how so? iOS still accounts for a signifigant (even if it isn't majority) & of smartphones. Apple owns that entire portion of the pie where as the android portion is shared by a handful of companies. Plus they got a name. As long as they put out a half decent product, it will sell.

Your logic is flawed. He didn't say that they were doing poorly, he simply said they are going for anything and everything they can. Maybe they want to own more of the market, maybe they are afraid of android getting ahead... Just because iOS is doing well doesn't mean they aren't getting defensive lately.

the OG iPhone spawned a growth spurt in transforming PDAs to our modern smartphone. We are currently in a spot where noone is doing anything innovative so I guess this is their way of passing time

I agree, Apple certainly, with their wealth, should afford to lose those amounts, however it's still a lot of money nonetheless.
Then I don't hate Apple, they have rather decent products, however I strongly dislike their ways of marketing and the way they abuse their (imho) way to big list of parents to bully other companies.
That said, if this is true, I suppose I'm happy it didn't go through since, from my understanding, $100 mil in legal disputes could have caused HTC quite some problems.

I wonder why Apple seems to win every legal dispute in Germany, but not in any other country. News says that courts in Düsseldorf and Mannheim both state, that Samsung/HTC infringes Apple's design rights, which is not patent-related. German law says, that products are not allowed to look the same. So all the judges here think that Samsung's products look the same as those from Apple.
Samsung's and HTC's "counter attack" is about patents, umts technology and such. But the German courts dismiss these technical claims. It's really weird (but nice) to hear that results of these legal disputes are the complete other way 'round in the rest of the world.

The point to me is that Apple's wasting money it could be using to develop better phones and tech with. And at the same time, it's forcing other companies to waste money, time and resources to battle it. That just holds back the industry and stifles innovation.
I used to be a big fan of Apple (not to the extent of being a fanboy) for how smooth their system was and is. But in the past 5 years, with all the DRM issues (starting with the iPod, even though I had one) and locking down their system so you feel you're borrowing your phone from them rather than buying it, and the patent trolling, I'm just getting more and more disillusioned...
*shrug* Feel free to correct me, but hasn't everything here essentially been stolen from the FLOSS community? The only thing these companies even provide anymore is package management and a GUI. For Apple this practice goes back to Darwin and for Google android. I suppose it's possible that the iPhone source is based on Unix (I can't do an audit).
I don't think android leverages much of X11 either.

Yes they do. As part of the in process acquisition by google motorola signed an agreement not to commit to any legal action without googles say so. It's been quoted from on xda and can be found online. I think it was on the patents blog by florrian mueller that I first read it though.

Apple is so anti-competitive, it's great to see them get a little payback.
At least motorola is willing to license it's patents. Apple just bans infringing products.

He added that the concept of a "slider" was not new since it had already appeared in Microsoft's CE system.

Worst case scenario is that usa would have to have a heavily neutered version of the os.
There is prior art that predates the patent application by a year so that could be useful in a court case.

Believe it or not the patent even covers widgets, if you read the whole patent it's about half way down. And it covers email, scrolling through lists, stuff people did long before apples patent.
But by specifying a multi touch portable device in their description this patent applies to literally any mobile device and if they were able to find a sympathetic judge such as Judge Koh they could cause problems for victims, I mean people stealing their ideas (oops), of their choosing.

Actually the ITC blocking the import of Android devices illegal. They technically do not have the authority to do so. Apple applies to all of these patents under FRAND. So, when they sue, they aren't giving anyone a chance to license the patent. Senators (as of last week) have decided to step in to fix the broken tech patent system, so I don't think this is the end of anything. If Google just throws in the towel and gives up, Apple will clearly have a monopoly (wp7, wp8, RIM have hardly any market share) and then they are screwed as well.

Well as far as I know, it's only the four utility patents that are in question here. I thought universal search was fixed with 4.0 though? I'm pretty sure all of those problems are fixed with 4.1.

They should be but seriously, the patents that people can have nowadays are utter ****. "We got a patent on the bounce back from a list". In a movie if someone said that, the audience would be like "Wtf..." but in real life I guess thats fine. A patent on clicking on Email and able to call? Its the most mind boggling retarded thing and of course people think its fine.

Unified search is a ridiculous one too. Basically just being able to find a search item locally as well as from the web. They've already sued to block the SGS3 with this.
Google had this feature with Google Desktop in 2004- Apple filed after it existed and got the patent for it in 2011.
This whole thing stinks so bad- basically if everyone did what Apple is doing, you can just look around at ANY good idea in any product made by anyone, do a quick sketch up of the idea and apply for a patent- even though you didn't do JACK but look around and see something someone else made and come up with your own version of it. If you're rewarded the patent, you can then sue the person who actually came up with the idea before you did and take their idea! You just have to be first to file for the patent.
This really sucks for innovation, because before, A company might come out with something like Google Desktop and release it without a thought that someone else would patent just the basic idea right out from under them and eventually take them to court and sue them based on their own innovation! But now, that's exactly the kind of crap any company is going to have to consider before it can release new ideas. And heaven forbid you're a startup without armies of patent lawyers and billions to throw around protecting yourself from patent-troll based lawsuits.

I still sctratch my head as to why Samsung still supllies parts to Apple for their iPhone. Sure it might be a different division within Samsung but it still carries the Samasung name.

I blame our judicial system more than I do apple. Look at what the other courts are doing with these lawsuits in other countries. They seem to have common sense.

Exactly! Further more why is Google even making apps for IOS? It's as obvious as a huge zit on your nose that this about android more than it is Samsung. If HTC was the leading android OEM it would be them in court instead.
What would happen to apple if Samsung and Google stopped supporting them? They're already lagging behind in innovation. The iphone 5 is going to be a joke. It's clear apple is trying to kill both of them but they are acting just like the general public. Support apple no matter what. Smh
