This looks like some well-meaning, do-gooder idea, but I can assure you that it's the camel sticking its head in a tent. I'm referring to the breaking news about how four U.S. Senators (who apparently have nothing better to do) want to control what apps you can or cannot buy. They began their effort by nearly demanding that Apple eliminate any iPhone apps that help consumers find police checkpoints, so they can avoid them.
The rationale behind removing these apps is the Senators say the only reason people would want to avoid a police checkpoint is because they're drunk. Thus, they've rationalized that the apps are a hazard to the public.
The four U.S. Senators, all Democrats, are Charles Schumer of New York, Harry Reid of Nevada, Frank Lautenberg of New Jersey and Tom Udall of New Mexico, and they should be voted out of office as soon as possible. What's wrong with the voters?
In a widely quoted joint letter to Apple's iPhone VP, Scott Forstall, the Senators wrote:
We write today with grave concern regarding the ease with which downloadable applications for the iPhone, iPad, and other Apple products allow customers to identify where local police officers have set up DUI checkpoints. With more than 10,000 Americans dying in drunk-driving crashes every year, providing access to iPhone and iPad applications that alert users to DUI checkpoints is harmful to public safety.
If this is actually about public safety, then why don't the Senators also advocate removing all the apps that show the numerous speed traps around the country? After all, speeders are a danger too, no? In fact, speeding is the leading cause of death not drunk driving.
By the way, sober people like to avoid police checkpoints, too, if you haven't noticed. Who the heck wants to go through a police checkpoint to be grilled like a criminal for doing nothing more than driving down the street?
This whole thing is an attempt to regulate apps. Already we've seen the FCC poke its nose into regulating the Internet by getting involved in net neutrality issues. As this column is being written, meetings are taking place all over Washington to find ways to regulate the distribution and use of the Internet. Watch CSPAN sometime and you can see the guys ready to set up shop to do this.
This will eventually mean licensing. In the early 1900s, when the radio hobby was blossoming, you didn't need a license to broadcast anything. We thought free access was going to change the world. Then the government jumped in because things were supposedly getting too chaotic. The hobbyists were shoved into a few specific bands and the pros (commercial companies) were required to have a license. Soon the hobbyists (ham operators) were required to have a license too.
And where is all the real action in the radio spectrum? The unlicensed bands. Now, another Legislator, Peter King wants to ban the ham radio folks—the only people who manage to communicate during real emergencies—from operating. Again there is a bogus rationale. In this case, it's because of the idea that Muslim hams can plan terrorist attacks. This is our government at work.
The nerve of these four Senators to pressure a private company like Apple to sell or not sell something is incredible to me. This crap is just going to get worse as long as guys like this remain in office.

What they are getting at is they want to regulate the type of applications that are made available via public access application markets. They are not wanting to watch what is made available via, forums or what not, just what is on the market. It's a stupid idea to me. Developer sends app to google, FCC/DOJ clears the app it goes lives. This could easily be controlled. But you are 100% correct if someone makes an app, we'll say this DUI checkpoint app, and post it via any forum their is no way of one person, or group of being able to control it. Esp if lets say 2 dozen people store the .apk somewhere on a hard drive.

Ya thats cheap publicity stunt as they trying to show brain washed Americans they are actually doing something. Its all total BS when we should be worried about real issues in USA but we have to deal with these type of BS. I still don't see why we can't just hang them for high treason and get it over with. We all know Microsoft is on a roll to make patent licensing agreements with Android OEMs. Since last week, Microsoft have announced 4 such deals without disclosing the amount of royalty involved. Today Reuters that Microsoft is demanding about $15 per Android device from Samsung, one of the largest android OEM in the world. Microsoft is also ready to lower the royalty amount if Samsung agrees with some deeper alliance related to Windows Phone smartphone making. Microsoft signed similar deal with HTC last year, Will Samsung also join the fray soon? I hope Samsung agrees with Microsoft on the later deal of less royalty amount for Android devices and more Windows Phone smartphones. Also analysts predict Samsung to ship about 19 million smartphones this quarter, if the deal is done Microsoft will get about $1 Billion IP licensing revenue from Samsung alone in a year...
Now that is a beautiful puzzle, they've already released the most user friendly and in my opinion best is on the market and now they're putting a squeeze on the big name android OEMs to eliminate some of the competition. I love this, now just throw in some good marketing and well have the trifecta of a perfect operating system.
Leave it to Microsoft to try to take over! Company wars are so much more exciting than politics lol. Can't wait to see how this race produces!

They'll just weigh up the balance between paying a small amount to make a phone that will actually sell running a decent OS, or the costs of developing the minimum number of WP7 handsets to sit unsold in a warehouse while paying a smaller amount to make a phone that will actually sell running a decent OS.
It's a bit like supermarkets and loss leaders, will the loss on WP7 be less than the gain on paying not quite as much to make Android handsets that actually sell.

What tech did MS actually contribute to Android? Or better asked: What unique tech worthy of a patent did MS come up with? Most of these patents fall into the category where every even remotely seasoned developer can come up with the stuff. Of course we can't know for sure, because MS never actually discloses which patents are involved here. Because they know full well it wouldn't stand up to public scrutiny.
And that's assuming software patents make sense in the first place. Which they don't.
They really don't but hey, I don't make those rules. It doesn't matter who can make it now, it's who created it first.

So you just accept the rules, no matter what they are. The abuse of the legal system (attack smaller firms who don't have the resources to fight first in order to create a precedent), the mafia-style protection racket (pay up or else), the obviousness of the patents, the very ridiculousness of even having software patents, all that is ok. In cases where I think the rules are not too far fetched. I mean hell, if they did it first they have a right. As far as google not having the resources that's their own fault, iOS just did it first because they run their company with force rather than being laid back and just stealing info

Not at all but it certainly helps, I like having a phone that does everything I want without having to install any apps at all and without having to flash a new rom every 2-3 days. I love xbox live, I love a well implemented office, I love the keyboard, I love that the DVP despite it's weak processor is the most impressive piece of hardware out there for mobile devices, I like the hubs, I like zune, there's just nothing wrong with all of it. It is not flawless, but it's as close as a mobile OS comes.

Do you know why patents were created for? And what they're used for in reality nowadays? And in particular the nature of software patents? If you really believe what you just wrote, the clear answer to those questions is "no".

But what exactly is it that they did first? It's like I said, trivial things that any seasoned developer can come up with. Being the first to wrap it up in tons of legalese to be granted a patent on it is not an admirable achievement. Patents only make sense for things that are unique, where it took a lot of effort to come up with something new.

That's just the thing, MS *didn't* attack Google. They attacked small companies releasing Android products. HTC was the biggest and now Samsung is even bigger. But they're taking on Samsung only after the precedent was set with the smaller companies. That's abuse of the legal system.

Wow, hyperbole much? I have all that on Android. And I'm not flashing every two days. That I choose to replace some apps with other ones was just that - my choice. Choice is good. It means competition. It means people vying to create the best music player, the best video player, the best... well, you get the picture.
And what do you know, I have the lag-free interface too.
I guess if your product can't compete on its own merits, this is one way to go about it.

If more of the community was more intelligent then Microsoft would have no issues, sadly it's not the case. No one does their research or looks into a phone before buying it. The majority of sales reps have never even used a windows phone 7 thanks to the plague that was winmo.

I know a lot of WP7 enthusiasts and blogs like to blame the sales reps, but I don't think sales reps are solely responsible for the 36% market gap.
I do have an HTC Surround I've been playing with, and you're right, it has no lag, but I honestly haven't seen anything that would make me choose it over iOS or Android. Probably the only thing I would miss is the cool XBox Live avatar guy I made.

I guess it's to each their own. I like functionality, a smooth UI, and hardware selection. The office and xbox programs on mango are great, overall I think the only reason I ever enjoyed android was because I got to spend so much time screwing around.

Don't underestimate how much people like to screw around. I think that's the whole reason XDA exists in the first place.
A lot of people are surprised Microsoft is doing this, but truth be told this is nothing new. Intel licenses out their instruction sets such as sse2, sse3, 3D Now! to Amd, nvidia, and Via. Companies do this all the time.
I wanted to like Microsoft, because hey, that's where all my stuff is (I'm an MS developer by trade as well). BUT, they fell short. Waaay short. Navigation, Voice commands, multitasking, the list was endless.
I have a few XBoxes and almost everything in my house is Windows based, but the phone won't sell me until I can firmly say: "I miss nothing on Android that I use every day."
Specifically, the judge found that HTC infringes patents 5,946,647 and 6,343,263. The first relates to receiving information that can then be used by a single interaction from the user, e.g. receiving a phone number, automatically highlighting it, and tapping the screen to call. The second relates to the processing of real-time data on a handset.
The issue this causes is much bigger than just impacting sales of HTC device as the patents relate to Android, not just HTC hardware. If the ruling stands, then Apple could quite rightly go after every manufacturer that uses Android, be it a smartphone or a tablet, and demand their device be banned from sale in the U.S. In effect, Apple would stop Android in its tracks and remove its biggest competitor from the field of play.

Indeed these patents have only a few years left in them, yet for the first one loads of phones and computer programs have incorporated text recognition and processing, yet I don't recall Apple getting uppety about it.

I don't see that happening. If anything, Apple will license their products to Google for a fee or Google will pay royalties. That is if anything comes of it.
Apple is pushing too hard.
These are normal things, which everyone uses, has used and will use. All droid companies gotta do is bring up a small update for the call thing and then smear it in apple's face, idk about second one though.
This is no way near to banning androids all over usa, indeed apple just changes a few things, while using android stuff.
They have been holding out on new iphone, probably cause of this patent thing.
Android made it through the multi touch patent, this should be a piece of cake.

There hasn't been anything done by Apple on the multi-touch capacitive mobile display tech yet. Apple was just awarded the patent last month. In all likelihood Apple will wait to see what happens with all of its current litigation before determining what to do with its nuclear bomb.
Apple will never be able to put a finger on with the current models. Probably a royalty.

Apple applied for the patent around the time the first iPhone came out, about 3 years ago. The government just now found time to award it to them. I guess it took the government 3 years to study its validity.
I think Apple just wants some money - royalties - from HTC (or Samsung... or any other manufacturer).
There would be a big backlash against Apple if they were able to ban any android devices from the United States.
It's all about the money.

and severely threaten development of tech. by other companies.
When I compared many of the Android phones against the iPhone, I found the iPhone to be a dinosaur. Apple is running scared. It's time to innovate again Apple, not threaten and sue.
I like your auto manufacturer analogy. They each push each other to build better automobiles. They don't waste their time suing each other over who had which feature first. Although I doubt many of the features have been patented.
If you can't out-innovate them, out-litigate them.

Look at Google, Android phones use things Google developed (some unfortunately use MS developed things but we won't get into that). even look at windows phone 7, it uses MS branded services like Bing Maps, Messenger, XBL, things that MS developed.
but then there is apple. they have NO services similar to those that Google/MS have; no maps, no messenger, no search engine. No, all they have is a big ****ty store with 200,000 farting apps

Look at Google, Android phones use things Google developed (some unfortunately use MS developed things but we won't get into that). even look at windows phone 7, it uses MS branded services like Bing Maps, Messenger, XBL, things that MS developed.

I farted when I read about all of these farts! Android apps are better because most are free, ad revenue based. Farted again.
Looks like Google is ready to take it to 'em. And this is correctly targeting *all* parties involved. Not just Apple. And I'm glad to see Google stand up and wallop. I hope Google balances out the situation because Google is the only real and true, "worthy" company among them all. Google stands for humanity. The others stand for profits at all costs. With Google here, the others are usable and enjoyable. Without Google here, the others are the ruination of the industry.

Oh come on now, let's not get carried away. Google is a business as well. They care about making money. And they do it by collecting as much info about you as possible and then selling it to advertisers.
Now, I am against this patent BS and fully support Google in their effort to fight it. But lets not make Google into more than they are.

It'll be interesting to see how this all plays out. Google didn't come off looking too good after the whole Nortel thing by immediately going to the DOJ and blogging about how broken the patent system is(which it is). Android seems to be everyone's target these days

Was just about to post the same, so Microsoft asked google if they wanted to bid with them and google said no and yet they blog that crap...
How exactly would Google bidding with MS help them? They need patents to defend themselves from MS, to establish a MAD situation. They can't do that with patents that are jointly owed by MS too.
And this all shows the BS-ness of patents. Where's the stuff about patents encouraging innovation and stuff? Nowhere. All I see is patents being bought as bargaining chips.
I mean, buying some patents and using them to sue is totally about someone copying what you invented, riiiiiiight. Because buying = inventing, sure.
I can only repeat: It's all BS.

Well it works like this, you buy a patent with one of your competitors and then it can't be used against you by them.
It also saves you money as the cost is shared and there is one less bidder at the auction to ramp the price up trying to out bid you.
Sure, you then can't use it to make a deal with MS to infringe some of their patents for free, but if you don't win the bid, you can't do that anyway, and they can use it against you.

Or they could suck up their pride, have patents along with Apple, Oracle, Microsoft, etc., have this cross-licensing patent deal and have less lawsuits. On the other hand, they can buy all the patents and use them for "defensive purposes."
I don't like the patent system either and I am pretty sure that Google won't fix it.

Yeah, but there's tons of patents that aren't part of this particular portfolio. So all there would be is Google spending a lot of money while not being any safer from litigation.

What does this have to do with pride? It's all about needing to amass a large portfolio of patents just so that when you're sued (and you *will* be sued, because it has become impossible to create *anything* without infringing), you have something to defend yourself.

their street view cars can read e-mail too, ya know, they have wifi-detection software in the antennas of those cars.

every company sells info, hate to break it to ya. and the conspiracy nuts fail to reealize those antennas are there so they can detect a wifi hotspot like a coffee shop or private network, and put into the maps software.
imagine if you are a traveling buisiness man with a laptop, and don't have a wireless tether on your phone, also if you are in a dead zone (serious, all verizon customers, go to mound city, mo, just TRY to use your data there, you will be lucky if you get 1x, must have somthing to do with the bluff)
Google's biggest problem right now is Apple, especially with the recently ruling Apple got against HTC <I would post link if I could but I'm not allowed yet>. So it would have been beneficial for them to jointly own them with Microsoft, for a couple reasons. First being Apple isn't going to go after Microsoft, their patent portfolio is too big. But more importantly it gives Google more defense against Apple which is really what they need right now. I believe I read somewhere that Google only has about 1000 patents related to the wireless and I'm sure Apple has ton more.

well, technicly google got into the mobile market back in 2003 when they purchased then start-up company Android Inc.
and people forget that the iPhone wasn't the first capacitive touch screen phone
anyone remember the LG Prada? (yes it was a feature phone but the point is that it was a touch screen phone, the first of it's kind)

When I say Google is for humanity, I'm speaking in relation to their sphere of involvement, not a "Christ" or anything weird like that. Google cares about benefiting humanity with convenience and comfort. Example: If Google knew of a perpetual free energy source, they would reveal it to the public. The others might be inclined to keep it secret from the public because of deals or influence from battery makers or oil companies. Google would laugh at an oil company who wanted them to keep free energy from the public.
If Google discovered alien life, they wouldn't be inclined to keep it from the public in order to keep church safe. They would reveal any and every information that can potentially free humanity from tyranny. NASA would oblige the government for the sake of religious lobbyists in Washington to keep it secret so humanity can remain under control of the church that much longer.
Sure, Google is a business. Google is made up of people who have the same needs everyone else does and need to make a living. That doesn't mean they have to conduct their business like the "good 'ol boys" do. If Google fails, humanity will remain in darkness that much longer until another entity comes along and rocks the system.
