Don't get me wrong...apple makes good products for people that dont know enough tech stuff to stray into non-apple territory or for people that want to be a trendy douche. Actually, it was worse than that. The case was tried in a San Francisco federal court, about 20 miles from Steve Jobs' home and 40 miles from Apple's headquarters.
And some jurors lived or worked a few miles from either of these.
I'm still trying to figure out why anyone calls this a failure on any level. Did Samsung copy some things? Yes. Did they copy everything? No. Did Apple win a case that gets them some money(as if they need it) and a POSSIBLE injunction on products that are currently outdated(by sales standards)? Sure. Does it matter in the long run? Not especially. Why? 1) Because they can afford the billion and change. 2) Their new and fast selling products are not on the injunction list and the ones on it have sold millions of units already. 3) All this does is set the tone for the inevitable licensing deal that will net BOTH companies money. 4) Where does Apple get 75% of the hardware required to build an iPhone? Having an iphone before the SR, I would say that an average user is better off with an iphone.
Technical users definitely should get an android.

I can only give you my opinion on that. I owned iPhones before Android devices, and the reason I find them superior is based on the open source aspect of the OS. I am all about customization of all my computer hardware. I like to upgrade memory, hard drives, and visual and productive features. Android is perfect for this; in fact the OS practically cries out for it. Apple does not make bad products; their equipment caters to a specific kind of user. If you want high-quality hardware where price is not an object and the hardware is ready to go out of the box, then Apple has good stuff to offer. If you want to upgrade their equipment or modify it, on the other hand, you are in for a hassle. Did you know that Apple tried to have the people who first 'jailbroke' iPhones locked up? Seriously, a judge had to tell them that once they sell their **** to somebody, that person can do whatever they want to it. Now, they have to be content with slamming you back to stock every time you update their firmware. Android vs. Apple is basically an apples/oranges kind of argument if it comes down the hardware itself. But, Android hardware offers not only the ability to upgrade and modify, but you can get in there and attempt to create personalized versions of current OS offerings. It is one of the things I am doing right now(see my sig). Apples equipment is top-notch in the quality area; I think even Apple haters would admit that much. But, they stifle creativity by the very nature of their heavy handed attitude towards the customization of their products. And as Forrest Gump would say, that's all ah have to say about thaht.....

It really doesn't matter what type of outstanding specs these guys put in the upcoming android phones, Apple's Iphone is the number one phone out there. These manufacturers have forgotten that it was Apple that brought the price of smartphones down drastically. You don't beat the number one product on the market by charging MORE for your product.
Now that Apple is on multiple carriers, Android cannot afford to make such critical mistakes. The recently announced prices on upcoming android devices have made me wait for news on the IPHONE 5. I will pay MORE for the number one phone, but damned if I'm going to pay MORE for a phone that doesn't even receive updates till the next model.

You may not be a noob from a tech standpoint but you are from a business aspect. The iPhone outsells because of image. People are sheep - they want something that is spun in a certain way - Apple does the marketing for the one phone product they offer. Android doesn't have that luxury - it has 20 different manufacturers so there is not ONE Android phone to compare to the iPhone.
People buy iPhones because they see ads for one appstore, for one company, etc. it is simple and fits the simple mind. Price has NOTHING to do with it. If it did, no one would buy the higher capacity iPhones. Look at all the people that waited in line to buy the first iPhone - no product reviews, and no subsidy.... where is the price theory there? They buy them today on eBay for $800 - not rational - but supply and demand dictates - along with perception and the idea of being a sheep.

I think in the coming years we'll see the iphone go the way of the blackberry regardless of its lemming followers. Apple is constantly introducing new OS versions with hardly barely any significant feature changes. When multitasking was introduced, it absolutely destroyed any hint of speed on the iphone 3g. Yet, we've been multitasking with android since introduction on hardware that is just slightly faster.
With every Apple update, the older devices get slower, yet with every android update, devices that can run the update become faster, and more responsive.

Sales numbers don't make something better lol microsoft os's are not better than apple os's but out sell them and are the most sold os out there. Not to mention iphone gained popularity way before google released android and just has a huge fan base, plus popularity of the ipod helped out a lot to.

This is nothing more than opinion and partial facts/ incorrect facts. There is no doubt the iPhone/iPad sell better. There is also little argument that Android missed the mark with their tablets/tablet marketing. But in no way is Android dying.
I would counter this article with how long will iPhone users upgrade to the same exact device with the same non evolving software before they start to get bored? I couldn't bring myself to buy a 4 after my 3g because the device bored the hell out of me. I walked into the Apple store, picked up a 4 and said to myself why in the hell would I lock into two more years, they practically changed nothing.

He hit the nail on the head. The iphone carries the user friendly market, as long as there are techies(men) and those who simply don't follow the crowd android will thrive. I do agree that Google should implement some kind of OS requirements, as many devices that could be running ICS are not, but to the previous comment of I walked in and said this really isn't any different than the 3g...that is pretty much it...apple will be apple, android is at least fresh in this perspective.

The Kindle Fire is an Android Tablet, as is one of the B&N Nooks, guess no one buys those. The Galaxy Tab 2 7" also seems to be selling well the way it looks. There is an issue with tablets, but it's mainly a price issue, not features. Google and developers are working to solve the app issues.

It's at 5% of the market and growing. With 300k new activations daily, that means at least 15k new ICS devices are joining the market every day. Now that OEMs are finishing up the ICS updates, and releasing their new phones/tablets with ICS, that is only going to grow over the next few months.

Yeah, HTC bringing in $2.3 billion in revenue is floundering. Even with profits down, they still made nearly $200 million in profit for the 1st quarter. Given the success of the One series phones, that will probably go up this quarter. And Samsung markets phones for everything, and I'm pretty sure they mention Android for the Android devices.

I would say the Galaxy Nexus equals the iPhone 4S, and the just announced SGSIII will be the equal of the next iPhone in terms of hardware. Software, it is an apples v. oranges comparison. However, I have seen comparison tests that show it is usually faster or easier to perform simple tasks on the Galaxy Nexus versus the iPhone.

The Kindle Fire is an Android Tablet, as is one of the B&N Nooks, guess no one buys those. The Galaxy Tab 2 7" also seems to be selling well the way it looks. There is an issue with tablets, but it's mainly a price issue, not features. Google and developers are working to solve the app issues.
It's at 5% of the market and growing. With 300k new activations daily, that means at least 15k new ICS devices are joining the market every day. Now that OEMs are finishing up the ICS updates, and releasing their new phones/tablets with ICS, that is only going to grow over the next few months.
Yeah, HTC bringing in $2.3 billion in revenue is floundering. Even with profits down, they still made nearly $200 million in profit for the 1st quarter. Given the success of the One series phones, that will probably go up this quarter. And Samsung markets phones for everything, and I'm pretty sure they mention Android for the Android devices.
Because iOS apps cost money, where the same app on Android is free. Android users will pay for apps if they're good, just that usually, there is a free alternative that is just as functional as the paid version.
If they were loosing money so badly on Android, why does it continue to exist?
Working just fine on my 4.65" touchscreen here. I have more issues typing on the on-screen keyboard of the iPhone than I have with any of my Android devices.

Unless the next iphone gets larger there's only so much you can shoehorn into a smaller form factor in which case apple customers could start looking elsewhere but as it stands there are a few android phones that could beat iphone including the s3 and optimus lte2.
But if android were dead then samsung lg and htc would all be failing miserably and their not.

This is one of the more interesting questions. I do believe that Apple revenue of course includes the app sales. Does anybody know more about this point?

My opinion is that Android is more secure than iOS. It is open-source, so anyone can look at the code (most of it anyway), find issues, fix them, and then submit the fix for inclusion in the next update. There is also SEAndroid being worked on by the same group that does SELinux. Apple is closed source, so when a problem is found, you have to wait for Apple to fix it. You can't tell when the fix will come, or if it will even come. Nor do you have the option to include the fix yourself, as there is no way to patch it without the source to build from.
Isn't the iPhone security able to be easily bypassed by anyone, regardless of the phone being locked or not? Android seems to be the more secure platform for most things from what I've seen, but I'm not a security researcher, so anything is possible.

The funny thing about this...which kind of invalidates everything he says, is that Samsung is running Android. I don't think Samsung has a single phone out right now that isn't Android.
"No one wants an Android tablet" No, it's just that the iPad has a name behind it. If not for that name, it'd be one of the worst selling pads on the market.
I think when the general population talk about the IPHONE they don't think of iOS but the Form factor of the phone. I also think that the general non techie population doesn't really know what Android REALLY is. This why every phone that's not an iPhone is considered a "Droid" to them.
Non techie people are seduced by the shiny and admittingly good design of the iPhone and as long as Facebook and Instagram works on it they are happy and they "love their iphone".

Its not that ipad has a name for itself, its that apple had a name for itself a long time ago. When the iPod came out it was a big hit. It then evolved into the iPod touch, which was alright for a while. Then they made the iPhone. Everyone was already hooked on apples products, thus not giveing android too much of a chance. Except for those who want something different, so they went and got an android. Slowly people are going to leave the iPhone cause they are going to get bored of the same old SH*T. Basicly the iPod is apples reputation. The ios is boring and kinda plain.
Who cares about what sells better? How about what performs better? And I know I would much rather be able to do whatever the hell I want with the phone like customizing, and tweaking the phone to run faster, and not having to pay for everything. And you can't even do anything on the computer without a jailbreak or being annoyingly restricted to iTunes!

This is quite simple to respond to. IPhone is for mainstream users, every friend of mine says iPhone is the best phone until I show them some android devices. We live in a world where all the crap which has an apple on the back is better by the eyes of people that don't even know what the market has to offer.
Another thing is, android is still growing, and iOS has much has it keep evolving, I believe it's pretty much that: a phone with the homescreen full of icons and with no customizing whatsoever; a phone that in my opinion gives a terrible user experience.
I'm no fan of Samsung devices but it's true they're doing a great job on expanding android.

If this ever happens i would rather go back to a flip phone or have none at all. I would never give apple any of my money.
I refuse to get an Apple device, but this won't effect available devices in stock or on eBay, so good Android devices will be very rare if this goes the way Apple wants... I'll tell you one thing, eBay prices for Android Devices will go sky high.... (used or not...)
Edit: I miss flip phones anyways, so I'll go old school if I have to...
i have an ipad, and this makes me want to smash it. Apple, you do not own the world, you were not the first to create a "list" on an electronic device. If your so afraid of Samsung, then just build a darn phone with a bigger screen, i wont buy it, but tons of other people would. Fair competition is good for business, it keeps ingenuity alive and keeps engineers pushing the limits of what can be done. Competition is THE ONLY REASON we have the superphones we have now. If apple owns all the rights to make anything that even resembles a smartphone, we will have the iphone 4s renamed and sold as a new product for the next decade.

Well some of what this says they currently have rights to like list view is bs because before the first iPhone was released I was able to use list view on Windows mobile for years. So unless I've miss read, something isn't right or maybe my aging memory is wrong.

Do a factory reset, sell it, buy a Galaxy Tab, then shove it in your Apple Store representatives face showing features that the iPad doesn't have... No reason to smash something worth hundreds, (although the company who makes it is pure evil...) But I agree with what you were saying completely...

I have the HTC EVO View, while I am not a fan of HTC, nor the EVO Series, I don't regret the purchase... Now there is wayyy more support for tablets and specialized tablet UIs.... Now just make sure you get a high end one that will be upgraded to Jelly Bean... (It's not worth getting one on a data contract, as you can tether from your phone to your tablet...)
Note: The EVO View nor HTC Flyer will NOT Get ICS nor JB so don't even bother...

Android is here to stay. Google and samsung have some pretty good lawyers too. It's total BS that this kinda stuff even goes on. The only people getting rich on this are the lawyers. If they were smart, they'd sit across from each other at a conference table and make a truce and move on.
Now that Jobs is dead, it's just a matter of time before Apple slips into irrelevance. Nobody there has the passion he had about his company, and nobody is gonna defend it like he did.
That 40 billion they have will be squandered away on bogus patent law suits. Money that could have been spent on more cutting edge development. Everybody knows that patents are crap. Your better off not even applying for a patent and get the thing to market first. By the time they figure out what you did, you come up with something new. A patent application is an invitation and a headstart for everybody else to steal your idea. The company thats ahead of the development curve, and gets it to market fast and furious, makes the money.

I will give it to Apple the iPhone was a brake through, but since then Android came out and is user friendly with developers willing to make the devices better and faster more customizable. The court should get sued for taking away our right to choose what we want to purchase. I will rather NOT have a phone or an old crappy phone than own a crapple device. I will order my phones through China or Japanese manufactures. but owning a crappy device I will not!

First off, I searched the forums to see if anybody has really discussed what seems to be a one-sided trial and I haven't really found anything. So I ask this question because I am a little confused on the matter...
If you have been following the news lately, you would see that the samsung vs. apple case has begun. Barely two days into it samsung releases evidence of designs that predate the iphone which look kind of similar. Apparently this "key" evidence was rejected by Judge Koh on the basis that it is irrelevant. Now, I am no legal expert and just taking a quick glance and seeing the evidence and hearing that it was rejected by the judge makes no sense right now. It angered me to think that samsung wasn't given a fair chance to provide evidence that seems clearly relevant to why this whole trial is even taking place. But I figured I should withhold judgment until I learn all the facts because like I said, I am no expert on legal matters and I know there is two sides of the story.
My question is, is there a good reason as to why the judge threw evidence out like this? A lot of people are claiming the judge is being payed by apple but I'm not going to quickly jump to that conclusion. I am wondering if there are any fellow xda people out there that have some experience in law or know a lot about this case and can elaborate as to why this has happened. I want to know if it is unfair to jump to the assumption that apple is somehow pulling strings behind the scenes.
I'd prefer people with a decent amount of knowledge in this case speak up and not people who have read a few articles and think they know all about it.
If it's one thing I'm really starting to learn, it's that all these tech sites seem to have a bias towards them. I see some sites blatantly ignoring and even sometimes lying about android and it's features, usabillity, etc. So I'd rather get advice, experience, opinions from people who at least know what they're talking about.

I'm pretty sure that evidence was thrown out because it was entered too late by Samsung (there's a cut-off date after which no new evidence may be entered for consideration, since both parties must get some time to go over it and decide how to deal with it).
But yeah, unfortunately I think Samsung is gonna get screwed on this one. Apple seems pretty good at deceiving juries and judges (especially certain ones) into believing that they invented everything in existence. I just hope it doesn't end too badly for Samsung, as their phones are probably the biggest reason why Android has risen up as a viable competitor to iOS (and even raced right past it in market share). The smartphone world needs that competition. I shudder at the thought of a world where the only real choice is getting an iPhone.

Ahhh, I see. Well that makes sense if it there's a deadline and they didn't make it. I will say that I find it pretty strange that they didn't make the deadline with evidence that seems to be pretty damn important.
There are time limits, thought it can still be allowed if it wasn't discovered quickly enough to be submitted. Regardless, every decision made seems to point to clear bias on the point of Koh and higher judges. I've yet to see anything fair and impartial about what's been going on with any of this from the beginning.

Worst case scenario... Apple wins. And also gets to enforce the recent touchscreen patents they were awarded. What does this mean for android? That's what I'm wondering. Although, I really hope this doesn't happen.

Yeah, if they actually manage to ruin Android (I don't believe they will), I'll go for a Windows Phone a million times before I even look at an iPhone. I never used to actively dislike Apple, I just wasn't very interested in their products, but recently they've really made me think they're a ****ty anti-competitive company that doesn't deserve a cent of my money. I truly hate what they're trying to do to the smartphone market.

I've kind of feel the same. I never really liked apple, although I know they make good products. After lots of research and hands on experience, I've realized iOS sucks compared to android. All it has is smoothness. Android has far more features and is simpler to use in my opinion. What apple really is good at is hype. After all these lawsuits with them suing everybody for what seems like ridiculous things, it's making me really hate the company now.

I should point out, in the interests of fairness, that despite many of our suspicions regarding bribery or illicit deals there has never been the slightest evidence apple have bought legal rulings by anything other than legitimate and transparent means.

However I don't think any of this is as simple as "Apple is American" or "bribery".
It's a broken patent system that Apple is using to try and prolong the inevitable - which is Android taking over the majority of the market for what could be decades. Apple is within their rights to attempt to use their patent portfolio to slow down the competition. This is not debatable. They are using legal means and the current system to attempt to enforce their dominance since they can no longer maintain it with product alone.
Although I am a Samsung fan and a huge supporter of Linux, Android, Google, etc. I cannot get past the picture of the Galaxy SII next to the iPhone. Side by side, it does look like they ripped them off. That is where I believe Samsung screwed up. It's not the functionality/UI patents that are troubling to me, it's the fact they made it look like the iPhone. It's almost undeniable. They encroached on brand recognition, to the point that you can't deny they look very similar. Too similar.
In my opinion, that will be the cause of Samsung's defeat. Everyone says "you can't patent rectangles or the color spectrum". But you can't rip off someone's design either. And they did, pretty plainly IMO. Why do you think there are no Black GSIII's? Samsung knows what they did, and they didn't want to risk it with their new flagship.
As far as software patents, Apply can kiss my ass. But they have the right for their product to look unique. No matter who designed something similar back in the day. No one sees a black, rectangular phone with a huge slab of glass and says "hey, that's that Sony phone prototype!". But any average person, even an elderly person who doesn't much follow tech, definitely recognize an iPhone. Unless of course, it's next to a black Galaxy SII.

Samsung didn't copy the iphone though, they actually had iphone like designs the year before iphone was made public.
Are you saying that because apple used that design in public first, even though samsung had a very similar one earlier, that apple should be only one able to have anything similar "no matter who designed something similar back in the day"?

It's the phone itself in combination with the dock, square icons, general "appearance" I'm taking about. I'm sorry but it's really not debatable. It looks like a foreign clone of an iPhone.

If worse comes to worst you know we'll just all switch to buying Chinese android devices. The Chinese system not only ignores Apple's chicanery, but has ruled in favor of several plaintiffs against Apple and allows the phones that truly are copies to be sold freely. I don't in any way foresee it coming to that but it will be a long, long time before Apple ever sees dollar one of my money and I will do whatever I can to keep an Android device in my hands.

You're not getting this. Samsung has shown (to the best of my knowledge the evidence that was tossed by Judge Koh, was legit from Samsung), that they had prior art to this style of design, the apps, the home button, the rounded corners, well before Apple ever went public with the iPhone.
Apple sued Sammy: Then G-Nex was banned(later appealed). Then another sue to potentially kill android.
But Apple's A5X processor is made by Samsung.
So Apple should be careful otherwise Sammy could kill all i devices.

Samsung will destroy apple, lawsuits or not. Open sources/ freedom always comes out on top. Its this difference that leaves the first generation iPhones still running iOS 3 and the original galaxy s with the latest os jelly bean.

it's a little more complicated than that. while sammy makes the chips in the current crop of iDevices, They would really not like to lose all that apple business (think of all the millions of samsung parts sold to apple. samsung makes a LOT of money from apple products, and it would be a huge hit to their business if that stopped.
I think apple may be moving away from samsung for the next gen devices anyway, so it may not even matter.
Actually iPad is a5x, made by Sammy, and next iPhone 5 will most likely have the same processor.

Sorry airfluip but there's no way that happens. Sammy makes money off of those chips they sell to Apple. If Sammy decides not to give Apple the chips they would be in breach of contract. Lots of money lost either way. Let's say that Sammy decides not to renew the contract. Well you can bet there are plenty of other chip manufacturers out there who would love the cash from that contract. Did I mention money? It's the bottom line when concerning business. Consumers may have brand loyalty but companies do not.

You're also not accurate.
Regarding the Retina screen that Sammy manufactures for the idevices, Sammy's the only one in the world that was up for the specifications Apple required, so if Sammy does decide to swallow this pill, Apple really is FCKed. However, it won't happen - the money is too good to let go, Apple pays good money.

I didn't realize Sammi was also making the display. I was talking about the chipsets. If Apple was really worried about it they would of started to produce their own by now. And they just won there lawsuit against Sammi:

I heard Apple won the suit.
A simple fact is that only in the US did Apple win that, which raises the possibility that pure patriotism got into considerations. But Sammy is a monster company and Google's Motorola has some real strong suits against Apple including Apple's star - Siri, which was copied from Moto. On the long run, Google's way will win.
And by the way, Apple doesn't have the tools to even get started on making displays. They are completely dependent on Sammy with current specification.

I'd say 10 billion is cash reserves is all the "tools" that they would need. That's just there liquid cash pile. No company in the world even comes close.

... I would sooner go back to a motorolla RAZR V3 before buying/accepting an iPhone, so they can pull a few hundred off of their "damages" from me.
I heard/read apple is looking at different manufacturers to make their A6 chip for their future phones. So them suing Sammy might be because they are looking to cut all ties and out source elsewhere.
Either way, Android is here to stay.

No not necessarily. Appeals will be filed extensions will be filed to allow them to use the current designs. I have a feeling the next lineup of nexus phones will be from sony, lg, motorola and samsung. However you will not see a Gnex from Motorola the Galaxy line is licensed by Samsung.

But are they still custom flashable?
Because it'll be AOSP not Motoblur.
But then again G-Nex does have download mode.
Motorola up until recently with the Photon Q has locked the boot loaders.
A Nexus flagship phone has to be unlocked so if Moto wants to be part of the group they need to be prepared to unlock the bootloader out of the gate.
They only won in the US. Samsung is Far too diverse of a company...the apple $ is super nice don't get me wrong but they were a giant before apple and will be more so after. Besides Motorola/Google are reported to be going after apple for knowingly using Moto's wireless connectivity technology(or something like that)without permission or paying royalties and apple refuses to negotiate.... if I understand it correctly All apple devices with wireless connectivity fall under 6 or 7 patent violations...1billion is chump change compared to them apples.
