Dumb me got scammed, but Tmobile said for sure I would have no problems =( ESN - Nexus 5 Q&A, Help & Troubleshooting

Ok so I bought a phone off craiglist. I'm pretty cautious and had the customer service number and called Tmobile with the ESN/IMEI number. I asked them specifically if the person were to cancel their contract or if there was a contract or can anything that seller do in the future cause me problems and they said "NO". Now 7 weeks later the ESN is blocked. Do they keep records of my conversation? I had tmobile service and even have the time I called them since I still have the texts from the guy who sold it.
I called the guy and he said he would take care of it, but he could be just saying that then blocking my calls now so who knows. Has anyone had Tmobile fix the problems since they were the ones that said things would be fine? I called them and they said "no", but I didn't have the exact time and just realized I know the exact time and date I called them.

Yeah for sure. That's why I said is there any possibility that it can get black listed and they said "no". The lady yesterday on the phone said they don't recommend buying from a 3rd party. I wish the person I spoke to said that. I almost can't blame the guy who sold me the phone since I got off the phone with tmobile in front of him after they guaranteed no problems. :crying:

no, you should blame him, for not being truthful. he had the phone blacklisted or he "stole" the phone from them by not paying for it.

Is it black listed in foreign countries like Taiwan? How about mainland China. My gf can send to her family in China. So I can disclose it is blacklisted and maybe it's worth $150 to someone who can take it out of the country. My other friend is from HK so he can send to his brother.

no, just in the US. i dont think that canadian carriers are involved either.

Next time use swappa to see if it's being financed or not. If it's financed, don't buy it. It will tell you if it's fully paid off. It can't protect from it being a stolen phone, but it can help.

[Q] Changing phone under warranty

Hi,
I have my Captivate since August 2010 (1007, Rev 0.4) and the GPS never, ever worked "right".
I seldom get a fix, tacking is impossible. So I decided to exchange my phone which should still be under warranty.
Problem:
I'm from Argentina and I bought my phone in the US while I was in a work trip (eBay). the phone is from AT&T (has the logo printed on it).
Since I really don't know how warranty works in the US, I was wondering what are my options, if any, to exchange my phone.
I DONT have a plan with AT&T.
Should I go to AT&T or should I go to Samsung?
Can someone help me out?

Op since you don't or never had a contract with att there would be no point to contact them. And I'm not quite sure if samsung will replace it if you bought it used on ebay, but I would try with them.

I would say they're optimized for national use, but I could be wrong. Wouldn't it save money to strictly be using it in the US?

Yeah if you were using att and paying roaming out the ass!
You can unlock the phone and use other carriers sim cards no problem.

Then your only option is samsung. And since your out of the country idk how it works. I assume they will just ask for your IMEI number and go from there...

That's very sad, but there's probably nothing you can do except using a different IMEI and just using your SIM card in the One S.. blacklisted IMEI is blacklisted. There's a possibility it was marked stolen or lost, possibly for insurance fraud (claim as stolen, get new device for ~$100, sell 'stolen' device for $450, profit), or possibly for non-payment of bill..

yea i guess thats what happended it worked for a month now is gone , but how would i get a diif imei number i think thats impossible
You cant get a different imei. Long story short you are screwed. Try to sell the device for $200 the most that you can get
dude that is terrible !!
I would hunt that seller down and kill him, Or ring the police on him..
Try explaining to the carrier that blacklisted the phone whats happened, they will know who the previous owner is and they can get him done for fraud

I agree. I am assuming you called tmo to activate the new microsim card when you got the phone. And when you activated, that imei should have been put on your account. I suggest you ask tmo to clarify how this happened.

yea this a new thing i was reading once the phone is blacklisted all major carriers in the us will block it , i did call they just said to return it back to the store where i bought it smh they said they cannot do anything about it

I would push it further with T-Mobile. I would ask to talk to a manager, and that manager's manager. Tell them you want to know who reported it lost/stolen so you can call the police for fraud. I would also insist on them telling you WHEN it was reported lost/stolen. If it was AFTER you activated the phone on your account then you need to know who reported, again, to report to the police.
I don't suppose you did any type of hand written receipt did you? I NEVER deal on craigslist (accept to sell). Ebay only, they have buyer protection.
EDIT: Then again, there may be privacy reasons that they cannot tell you who reported. Just sucks. You got the guys number still?

45 days protection with PayPal and usually say buyer eligable for protection on your transaction....I notice a few adverts are appearing with Bank Transfer
If it was.sealed and never activated can it still be.reported ? Isn't that even more of a danger ?

Yeah my case sounds a lot like something posted above guy said it was an upgrade but he wanted a note he had two one was open to register the sim and the other he said he just kept old sim for the note when I openes it everything was fresh never touched the stickers didn't look like they where pulled from the box either I guess all I can do.is wait and hope .

Coming from a tmo insider. Your phone is black listed because the guy you got it from didnt pay his bill. If eq is purchased on the value plan and It's not paid they will disable the device. Only way around is to bring the account it was on current

So I bought a Nexus 5 from someone in person, they gave me the receipt for it and the box un-opened. 2 weeks late the phone was put on a Blocklist (lost/stolen). It is a nexus 5 so it can be activated on all carriers. The phone was from Koodo and I am on Rogers. What are my options here? I can't get a hold of the guy that sold it to me, but I have his phone # and first name. And the receipt of course. Are there potential reasons this phone would be put on a lost/stolen list? Is this some sort of method created by the seller to get his phone back and with no payment proof (I paid cash). The phone worked for 2 weeks before being 'blacklisted'. So something is up.
I did not steal the phone, I made sure it worked before I bought it. It was brand new unopened. I met the man in person at a public place. I just want my damn phone to work! I believe that if I call Koodo they will assume I stole it and ....do something about it?

Blacklist means stolen and you're hosed. Up to you if you confront seller and I doubt you'll get police to assist since technically you possess stolen property. Call and ask if you surrender device to them would they help recover from thief.

Why would he supply me with the receipt, and why would it only get disconnected 2 weeks later.
This is frustrating, i'm pretty sure he blocked my # too so I get busy signal when I try calling him.

Sounds like you bought a hot phone. Why else would it be blacklisted? Something tells me you bought it out of someone's trunk for some ridiculously low price, so what do you expect? You're in possession of stolen property. If something seems too good to be true, it usually is. Since it was brand new, and they had a receipt, it was probably stolen from a retailer, so they probably won't bother looking for it. I mean if they were looking for it, the police probably would have knocked on your door already, it's easy enough to track a smartphone, and besides it's not like stores and the police don't have better things to do than to track every piece of merchandise ever stolen, they'll just write it off as shrinkage. Live and learn.
I work for Rogers and the best thing i suggest is to call koodo and explain the situation. Show them the receipt and they will probably work something out with you. They can call there help desk and remove the phone from there blacklist. Most likely they will just write off the phone. You may need to pay a fee to get it removed from the blacklist though. Next time order from the play store.

Umm.....typically retailers don't give receipts when you steal something. The presence of a receipt would indicate it was stolen from someone who purchased it.

Yeah this fellow should probably check the receipt to see if the IMEI is on there and if it is that it actually matches the IMEI on the phone and the box.

This sounds like a likely scenario...the seller posted on CL early in Dec for an Nexus 5 or LG G2 wanted...several days later he posted a BNIB Nexus 5 with receipt, which OP purchased. Seller is still active on CL with other phone offers.

For everyone's info: the IMEI on the Phone matches the EMS on the receipt, it was purchased from a Future Shop. EMS and IMEI are the same thing I believe.
There is an 8 digit number written in pen on the back of the receipt as well. This could mean anything I guess.

Swappa clears the serial before sale, and buyer has some recourse if sale if falsified or otherwise not as described.

Sprint blacklisted phone

I am looking at picking up a 2nd nexus for the wife on Craigslist. I can get a good deal on one but the guy is still paying on the payment plan. If he bails on his plan afterward would the phone still work on at&t and T-Mobile OK? I assume sprint would blacklist it and I don't really care about that.

A good number of All but one of 'em are unopened/New,they probably bought 'em to take advantage of the $200 Rebate & headphone offers.
As long as they have a net gain from purchase price/rebate/sale price,I suppose it's a worthwhile endeavor.........

T-Mobile is basically giving these things away. If they used the trade in thing, it makes the phone either free or less than $200. They probably have another phone they are using and don't plan on leaving T-Mobile, so they just got one and are selling it. T-Mobile, effectively, puts you in a contract doing this. They take the price of the phone and give you bill credits for the whole term of the EIP. If you terminate service, you owe the phone. Combine that with the free line promotion they had a few days prior, I am guessing this is what is happening. The contract does not say anything about using the phone. As long as they keep their bill current and keep their service, it will be able to be used (I think...). I would be careful buying one of these V20s in case you are not allowed to use the phone on a line that isn't associated with the account, but that is me being a worry wort.

Swappa won't let you sell a phone that still has anything owed on it. They check the IMEI.
I assume the bill credits wouldn't affect this as long as the phone is free and clear.

I assume lot of the unopened were bought with significant discounts. They are being sold for $500 +/- $15.
Watch out t-mobile is the carrier that's gets the lg partner purchase program phones. They can not be carrier unlocked. That's why there up and cheap.

Won't work. When they go to get the unlock code from T-Mobile the imei isn't in their system so they can't get it and it can't be done. Trust me. I've seen this happen on the v10 and g5. Just look it up.

If that's the case, I'd think the sellers would know better than to post a listing on Swappa.

There not fraudulent. Not sure why u think that. Theres nothing wrong with selling lg partner purchase program phones. They just can't be carrier unlocked and the sellers don't go out of their way to tell you. They just say their not sure.

Full disclosure is a given when selling on Swappa,anything less would be fraudulent,if not to the letter of the rules,it certainly would be in spirit/practice.

Yeah ur right. Lol I wast trying to buy a v10 and g5 earlier this year and ran into this situation. Very difficult to deal with. Most sellers selling them do t really understand them selves and they blame T-Mobile. It probly is T-Mobile fault since it's branded T-Mobile. Just want everyone to be aware they can't be unlocked, even a third party unlock service can't. Having it on ur account for 40 days doesnt matter either. It's a crappy situation lol

I'd heard of employee deals/mfg-partner phones/etc..,but,I didn't know about the SIM Unlocking issue.

Bulletproof,no,but,it sounds as if they're doing their due dilligence w/researching the ESN/IMEI,perhaps w/more tools than the general public is armed with.
Some sharp individuals here on XDA/Swappa running the show,I'm guessing/hoping they have this scenario covered,enough to ensure the buyers are protected in a worse-case scenario.
A little bit off topic, can you get square trade insurance for phones purchased at swappa?

Um I'm not trying to be a pain but I bought my G5 from Tmobile and had it unlocked in 24 hours as I was traveling out of the country. I used the app on the phone and the code the rep gave me. I've traveled to 7 countries since then and used sim cards from each one no problem.
