Umm, not really. The purchase has not been approved yet (although it is expected to be). So Google actually has no say in the actions of Motorola at this point in time.

Yes they do. As part of the in process acquisition by google motorola signed an agreement not to commit to any legal action without googles say so. It's been quoted from on xda and can be found online. I think it was on the patents blog by florrian mueller that I first read it though.

Google and it's partners have only filed retaliatory suits against Apple.
Apple is simply getting exactly what it deserves. If they behaved themselves in the first place this would not have happened

Anyway,good one,finally.No,Google is no company of saints and non-sinners,but compared to Apple,all others are angels at worst.Yeah,healthy competition is one thing.Patenting something that DOES belong to you is ok too.But patenting the whole ****ing planet because it actually looks like a fruit in shape is outrageous.

that's indeed exactly what it looks like currently with this flawed patent system

The system is capable. It's the legal teams that are at fault.
Apple is so anti-competitive, it's great to see them get a little payback.

At least motorola is willing to license it's patents. Apple just bans infringing products.

It's not uncommon for Apple to target Samsung, Motorola...or Android for that matter. Whether or not Apple actually has a case is above me, but it's apparent both of these OS use or "borrow" features from the other...a self-made "improved" version of the former.

how so? iOS still accounts for a signifigant (even if it isn't majority) & of smartphones. Apple owns that entire portion of the pie where as the android portion is shared by a handful of companies. Plus they got a name. As long as they put out a half decent product, it will sell.
can't these guys just drop all the lawsuits and actually improve their os/ui? seriously.. most of the time they just sue each other instead of improving things -.-

Your logic is flawed. He didn't say that they were doing poorly, he simply said they are going for anything and everything they can. Maybe they want to own more of the market, maybe they are afraid of android getting ahead... Just because iOS is doing well doesn't mean they aren't getting defensive lately.
Another one of the many reasons why I refuse to buy any apple products.

the OG iPhone spawned a growth spurt in transforming PDAs to our modern smartphone. We are currently in a spot where noone is doing anything innovative so I guess this is their way of passing time

German courts have made a ruling that means if Motorola tries to use its most important patents against Apple in a court case the company will be in violation of European Anti trust law.
As the article says:
"Apple scored a breakthrough court victory today against Motorola. Its important can hardly be overstated. This is so huge that it even begs the question of whether Google's strategy for its $12.5 billion purchase of Motorola Mobility has failed before the deal is even formally closed (they're still waiting for some regulatory approvals)."
It would be nice to see Apple bought down a peg or two but the way things are going its likely to be Google-Motorola (and therefore also Android) that is on the losing side.
After all Motorola cannot use its genuinely essential patents in court now and yet Apple can still use dumb ones like voice search, touch screen, text completion etcetera that although every decent phone nowadays has these features Apple own the patents to and have been able to use in court cases so it seems Apple now have the upper hand.

They can't develop new devices without violating apples patents anymore. When the new phones with android get released after mwc you'll see more lawsuits against those models too.
Apple will win because they have patents that are not subject to frand so don't have to let people use them.
Odd thing is that apples licence offer to motorola, which stopped the injunction on iphones in Germany, is still less than motorola asked for yet judges order them to not sue apple as a result.

First of all you have to consider the source of this information to be able to evaluate the spin on this. Florian Mueller is a anti Google/Android pro MS mouthpiece who tends to be clueless.
This is a lifting of the preliminary injunction. The case itself is still pending, but It'll likely to take quite a while to finish up. Granted this isn't good news for Motorola, but it's NOT the end of the road.
Check out Groklaw for a different slant on this and other issues (eg Oracle/Google)

Actually he uses android devices as he has a Samsung that was affected by the german court case against them last year and he is actually very knowledgeable.
I follow his work and have not noticed any pro apple bias but the things he states are facts, motorolas cannot sue apple using their patents for the duration of the appeal which is between one to two years so how would any bias change the facts?

Motorola sued after apple didn't pay licencing fees in 2010, something apple still won't pay. Bit different to apple suing because phones can auto complete text for example.
Motorola sued for a good reason but apple do so to stifle competition.

saw this and i thought i would say that apple originally started all of this by suing google and HTC first
they r trying to hold back developemnet becuz thats all apple has done is steal and try and stop competition
in the long run apple will fall
and ppl only buy apple products cuz they br pretty i buy google products for quality and interfacing

That's probably due to the high profile court cases this week where some androids were banned for violating patents such as being able to act on a phone number you've been sent in a message (data tapping) and having a unified search feature (siri patent).
People rightly get annoyed when a big company patents things that were in use before the patent and then uses them to stifle the competition.

Pretty sure apple patenting anothers ideas then suing over people using them is just a little worse, and does more to hold tech back, than motorola who are owned by google allegedly charging a high price for patent rights.
One copies existing ideas and then stops rivals using them while not allowing them to licence the rights, the other own patents vital to tech products and lets anyone use them but possibly overcharges.
Pretty big difference between them.

The thing about Apple getting in hot water over frand is that they didn't pay the frand rate at all.
Motorola objected as it should be paid.
Now Apple have entered into a frand agreement, however they want to have their cake and eat it by not paying for the time they were illegally using the patents.
As they hadn't entered into a frand agreement with Motorola back then, Motorola is not obliged to charge a frand rate and so want to charge a compensatory rate that punishes Apple for breaking the ethics of frand. This upsets Apple and the protectionist US authorities.
Had Apple played by the rules in the first place they'd not be in this mess but they wanted to rip off Motorola so must pay the price.
This is xda not androidCentral or imore. Keep the fan crap out!

I was an avid Apple user, switched to Android, and staying that way. I believe that Apple is upset that they can come up with an idea at the same time Android developers do, but android does it faster and better every time. When apple announced Siri, before it was even out; Android users had similar programs already such as Iris(Iris being created after of course).
We had Google Voice Search since uhh... the G1. September of 2008.

The four patents at stake were:
1. Unlocking a device by performing a gesture on an image.
2. The use of a multilingual keyboard offering different alphabets on portable devices, including mobile phones.
3. A system to determine which elements of a screen were activated by single-finger touches; which were activated multi-finger touches and which ignored touches altogether.
4. Letting a user drag an image beyond its limits and then showing it bounce back into place to illustrate that they had reached its furthest edge.
The judge ruled that the first three patents were invalid in this case, while the fourth did not apply to HTC's devices.
Lawyers fighting other lawsuits against Apple are likely to pay close attention to the decision regarding its slide-to-unlock patent.
The judge said that HTC's "arc unlock" feature - which also involves a predefined gesture along a path shown on-screen - would have infringed Apple's technology had it not been for a device released in 2004.
The Neonode N1 showed a padlock on its screen with the words "right sweep to unlock" when it was in its protected mode. A later version replaced the text with an arrow.
The judge said it would have been an "obvious" improvement for the developers to have offered users visual feedback in the form of a "slider" in the way that Apple later used.
He added that the concept of a "slider" was not new since it had already appeared in Microsoft's CE system.
As a result Apple's claim to the innovation was rejected.

I know there's at least one intelligent judge in California and one in D.C., but it seems like the rest are all in other countries. I know there's at least one intelligent judge in California and one in D.C., but it seems like the rest are all in other countries. Sad that American judges are so clearly biased by the corporate atmosphere of this country. Sadder still that I'm having to talk about all this nonsense on the 4th of July.

I wouldn't call it icrap. They are pretty good phones really. Just the company behind them has become "evil".

Couldn't agree more with the majority of the comments. It seems Apple really are getting too big for their boots, and trying to throw their substantial weight around. Pleased to see someone stand up to them and put them in their place, for once.

i think something wroing is going with apple , they are almost against all phones... and i just hate it .
Apples iPhone craze is just a phase. It'll soon be in the closet with our pet rocks and the members only jacket, and the furby( not nearly enough of this met the end to a gun.. who would make such an annoying toy)
