I just read this, and wow.
While I am not a programmer, I cant understand how apple is winning these disputes. If you read here

you will see that in some cases.. just having a SCREEN that allows you to touch it to control the phone is a copyright infringement, and that same screen that shows you the information is also a copyright infringement.
That's like saying a Ford truck has 4 wheels that roll with an engine providing the power is a copyright infringement on chevy
The potential is that HTC will be banned from selling phones in the US, but that article also says that all android devices break these patents.

apple is getting set up to get REAMED by the FTC for monopolistic business practices.. completely borked patent system aside, crapple may win these battles but eventually big daddy google is gonna step in and start throwing their weight around. i'd like to see apple try and go toe to toe with them

But seriously... most of the patents they've been granted are ridiculous
and severely threaten development of tech. by other companies.
When I compared many of the Android phones against the iPhone, I found the iPhone to be a dinosaur. Apple is running scared. It's time to innovate again Apple, not threaten and sue.
I like your auto manufacturer analogy. They each push each other to build better automobiles. They don't waste their time suing each other over who had which feature first. Although I doubt many of the features have been patented.

If you can't out-innovate them, out-litigate them.

Apple is just setting themselves up for a huge failure.

This is old news, regarding Oracle. That article would make you think Android is about to crumble, and that is not the case. At least he points out that re-writing the code, slightly, would make this go away.
Google has way too much power/$ to not fix this for Android, which has exceeded their expectations wildly.
In short, do not fret. Apple just being scared, as they should be.
Just like Jobs said recently via an email that Android is tracking people and that they do not.... ignoring all the articles about apple tracking people lately.

The iphone makes up 50% of Apples revenue stream now so Android is a massive threat to their business. Totally idiotic for a company or that size to have most of their eggs in one basket if you ask me.
Personally i think competition is good and keeps the market honest, but all this patent trolling that's going on is just ludicrous. It's no better than kids fighting over marbles in the playground.

This also is not really accurate.
How can you compare a hardware/software vendor to a software vendor?
When google is able to claim it makes the hardware its software runs on, then you can start saying Android is a "threat" to apple.
Google and Apple are entirely different beasts. Apple makes money when it sells its hardware, it includes the software "free" with its devices and it has always done this with any of its products.
Google makes software for multiple vendors, and makes zero hardware.
Apple has always been pretty sue-happy, moreso than other phone/computer manufacturers.

i would like to add 1 small piece to this although apple are a hardwar/software vendor it does contract out to people like samsung , so this apple google is also apple samsung writ , android and samsung together is a bigger threat to apple and apple think by sueing (as most companys do and would do in the same situation) both samsung and google may slow them down or as is most likely with the release of all the new smartphones ie galaxy s 2 and new nexus phones will generate a feelling within buyers that apple sell a better product because others are copying , this is not a serious attempt to stop android but with the timing so close to may first release date for sgs2 is more of a marketing exercise , for instance when google lost a case recently they had to pay 5 million $ where as if they had payed for the licence out right may have cost them 50 million $ dont take these figures to seriously but you get the idea this is the way business works and will carry on working as has been said before apple will still buy from samsung google will still develop android licences will be paid for in one form or another and someone will use somebody elses idea to improve their own and tommorrow will be another day

Sort of, it's powered by google as all android phones are, but it isn't MADE by google, it is made by HTC, and the Nexus S is made by Samsung. Google works with the companies closely for these phones, but the phones themselves are not manufactured by google, and I'd be willing to bet google doesn't design the phones and pic the internal components to them either so much, they probably have some influence, but I'd be surprised if they had complete control when it is the manufacturer who stands to make or lose money on the phone based on sales.

HTC infringes 2 Apple patents, could see all Android devices banned

Specifically, the judge found that HTC infringes patents 5,946,647 and 6,343,263. The first relates to receiving information that can then be used by a single interaction from the user, e.g. receiving a phone number, automatically highlighting it, and tapping the screen to call. The second relates to the processing of real-time data on a handset.
The issue this causes is much bigger than just impacting sales of HTC device as the patents relate to Android, not just HTC hardware. If the ruling stands, then Apple could quite rightly go after every manufacturer that uses Android, be it a smartphone or a tablet, and demand their device be banned from sale in the U.S. In effect, Apple would stop Android in its tracks and remove its biggest competitor from the field of play.

Indeed these patents have only a few years left in them, yet for the first one loads of phones and computer programs have incorporated text recognition and processing, yet I don't recall Apple getting uppety about it.

I don't see that happening. If anything, Apple will license their products to Google for a fee or Google will pay royalties. That is if anything comes of it.
Apple is pushing too hard.
These are normal things, which everyone uses, has used and will use. All droid companies gotta do is bring up a small update for the call thing and then smear it in apple's face, idk about second one though.
This is no way near to banning androids all over usa, indeed apple just changes a few things, while using android stuff.

There hasn't been anything done by Apple on the multi-touch capacitive mobile display tech yet. Apple was just awarded the patent last month. In all likelihood Apple will wait to see what happens with all of its current litigation before determining what to do with its nuclear bomb.
Apple will never be able to put a finger on with the current models. Probably a royalty.

Apple applied for the patent around the time the first iPhone came out, about 3 years ago. The government just now found time to award it to them. I guess it took the government 3 years to study its validity.
I think Apple just wants some money - royalties - from HTC (or Samsung... or any other manufacturer).
There would be a big backlash against Apple if they were able to ban any android devices from the United States.
It's all about the money.

Looks like Google is ready to take it to 'em. And this is correctly targeting *all* parties involved. Not just Apple. And I'm glad to see Google stand up and wallop. I hope Google balances out the situation because Google is the only real and true, "worthy" company among them all. Google stands for humanity. The others stand for profits at all costs. With Google here, the others are usable and enjoyable. Without Google here, the others are the ruination of the industry.

Oh come on now, let's not get carried away. Google is a business as well. They care about making money. And they do it by collecting as much info about you as possible and then selling it to advertisers.
Now, I am against this patent BS and fully support Google in their effort to fight it. But lets not make Google into more than they are.

How exactly would Google bidding with MS help them? They need patents to defend themselves from MS, to establish a MAD situation. They can't do that with patents that are jointly owed by MS too.
And this all shows the BS-ness of patents. Where's the stuff about patents encouraging innovation and stuff? Nowhere. All I see is patents being bought as bargaining chips.
I mean, buying some patents and using them to sue is totally about someone copying what you invented, riiiiiiight. Because buying = inventing, sure.

Well it works like this, you buy a patent with one of your competitors and then it can't be used against you by them.
It also saves you money as the cost is shared and there is one less bidder at the auction to ramp the price up trying to out bid you.
Sure, you then can't use it to make a deal with MS to infringe some of their patents for free, but if you don't win the bid, you can't do that anyway, and they can use it against you.

Or they could suck up their pride, have patents along with Apple, Oracle, Microsoft, etc., have this cross-licensing patent deal and have less lawsuits. On the other hand, they can buy all the patents and use them for "defensive purposes."
I don't like the patent system either and I am pretty sure that Google won't fix it.

Yeah, but there's tons of patents that aren't part of this particular portfolio. So all there would be is Google spending a lot of money while not being any safer from litigation.

What does this have to do with pride? It's all about needing to amass a large portfolio of patents just so that when you're sued (and you *will* be sued, because it has become impossible to create *anything* without infringing), you have something to defend yourself.

their street view cars can read e-mail too, ya know, they have wifi-detection software in the antennas of those cars.

every company sells info, hate to break it to ya. and the conspiracy nuts fail to reealize those antennas are there so they can detect a wifi hotspot like a coffee shop or private network, and put into the maps software.
imagine if you are a traveling buisiness man with a laptop, and don't have a wireless tether on your phone, also if you are in a dead zone (serious, all verizon customers, go to mound city, mo, just TRY to use your data there, you will be lucky if you get 1x, must have somthing to do with the bluff)

So it would have been beneficial for them to jointly own them with Microsoft, for a couple reasons. First being Apple isn't going to go after Microsoft, their patent portfolio is too big. But more importantly it gives Google more defense against Apple which is really what they need right now. I believe I read somewhere that Google only has about 1000 patents related to the wireless and I'm sure Apple has ton more.

well, technicly google got into the mobile market back in 2003 when they purchased then start-up company Android Inc.
and people forget that the iPhone wasn't the first capacitive touch screen phone
anyone remember the LG Prada? (yes it was a feature phone but the point is that it was a touch screen phone, the first of it's kind)

When I say Google is for humanity, I'm speaking in relation to their sphere of involvement, not a "Christ" or anything weird like that. Google cares about benefiting humanity with convenience and comfort. Example: If Google knew of a perpetual free energy source, they would reveal it to the public. The others might be inclined to keep it secret from the public because of deals or influence from battery makers or oil companies. Google would laugh at an oil company who wanted them to keep free energy from the public.
If Google discovered alien life, they wouldn't be inclined to keep it from the public in order to keep church safe. They would reveal any and every information that can potentially free humanity from tyranny. NASA would oblige the government for the sake of religious lobbyists in Washington to keep it secret so humanity can remain under control of the church that much longer.
Sure, Google is a business. Google is made up of people who have the same needs everyone else does and need to make a living. That doesn't mean they have to conduct their business like the "good 'ol boys" do. If Google fails, humanity will remain in darkness that much longer until another entity comes along and rocks the system.

Nice find. The I love that article. The main reason I will never buy apple. Their products are decent, not my taste but decent. Even if they came out with a great phone I would be hard pressed to put my money on a company like this.

The attention whore is back! You want to talk about stealing?? Youtube search Steve Jobs on stealing. He says word for word, "Good artists copy, but great artists steal." Youre just a biased android hater. Jobs said himself that stealing is a good tactic so obviously Apple has done a lot of that.

This is the same Apple that has initiated a patent war with its smartphone rivals. And it's the same rival that has tried to remove competing products from the market, rather than agree to negotiate a licensing fee. And it's the same company that patented multi-touch gestures 26 years after they were invented at a research university. And it's the same company that allegedly doctored evidence in European courts to support its lawsuits against Android. And yet this company claims android-based smartphone manufacturers are abusing the patent system.

First of all Google only provides the software HTC, Samsung and other companies provide the hardware. Secondly Google android looks nothing at all like iPhone ui. IPhone is plain where as Google has customization with Widgets notifications and an open source market. Google android is so good that apple decided to implement it into there phones through ios 5, so I wouldn't be talking if I were you.

I'm fully aware that googlr only provides the software, the software is what is used to steal everything. You CAN customize android to look however but by default its the same boring 4x4 slab of icons and that's how your average consumer will keep it. Android looked like blackberry OS until they saw the iPhone. Android has an open source market which has made it the 2nd biggest target for malware, it is expected that almost 1/3 of android users will encounter malware on their phone within the year. The most common varieties of this malware end up adding a hefty sum to your bill, these can be found on the "open source marketplace" that you're so proud of. As for your last statement saying apple is implementing android into iOS5 the only thing they've got that was stolen was the notifications bar. I'm no apple fan, but I feel justified in calling you an idiot.
Man everything that you mention makes you sound like an apple fan. Just get the hell out of here because no one likes a whiner who *****es about Google and says he's no apple fan. Funny once apple sues samsung its all ok , block their sales all good , but once apple gets hit back with same meassure then everyone else is abusing pattents.
Lets face it apple wants to put a stop on so fast and developing android phones and software, all they can is try to find loopholes and sue.
We will see where apple will be in 2 yr time and where android will be.

Apple does not innovate. They steal many ideas and clump them into one nicely built product. However, most tech companies do take other's ideas and build on them. Apple, HTC, Samsung all feed off of eachother. However, it is a problem when Apple decides they can steal but no one else can, and thus this stupid patent war.

All companies are the same. If Google was were Apple is, they would be doing the same thing. This goes for all other companies as well. Even the US government is getting into the suing business. They're suing companies and institutions right and left. It's "sue" pandemonium these days...like a carnival. I watched a "Sliders" show once, a very long time ago, where they slid into an alternate Earth were everybody was suing everybody else just for looking at someone crosseyed. Planet Earth seems to have slid right into the same episode as that Sliders one.

I know they do this kind of "research", and I know I'm watched everywhere everyday by cctv or whatever. But I just want to know how they do this, in what kind of conditions and by what tools. So I can make myself as best as possible.

Which from the look of the articles it is tracking users.
Though I don't remember this properly but once Google automatically deleted a particular malware from all of it's affected android handsets without notifying them first.
In the end, this may have been for the betterment of the users. But if this is where Google sets the line, I'm against it. This is violation of privacy.
As for Microsoft, this was no different.
Did he really just say if Google was where Apple was at? Really? Last time i checked Google has passed Apple in well almost everything.
