They have won already. Google announced they are altering android to ensure it satisfies apples lawyers.
One thing being changed is searching. Voice search will no longer return local results because apples patent means only siri is allowed to offer local knowledge.

Its the nexus win that has forced google to change android so the htc case is not a factor now that google are changing the os apple have their first android change rather than manufacturer specific as htc win was when apple won an injunction before.

While I think it's stupid, it's not the judges fault. Their job is to make the decision based on whether the patent was infringed or not, even if they think the patent was stupid (haven't heard from the judge so I can't say what their personal beliefs on the matter are) if it was infringed they have to rule in favor of Apple if they believe there to be infringement.
I do not know why everyone is riding the judge for her decision. It is her job to interpret the law and use other cases as guidelines. Apple is winning in the US, but mostly losing in the UK.
But, yes, Apple is losing marketshare to Android. The more mature thumb optimized touchscreen smartphones become, the more options OEMs must give consumers. That Apple one phone a year model will cease to work magic and they will find themselves in a position they do not want to be in - no more of that high margin, one device fits all once a year, planned obsolecense all wrapped around a marketing hype machine.
Well when your backs up against the wall, thats the time to become creative.
Apple is only taking a little chip with the voice search on ics but google will fix it for now until they get that idea (like pull down notifications, Genius!!) and make apple and its customers jealous. Steve Jobs (rest in peace, great man) is gone and apple is stuck re releasing the same crap just fixed up. Ex. The New Ipad, better screen, faster. and Iphone 4s, faster, with some dumb virtual assistant. Only people like Samuel L Jackson use Siri like the commercial shows but all of us get bored within hours. Apple is staring at a blank page and the essay is due tomorrow. There really isn't any must have, new technology(like front facing camera or dual core processors, and 3d screen) out right now that would get people buying them instead of android. Android stepped up, with play and jellybean and there is going to be much more to come. The Gnex will be back in a week, badder and better than ever.
If i was Google Ceo and some kid like Apple wants a fight, I get Jellybean on every new device and most popular old ones, then pull youtube off iphones. but then again im not the Ceo.

If this ever happens i would rather go back to a flip phone or have none at all. I would never give apple any of my money.
I refuse to get an Apple device, but this won't effect available devices in stock or on eBay, so good Android devices will be very rare if this goes the way Apple wants... I'll tell you one thing, eBay prices for Android Devices will go sky high.... (used or not...)
Edit: I miss flip phones anyways, so I'll go old school if I have to...
i have an ipad, and this makes me want to smash it. Apple, you do not own the world, you were not the first to create a "list" on an electronic device. If your so afraid of Samsung, then just build a darn phone with a bigger screen, i wont buy it, but tons of other people would. Fair competition is good for business, it keeps ingenuity alive and keeps engineers pushing the limits of what can be done. Competition is THE ONLY REASON we have the superphones we have now. If apple owns all the rights to make anything that even resembles a smartphone, we will have the iphone 4s renamed and sold as a new product for the next decade.

Well some of what this says they currently have rights to like list view is bs because before the first iPhone was released I was able to use list view on Windows mobile for years. So unless I've miss read, something isn't right or maybe my aging memory is wrong.

Do a factory reset, sell it, buy a Galaxy Tab, then shove it in your Apple Store representatives face showing features that the iPad doesn't have... No reason to smash something worth hundreds, (although the company who makes it is pure evil...) But I agree with what you were saying completely...

I have the HTC EVO View, while I am not a fan of HTC, nor the EVO Series, I don't regret the purchase... Now there is wayyy more support for tablets and specialized tablet UIs.... Now just make sure you get a high end one that will be upgraded to Jelly Bean... (It's not worth getting one on a data contract, as you can tether from your phone to your tablet...)
Note: The EVO View nor HTC Flyer will NOT Get ICS nor JB so don't even bother...

Android is here to stay. Google and samsung have some pretty good lawyers too. It's total BS that this kinda stuff even goes on. The only people getting rich on this are the lawyers. If they were smart, they'd sit across from each other at a conference table and make a truce and move on.
Now that Jobs is dead, it's just a matter of time before Apple slips into irrelevance. Nobody there has the passion he had about his company, and nobody is gonna defend it like he did.
That 40 billion they have will be squandered away on bogus patent law suits. Money that could have been spent on more cutting edge development. Everybody knows that patents are crap. Your better off not even applying for a patent and get the thing to market first. By the time they figure out what you did, you come up with something new. A patent application is an invitation and a headstart for everybody else to steal your idea. The company thats ahead of the development curve, and gets it to market fast and furious, makes the money.

I will give it to Apple the iPhone was a brake through, but since then Android came out and is user friendly with developers willing to make the devices better and faster more customizable. The court should get sued for taking away our right to choose what we want to purchase. I will rather NOT have a phone or an old crappy phone than own a crapple device. I will order my phones through China or Japanese manufactures. but owning a crappy device I will not!

Let's face it.. this doesn't make sense to me.. Apple is a huge American company, Samsung is from Korea.. so for a case so big shouldn't it happen in some international country or something? And plus guess what... the jury is 9 American citizens. Seriously? They probably have some iStuffs, their wives,husbands,kid,friends probably do.. so which side do you think they would be on?
Anyways this is what I think, and why I am not surprised Apple won on all counts..

Oh I knew it was gonna turn out like this. About 75% of the population here see a smartphone and label it a iPhone, they see a tablet and label it a iPad. Who did you think the American public was going to side with. That's the power of advertisement Apple controls over all smartphones & tablets. When you are able to replace the generic name of a product with your brand name for that same product and have the whole population calling it that way you are in control. (Q-tip, Vaseline, Band-Aid, ChapStick, Windex, iPod, etc.)
Really when you think about it, the ruling isn't surprising at all. Apple wants to get rid if their competitors and lawsuits are just one way to do it. In my mind, a really cheap and almost disgraceful way to do it, but, that's politics for you! No one remembers Tucker (old car company) but i was wiped out by the Detroit 3 through a lawsuit as well. Only 50 cars were ever produced because of it.
I hate politics, but this is how things go down... Hopefully, up here in Canada we don't have repercussions from the American trial, but who knows right? All three of my phones have been Samsung, and I want my fourth to be one as well, even if I have to buy international.
Apple... Great products, however they need to stop suing about everything. But that's politics, and I hate them.
Samsung... Best of luck to you. I want another great phone... Maybe make it in the shape of a circle so Apple can't sue about the shape (how can you patent a shape anyway!? I might as well patent the sphere and sue all the ball makers in the world. )

I'm not surprise with the verdict. I expected crApple to win, not because of the patent infringement claims, but due to their huge advantages. Basically, Samsung was the underdog in this case. Keep in mind that crApple's headquarter is just a mere 10 miles away from the courthouse and the jurors were picked from the heart of Silicon Valley, where Steve Jobs was from.
It could be that they let Apple win because Apple's a really big company that supports the American Economy

I was kind of surprised since the jury got to use some of the Samsung devices to compare. Usually when I'm around someone who is messing with their iPhlop I let them mess around with my phone and 90% of the time am asked if I have any for sale.

Its sad really. Do you see Bentley and Mercedes suing Hyundai for making their cars look like ripoffs? Designer clothes stores suing old navy for clothes that look exactly the same? A third grader for drawing a rounded rectangle??
I just couldn't help at Tim cook's release to his employees about how they were reluctant to sue and how they want to protect innovation for all. Bunch of goddamn money hungry elitist assholes. If they really cared about innovation and technology they would be a little more concerned with moving the whole segment forward, not hoarding everything to themselves.
That being said, some things Samsung did really are ridiculous copies (the charger cube for our phone looks exactly like the iPhones...)...and they should have partially lost.
They won't make it very long after people don't think their **** is so hot anymore and they burn all their cash on stupid lawsuits...watch out in the near future for a bombed product upgrade...could come as early as the iPhone 5 I bet.

I don't see how Apple won in a business sense.. Samsung had already established themselves as the number one smartphone manufacturer in the world by focusing on territory. Now they can focus more on design. It was a billion dollar gamble that paid of nicely. They don't need to do anything but but put out a bunch of vanilla Android devices with top of the line hardware and a physical design that doesn't look like an iPhone. There are many possibilities. This was a win for Samsung and us since we will get less iOS look and feel and better functionality.

As much as I love android I do remember shopping for a phone and picking up the galaxy s fascinate and thinking to myself "wow this really looks like an iphone".. Samsung really should have done something to better differentiate the 2 phones.. However I never for one second got it confused with an iphone.. I love Samsung phones but some of their phones did look like blatant copies.. I agree that a rectangle should not be patented but i also think that Apple has a right to not have their products copied so closely... That is why they won their case..

google doesnt care about right or wrong. They are probably negotiating with Apple to have a peace treaty then Apple will go after Samsung and when thats done break whatever agreement they have with Google. Google will act blindsided but they should of seen it coming a mile away.

I think the point of Apple not being able to provide LTE speed is an interesting point but may not be a major factor...ease of use may win out over speed for users that are less than savvy...although we know our devices are pretty common sense, I watch my mom try to use her Desire HD and cringe lol.
All we can do is wait and see...
Apple is getting what they deserve. When you use someone's technology and hen try to claim it as your own and sue your competition, companies will start to take notice. They really do take other people's innovations and use it against them. People do notice this stuff. And after suing the makers of one of the key components of their phone, they really did bite the hand that feeds them.
Google was smart to go with Motorola because they have lots of patents, and this should mean android will continue to take over apple. And I do think that the Samsung and apple case findings will be overturned so I really do think apple has cooked their own goose.

I wonder what would happen to Apple if Google blocked all Apple devices from accessing any Google service. This would hurt Google badly, but it could serve to cripple Apple. Yahoo! would be estatic, but Google is currently intertwined so intricately into the fabric of the internet any device without access to Google services is a child's toy.

They could sell out a device with no pomp and circumstance simply by relying on the viral nature of the internet. A few well timed and coordinated leaks and it started a wildfire with rumors and speculation.
No renting out convention halls, expensive advertising, official teases, etc. They proved how powerful their brand is without having to do much at all. The community took every single rumor and ran with it. It is pure genius if you can get away with it.
Hype reached a fever pitch this morning and out of nowhere the flood gates were opened. What benefit would an announcement have made?

So true. However, I feel like normal people who aren't checking tech blogs all the time won't really know about the device. Then again the Nexus line has always been meant for "developers". Although, it's starting to become more than that. I'm not sure if not broadcasting the phone's release to everyone besides techies is really enough.
Just curious I guess, We'll probably never hear an official reasoning from Google though :|
Maybe releasing it like this was a nod to their faithful nerd following, allowing us in the know to get first crack at the device. We were following the tech blogs, we were building the hype for them, we were keeping the rumor mill churning.
Word of mouth is powerful, a handful of happy nerds with their shiny new toy in hand are more likely to give a glowing recommendation than a pissed off nerd that's left waiting to get their hands on the device of the year.
There was a lot of bad press last year because so many that wanted a 4 simply couldn't get one. This year, those of us that were most looking forward to the 5 actually had a chance to get one.
I predict that marketing will pick up soon after these first units get out there.
I'm happy they did it like this, it makes me feel like they care about us nerds!
