I had a very grim realization today about the true meaning of the Apple vs. Samsung trial. Apple is suing Samsung because Apple believes that Samsung has copied its iPhone. Apple claims that customers confuse Samsung products with Apple products. However, the case is not just between Samsung and Apple. It is between the Apple corporation and the Android ecosystem.
If Samsung loses the case then it will be forced to pay billions of dollars to Apple in damage costs. However, the case will not end there. What is to stop Apple from suing the rest of the Android makers (HTC, Motorola and others) ?…Nothing.

Think this is an exaggeration. There are many other things to consider. This trial is only for US devices, is probably most damaging against touchwiz, and apple is already litigating against the other manufacturers anyway. Googorola may be enacting a plan right now to force a patent pool/cross licensing deal. Even if Samsung were to get hit, it was already starting to dangerously monopolize android; a marginalization would give the other OEMs a (small) chance to pick up the slack. The greatest danger is that Samsung, by failing to invalidate the patents, strengthens them.
In the worst case scenario, Android dies within a few years, but even here the prognosis is not so terrible. It would pave the way for the next big thing (hopefully either open-standards OS's like Firefox or finally a desktop-class OS as smartphones become more powerful).
It seems every aspect of our daily lives has doom sayers now. Its the end of the world, its the end of consol gaming, its the end of Androids, etc, how many times did some one say linus our windows or Mac were about to die out

No way. At worst, Samsung would have to pay a licensing fee to Apple for every version released. Being that Android is open source software based upon Linux, it would continue onward.

That implies that if Samsung lose they will go out of business or stop using the Android operating system on their smartphones and the same will happen with every other smartphone manufacturer, which you can't say. Whilst not impossible is extremely improbable.
Looking at pictures of Samsung's products evolving after Apple released a product it does look like they copied their design and my personal opinion is that they have a case against Samsung and I would not be surprised to see Samsung lose. I'm sure Samsung have a contingency plan in place in case they lose and anyway the trial only affects their presence in the US. The outcome in another country could very well be different to the outcome in the US.
Apple have already sued or taken some form of legal action against quite a lot of Android smartphone manufacturers so the outcome of this case will not change Apple's stance in taking legal action against its competitors.
There has been a lot lately about the death of Android being near and big bad Apple going to be the downfall of it but people seem to forget Android is an open source operating system and has several manufacturers who install Android on their phone whilst Apple is only 1 single manufacturer. Android will live on (at least for a few more years) because its open source, look at Linux its still around even though Microsoft have tried so hard to get rid of it. The beauty about Open source software is that if their is a strong community behind it like Android has here in xda-developers ( 4.5million members and always around 40,000 online (whenever I am at least)) and the many other Android forums and blogs around and the 1million (if I remember correctly) people who watched Google I/O it will continue to live on.
Maybe Samsung losing is a good thing for Android, maybe it will lead to increased sales for some of the other Android manufacturers which means they can invest more into R&D and possibly make better smartphones or strides than Samsung can.
Who knows what will happen? Lets just wait and see what happens and enjoy the show while we can.

According to latest survey by comScore the digital measurement provider Google's Android and Blackberry RIM have beaten up Apple in the wild race for best mobile Operating system,OS.
The from comScores "Mobilens Serivice" tells that the study of 30,000 mobile users; 30.4% were Android based as the leader followed by RIM ( Blackberry) and then Apple with a constant 25% share of the Market.
With Regard to this Race for Mobile OS Supremacy, all have there advantages, but on the other hand this proves that today a major Population uses smart phones. (65.8 million in US only) .

Nope, i feel the same too, the new Bold makes me horny.
Anyway, these numbers mean almost nothing: Apple sells only ONE phone, which costs about 800$, while there's a bunch of crappy low end android phones out there, so go figure.
This said, we're users, not shareholders, should we really care about marketing? I guess not, it's none of our business. What we should care about is software/hardware quality...on that note: there are many androids with awesome hardware, but does the software really keep up with that? Look at a super cheap lg optimus 7 (desire cpu+gpu package), it's smoother than a SGS II and costs about three times less. Even RIM has hardware acceleration now, BB OS 7 will be way faster than current android os when it will come out in a few months, and i won't mind picking up one if ICS won't be a MAJOR update. After a year spent on this OS i can say that it's not perfect, and i'm even kind of tired of playing the nerd part ironing out the bugs and glitches that google dev team is unable to handle.
You might say i'm a fool, and argue that RIM sucks and is about to die, but believe me, if android doesn't come to a new deal i can't actually tell who's gonna die first (at least in the highish end devices marketplace)

I agree.
When I get my Android smartphone, it will be because of its low cost, first and foremost. I also appreciate the OS's flexibility. But I'm hardly "loyal" to the operating system, since it seems that its primary attraction is what it doesn't do, that is lock down the system from its users, than anything it does do.
When there is an OS that lets me use my smartphone computer like an actual computer but has full developer support, I'm jumping ship. (The most likely candidate will be Windows 8.)

note: I am using an Android (Desire) and am very satisfied about it but I am more than willing to get something else, if it is better.

In my opinion, Apple is still the best. If you don't like it's premium price tags, Android has some good alternatives.

I'm waiting to see more details about what information they are supposed to give up, I don't think it's anything from the development of present or future Android code or anything like that, it just doesn't make sense...

Then act like it was their idea and call it iOS 6, with 200 new features that make no sense and no one will ever use, then charge an outrageous amount of money for it. As far as I am concerned, Their iOS is just old junk mac operating systems refined for a phone. There aren't making anything better, they just keep reworking old code with **** taken from cydia and other outside developers, then change the name of it, then sue the person who actually created it for copyright infringement. But hey, people are dumb enough to keep shelling out 300 to 400 dollars for the exact same os with some new tweaks, oh and a new beveled edge. Nice lol.

However, they will still sell a gazillion iPhones and iPads. I personally don't like either (and pretty much hate them) however, they're obviously not bad, I just don't like the way Apple does things and Android feels much much better, from Google's side and specially from the community's side, it's just amazing what people (devs) can do with a few lines of code, I'm currently running ICS on my Motorola Defy, and it works a million times better than the stock Froyo!
I think than in a not too distant future, Apple will make some sort of change getting closer to the way Android does things, not only copying things like the notification bar, but with the release cycle for updates, and maybe even licensing the OS, obviously not now, but in a few years, I think it's a possibility if Android keeps gaining market share
I totally agree on the end product being great hardware, just the way they conduct business.

Don't count on U.S. judges to rule in favor of private property rights. They're kinda trending away from that. I just hope legislators don't make it a law that everyone must purchase iPhones. The federal government mandating citizens to purchase a product would be wrong, imo.

Why not? This isn't even part of the the normal copying of features (which I would question actually calling theft): apple is trying to force google to hand over their future plans. This is more or less the equivalent of corporate espionage.
Still ironic, given the fact that most of Google's revenue is generated by 'obtaining' people's information and hiding things in the fine print. Then, there's the CIQ fiasco of late and the fact that the UI as a whole was heavily inspired by iOS. I mean yeah, they took your notification bar but had it not been for iOS android would closely resemble blackberry, the previous OS they were stealing their ideas from. I'm just tired of seeing google treated like white knights when they are just as bad as any other company.

In yet another Apple lawsuit in the US, and yes it's against Samsung, Apple have listed several of their patents and what they want in compensation.
Aside from $2.25 billion for lost profits they say Samsung caused by misleading people with their copied look they also list the royalties they are demanding for use of their patents. Thought it might be interesting to see just how much (financially) a successful result for Apple will cost the end user.
Bear in mind that to use Samsungs patents Apple have offered just half a cent per unit even though Samsung own a number of standard essential patents. Apple want the following per unit from Samsung for each device sold....
$2.02 for allowing Samsung to use "overbounce" patent (the bit where your phone pings back when reaching the end of a gallery for example)
$3.10 for the scrolling api patent
$2.02 for allowing Samsung users to tap their screen in order to zoom in or out, or navigate
$24 for allowing Samsung to have devices that look similar
That's over thirty dollars per device. If they win (and as it is Judge Koh presiding it's very likely they will) then the end price of Samsungs android products will have to go up to incorporate this and it means that end users will end up paying more and getting hit in the pocket for what are surely implausibly high royalties.
How can Apple pay just half of one cent yet expect over thirty dollars in return?
Apple ceo Tim Cook said "we just want other people to invent their own stuff" recently but it looks like what they actually want is to make up their less than expected profit shortfall by picking on their best selling rivals until they can bring out the all singing all dancing iphone 5, at which point presumably they will then also sue Samsung for having a large screen phone

The problem is that it would also impact all non american users to as it is a per unit cost applied to all units not (I think) just ones sold in america.
Not seen your thread, but as am not american can't sign american petitions although I would have thought you would have to petition your congressmen, or is that who you mean? I was assuming you meant petition apple.

What is wrong the patent system? How can someone get a patent to ELECTRONIC LISTS?! Makes no sense at all what is going on with these patents. "songs in music libraries"? Where ELSE would you have songs, in electronic lists? Which is again patented. Someone has to be getting paid on the inside, right?
The real cost to users is probably incalculable; increasing uncertainty causes less incentives for R&D, funds for which are diverted to dealing with the lawsuits in the first place.
In the long-term, this is a good thing: the more obvious the bull**** and harm to consumers, the more likely some drastic change would occur. Knowing humans, however, it could take several decades.

Plus, because the apple patents they now have are vital to any mobile os (displaying documents on screen, using icons and widgets, touching a screen to input data, etcetera) but not under frand terms apple can refuse to allow their use and force phones using these features off the market.
And we're talking about a company who sued a grocer for having an apple as part of their logo so don't think that apple won't sue android out of existence if they can. They will.

since I'm still rather new on the forums, I would like to know what the people here think of Apple and their devices, and of course, why. I think I already understand people aren't positive, which I'm either. Speak your mind!
My view? Well, I of course prefer Android. The freedom of flashing Roms is great, Android simply is much more open. I also see many Apple products with broken screens, and I nearly never spot a Droid with one. Apple products are overpriced in my opinion, too. And as last, patents, enough said.
I have to admit that I maybe am a little too subjective. I think that the overall hardware quite good, apart form the screens, and its interface feel rather good.
Oh, right, I forgot to mention innovation, which Apple lacks

I won't buy their products. I like the open source android and having ultimate control of my device. Now after this lawsuit against Samsung, I definitely won't buy any crapple products.

Well, I would have to say that albeit the devices have a premium feel [with the two latest iterations], the Apple ecosystem is generally a money trap.
I'd rather have a Blackberry over an Apple device. At least I wouldn't have to be afraid of breaking it with a 2 foot drop.
They don't get nearly the credit they deserve. Particularly around here.
Innovation stiflers.
As for their products, they're okay, if overpriced and hard to unbundle. With Apple, we pretty much get accept-everything-or-leave-it devices, and I don't really like their design aesthetic - even Metro is preferable to me.
Nothing really special. Easy to use but they're not my type. Overpriced and very limited.
They make quality hardware but lackluster software, to closed/limited for the price you're paying. They also have those overtly absurd patents that endanger the mobile ecosystem as a whole.
I like the design, it looks professional and iconic. Other than that, nothing.

They're a good company, superior marketing, but shameless and greedy.
The hardware on them is just wonderful (minus the processor, but I suppose it doesn't need it with their OS). If on Android, every OEM could team up to make an ultra phone (i.e. Sony Camera, Tegra graphics, Exynos Processor, Motorola durability/signal strength etc.) like Apple did with everyone else's parts... well I might not be saying the same thing.
Apple is sort of like the Firing Squad, and each of the Android Manufacturers are like the Lineup. Apple takes each of the best parts from each OEM and kills them off. For example (most recently) Samsung chips, but sues them. It's a great strategy. But also a pretty a-hole move.
In conclusion, GREAT HARDWARE, SMOOTH OS, BUT CLOSED SOURCED JERKS. That's just me.
I think they make a decent product that appeals to those who want something simple to use. If the company wasn't the biggest patent troll around, I wouldn't mind recommending their products to people. They only sell one phone and I think there are different wants from consumers. Some like a larger screen, some like smaller screens, some like QWERTY keyboards, some would rather have a thinner phone with only a software keyboard. They had a pretty nice looking OS in 2007, it looks outdated nowadays. Its also a very limited OS with minimal customization allowed.
I see apple as a onetime great company that allowed the untech savy people to fianlly have the ability to use the latest tech, then they gained such a cult following they realized they could be a little greedy, when that worked so well they set there sights higher until they became a very greedy company whos inovation spirit was lost and forgotton.
Then they decided they want everyone tobe an isheep and make it so if you don't choose them you cannot choose anyone.

The iPhone has always had the best build quality. The iPhone always felt really good in the hand. You really feel like your possessing something made for the gods. The only thing about the built quality that I don't like is the glass screen, it breaks so easily.
The iPhone has the most apps, iTunes, and no risk of viruses so your always secrure. The battery life will almost always get you through at least a day. The picture quality is remarkable, and the camera is easy to use. When there's an update (if your device is going to get it) you recive it almost immediately. The ios interface is simple, beautiful, and fun to use.
Apple is never influenced by other companies. They never put technology in there phones thats not practical (HTC releasing the Tbolt that only lasted 4 hours) (4LTE drains battery's way to fast to be put in a phone).
Having that said, I refuse to buy an iPhone until it supports a 4 inch (or bigger) screen that's 720p. And atleast 1.2 gzh dual core A5 CPU.

The only thing I like from Apple, having used the Iphone 4, is the app store.
I don't care how many apps there are for each platform, but in the iphone, hundreds of apps are very polished and made almost perfectly. This includes games. I'm not even going to mention games and apps on the ipad; when they're optimized correctly, they're beautiful. (see: snapseed, alienblue, etc) You just enjoy using those apps. Many apps and games on Android are just iphone ports, and due to fragmentation, you don't get 100% perfect games like the developer intended.
Other than that, I don't care about apple or their products.

Yes I think Apple will be the one of the two with more on the line. As for security concerns on this subject Apple already has enough issues currently and would much like to keep it as minimal as possible? Both companies are in compromising positions in this field as it is.
I'm all for this as most of us are. It is one step forward to a completely Lock Free phone Computing environment. It is right XDA and other communities alley. Developers will love this of course. It will put a lot of money in people's pockets where it needs to be.
Additionally the world of Android customization, custom phones, and all things totally cool for the little green guy my all come true for us someday.
One small step for this win? One huge leap for the little green fellas kind...

Agreed, if it gets passed, it would start to open the Apple OS more for customization.
In case most did not already know In the old days Apple was more of a user base of older people. Primarily older adults. There was not a lot of sales nor young people that were using the devices in the way that they are today. Fast forward in time technology has improved Apple has put out good PR when the iPhone released.. really a little bit before however this spiked a rise in their user base and this time one that

Apple firing back with iCloud the Superior device protection which launched an even greater amount of device sales for Apple with so many devices lost stolen Etc due to not being able to recover from iCloud lock. I don't know if the latter was very significant but in my mind it is and still is to this day until they fix it. I don't believe iCloud is bad. I would love for Google to implement their new surprise factory reset protection they have been talking about for a little while now that is not really in the media yet. Then Google will be up there with apple when it comes to device security on Lost stolen devices when this happens.
This is just a start of a whole new era of freedom for cellular devices. Up to 2015 we fought for unlocking rights and then we got them. Companies such as Motorola and HTC becoming developer-friendly in allowing bootloader unlocking . Other things. Now we have this. The day of Androids right now and Apple iPhones and I devices are likely days of moonshine running but only take that a step further the days of building custom cars right before NASCAR when everything had to be strictly from scratch. No million-dollar companies helping just strictly small mom-and-pop and backyard mechanics. I'm not trying to say phones are becoming hot rod that will eventually start racing each other lol by no means. But I think you get the gist of what I'm saying. Absolute freedom to do whatever with our devices.

Agreed, Motorola thankfully has an easy way to unlock bootloader, it at least gives you an option to flash a different current os compared to their os which updates maybe every so many months if you are lucky.
Oneplus I believe also has bootloader unlock available as well.
