Well I thru htc an email about source code. Granted its probably just a cookie cutter reply but here's what they wrote to me in reply to my email :
Dear Blair Ginley,
We appreciate your interest in development options for the HTC One S and can provide some information to answer your concerns.
HTC will typically publish http://www.htcdev.com the Kernel open source code for recently released devices as soon as possible. HTC will normally publish this within 90 to 120 days. This time frame is within the requirements of the open source community.
Feel free to reply should you have any further questions. If you feel more comfortable discussing issues by phone, you can contact Technical Support at 1-866-449-8358, 6 am to 1 am EST, 7 days a week.

So, we will finally get true CM9 and co (AOKP, MIUI, etc)!
It's weird that T-MoUS is MIA, but it's the only black sheep (different model) in the One S pack.

You'll get the same canned response about 90-120 days. Remember US Tmo version was released a little bit after the others.

yes unlock bootloader... but this will not help... what will really make htc unlock their bootloader is if we boycott them and say we will not buy the sensation at all if its locked and convince others not to buy it... but its a longshot so i vote yes

I doubt this is the best way to make a petition. Can't we make a petition on Petitiononline.com or something? We would reach a wider audience and get more signatures. We could send it to Android and tech related websites for people to sign. So we can make a more powerful statement to HTC and maybe also Motorola that the public wants to have the choice to do whatever they want with their devices.

XDA now have 3,878,020 REGISTERED USERS and is a worldwide site, a reference point for a lot of developers and useres. This is the best way!

Agreed, but the threads in this Sensation section aren't getting many hits. I'd say ask moderators for a petition on the homepage or something that catches more eyes than here.
But great idea, I was waiting for someone to start a petition. Keep up the good work! Let's maximize the potential of this petition!
I agree that the use of a petition web site outside of XDA would be useful. Not everyone who would want to vote is a registered XDA member and I'm not the type of person to be inclined to register somewhere just to cast a vote.
Now, if you were to use something like Facebook... I'm sure you'll get more votes there. Plus, other web sites probably wouldn't have a problem linking to it from their web sites (Android Central, Phandroid, Engadget, etc.).

wont buy a locked sensation
this device sounds like the promise of the year,
but i wont think about buying it till i see the development threads filling with custom ROMs .
i love HTC hardware , but i hate the sense !!!!! and although the sense3 looks better it will still be far behind Cyanogen mods, performance wise .
and as a HERO owner ( hopping soon to be ex ) i know how HTC neglects the old devices . had 1.5, HTC promised 1.6 and then they promised 2.0, and finally when i got 2.1, everyone already had froyo. ahh
I dont want to see their stupid flipclock weather thing ever again
bottom line is:
only when HTC sensation will run CM7 ill buy it..
Why is it locked in the first place? Noobs won't know what bootloader is and so won't be messing up their phones and people like us who mod our phones know what we are doing (or at least think we do) and so won't mess up our phones anyway... Having it unlocked just saves us the time of having to hack it to unlock. Really don't see what they achieve??!?

I recently complained to htcdev about the kernel source not being released and I threatened legal action as they are in violation of GPL. Here is what they came back with:
Dear Rohan Mathur,
Thank you for contacting HTC. I will gladly assist you with your request for the kernel source code for your HTC One X.
New source codes are typically posted to the HTC developer site within 90-120 days after a new device is released or after an update is released for the phone. In most cases it will not take this long for the source code to be made available Rohan. The kernel source code for teh One X will be posted as soon as we have it ready for the developer community.
Please check back from time to time on the developer site for the One X source code. HTC does their best to make the kernel source code available as soon as possible for all HTC devotees and android enthusiasts. For more information and other developer resources, be sure to check other areas of our developer site from http://www.htcdev.com/ .
I apologize for any inconvenience this may cause Rohan, and I hope that this will not detract from your overall use and enjoyment of the One X until the kernel source code is made available. Thank you for your patience and understanding in this matter.

I'm kind of suprised that an actual human responded to me and didn't just send me the generic answer (notice the typo of "teh" instead of "the")
Anyway, this leads me to believe that it will be soon. 30 days of those 90-120 are almost done, so lets hope that it comes soon!

I don't understand why AT&T would do that. What's in it for them to make then wait? Eventually it will be released. I mean I just can't understand who the are trying to screw but not releasing it. It can't be developers because they wouldn't want to lose sales. I'm sure they don't care who buys the phone, developer or not.

We have no idea what comment it is that we should Like though...
That's like saying a doctor will only save a life if X amount of people like this photo. It's stupid - no offense. If, and I mean a big if, facebook comments were ever taken into consideration for tech feedback it would be quantity of posts about it that would be taken seriously, not one that's just liked a lot.
Is HTC in the habbit of not releasing kernel source or something? this is my first HTC phone so i wouldn't know but I'd think they are going to release it eventually. don't they really need harassing?

They typically release it within 90 to 120 days apparently.

Um, if this is an official response from HTC, they have horrible spelling, grammar and sentence formation.
It also seems highly unlikely that a paid developer spelled "kernel" wrong.

I'm still a little unaware of how developer requests work, but is it appropriate to post in the general forum about a ROM request / donation pledges for a Sense 5 port? I'm not sure if that would be popular among the HOXL community but I think it would be. That way, we can have a huge part of whats coming out with the HTC One on our devices :fingers-crossed:

I would definitely throw in a few bucks if somebody successfully ported sense 5 to the one x. So long as it was functional that is lol. Hopefully somebody can come up with something, that way it will make me feel less bad about not having the newest from HTC haha

This isn't eBay. Developers may pick up a request or not depending on what they feel like doing. If you want to start a bounty thread, go for it, but people work on this kind of stuff when they want to, not because other people ask them to.

I'm not sure if that was meant to be offensive or not. But if you check my post history I have been very supportive of all the developers here. I just know that a lot of the developers do this in their spare time and is not their primary job obviously. So I could show my support by providing a few extra dollars from my bank account. It is simply a token of my appreciation. But thank you for the clarification

Bounty is a good idea i think, the port its not that easy and the dev can receive a good incentive for that, not a pay, is a grand "thanks".
