Apple wastes $100,000,000 against HTC - Android General

There are rumors that Apple just wasted $100 Million in legal disputes Against HTC. Apparently, Apple patents did not hold up against HTC in court. The only patent that was successful was about tiny software feature in email app used by HTC on Android Phones.

I am fairly certain Apple can afford to lose such amount. I don't think they act on impulse, they plan very very carefully and consider the risks. Plus any publicity is good publicity. Just sayin'.

I agree, Apple certainly, with their wealth, should afford to lose those amounts, however it's still a lot of money nonetheless.
Then I don't hate Apple, they have rather decent products, however I strongly dislike their ways of marketing and the way they abuse their (imho) way to big list of parents to bully other companies.
That said, if this is true, I suppose I'm happy it didn't go through since, from my understanding, $100 mil in legal disputes could have caused HTC quite some problems.

instead of suing every mobile manufacturer on the planet (HTC, Motorola, Samsung...) apple should focus on improving that horrible os they have.

Apple is not compatible to android overall IMHO and therefore has to use the money they make off the fanboys to try to attack the better companies. Let em waste their money.

I wonder why Apple seems to win every legal dispute in Germany, but not in any other country. News says that courts in Düsseldorf and Mannheim both state, that Samsung/HTC infringes Apple's design rights, which is not patent-related. German law says, that products are not allowed to look the same. So all the judges here think that Samsung's products look the same as those from Apple.
Samsung's and HTC's "counter attack" is about patents, umts technology and such. But the German courts dismiss these technical claims. It's really weird (but nice) to hear that results of these legal disputes are the complete other way 'round in the rest of the world.

The point to me is that Apple's wasting money it could be using to develop better phones and tech with. And at the same time, it's forcing other companies to waste money, time and resources to battle it. That just holds back the industry and stifles innovation.
I used to be a big fan of Apple (not to the extent of being a fanboy) for how smooth their system was and is. But in the past 5 years, with all the DRM issues (starting with the iPod, even though I had one) and locking down their system so you feel you're borrowing your phone from them rather than buying it, and the patent trolling, I'm just getting more and more disillusioned...

*shrug* Feel free to correct me, but hasn't everything here essentially been stolen from the FLOSS community? The only thing these companies even provide anymore is package management and a GUI. For Apple this practice goes back to Darwin and for Google android. I suppose it's possible that the iPhone source is based on Unix (I can't do an audit).
I don't think android leverages much of X11 either.

Nice find. The I love that article. The main reason I will never buy apple. Their products are decent, not my taste but decent. Even if they came out with a great phone I would be hard pressed to put my money on a company like this.

This is the same Apple that has initiated a patent war with its smartphone rivals. And it's the same rival that has tried to remove competing products from the market, rather than agree to negotiate a licensing fee. And it's the same company that patented multi-touch gestures 26 years after they were invented at a research university. And it's the same company that allegedly doctored evidence in European courts to support its lawsuits against Android. And yet this company claims android-based smartphone manufacturers are abusing the patent system.

First of all Google only provides the software HTC, Samsung and other companies provide the hardware. Secondly Google android looks nothing at all like iPhone ui. IPhone is plain where as Google has customization with Widgets notifications and an open source market. Google android is so good that apple decided to implement it into there phones through ios 5, so I wouldn't be talking if I were you.

I'm fully aware that googlr only provides the software, the software is what is used to steal everything. You CAN customize android to look however but by default its the same boring 4x4 slab of icons and that's how your average consumer will keep it. Android looked like blackberry OS until they saw the iPhone. Android has an open source market which has made it the 2nd biggest target for malware, it is expected that almost 1/3 of android users will encounter malware on their phone within the year. The most common varieties of this malware end up adding a hefty sum to your bill, these can be found on the "open source marketplace" that you're so proud of. As for your last statement saying apple is implementing android into iOS5 the only thing they've got that was stolen was the notifications bar. I'm no apple fan, but I feel justified in calling you an idiot.

Funny once apple sues samsung its all ok , block their sales all good , but once apple gets hit back with same meassure then everyone else is abusing pattents.
Lets face it apple wants to put a stop on so fast and developing android phones and software, all they can is try to find loopholes and sue.
We will see where apple will be in 2 yr time and where android will be.

Apple does not innovate. They steal many ideas and clump them into one nicely built product. However, most tech companies do take other's ideas and build on them. Apple, HTC, Samsung all feed off of eachother. However, it is a problem when Apple decides they can steal but no one else can, and thus this stupid patent war.

I think this is also a part of their marketing strategy. Consumer will become more curious so if they buy an apple brand maybe they will buy a samsung brand to compare by themselves whos better..As part of marketing, a profit for them both...But thats true theres a lot of choices and maybe much better than them definitely, but maybe thats why they doing an exposure to sell their products.
My 74 yo mother in law went to Big Red and asked if she should get an Android or an iPhone. they said the iPhone was less technical and she would be able to the simpler device much easier. So I guess if you are an old woman you should use the iPhone.

Since a lot of the infringments seem to be from the software side which leads to google :S seems like apple doesn't want to tie up as much cash going after google than if it went after Samsung. Since samsung is a "safe" hit seeing as how apple is one of it's biggest hardware buyers so they can't go after apple too much, if apple doesn't sell well, then samsung loses out on a buyer as well.

You couldn't make this up, Apple are suing Motorola in the US so that, if successful, Motorola can never again take them to court (ever) for the patent infringements Apple specify. Not only that but if, as is expected, Apple win then courts in other countries are expected to also come down on Apples side in their countries Motorola cases.
As the article states:
"this is a very serious issue, and it could have major impact. Beyond presenting a good chance that Motorola will in the not too distant future be effectively precluded from enforcing its baseband patents against the iPhone 4S (and Apple products to be released in the near term), this could further increase the likelihood of serious antitrust trouble for Google-MMI in Europe and, in a worst-case scenario, it could reflect very unfavorably on Google-MMI's credibility in certain important circles."
The article then explains how Motorola, and Google (yes both companies), would also be liable to pay Apple damages for breach of contract and unfair licensing issues.
Seriously, how can you sue your competition so they can't sue you? I think that's just nuts.
The patent system is so broken and just needs a major overhaul. It's so disgusting how Apple is abusing this and the legal system. And taking someone's ability to sue and defend themselves is just insane!
It really frustrates me to see Apple do this I mean come on seriously, I wouldn't be surprised if apple wins this too since they seem to win most of there legal battle some how.
I think the biggest problem is these companies know that judges have no real clue when it comes to technology and they are using it to their advantage. Truth is I don't see them winning their no sue side of it. The truth here is that Apple is scared because Google is planning to sue them with the patents Motorola has and this is just a preemptive legal strike... but I don't see it working.

how so? iOS still accounts for a signifigant (even if it isn't majority) & of smartphones. Apple owns that entire portion of the pie where as the android portion is shared by a handful of companies. Plus they got a name. As long as they put out a half decent product, it will sell.

Your logic is flawed. He didn't say that they were doing poorly, he simply said they are going for anything and everything they can. Maybe they want to own more of the market, maybe they are afraid of android getting ahead... Just because iOS is doing well doesn't mean they aren't getting defensive lately.

the OG iPhone spawned a growth spurt in transforming PDAs to our modern smartphone. We are currently in a spot where noone is doing anything innovative so I guess this is their way of passing time

German courts have made a ruling that means if Motorola tries to use its most important patents against Apple in a court case the company will be in violation of European Anti trust law.
As the article says:
"Apple scored a breakthrough court victory today against Motorola. Its important can hardly be overstated. This is so huge that it even begs the question of whether Google's strategy for its $12.5 billion purchase of Motorola Mobility has failed before the deal is even formally closed (they're still waiting for some regulatory approvals)."
It would be nice to see Apple bought down a peg or two but the way things are going its likely to be Google-Motorola (and therefore also Android) that is on the losing side.
After all Motorola cannot use its genuinely essential patents in court now and yet Apple can still use dumb ones like voice search, touch screen, text completion etcetera that although every decent phone nowadays has these features Apple own the patents to and have been able to use in court cases so it seems Apple now have the upper hand.

this is getting hilarious...they all should concentrate on developing new devices instead of sueing each other. I hate Apple for all these lawsuits...

They can't develop new devices without violating apples patents anymore. When the new phones with android get released after mwc you'll see more lawsuits against those models too.
Apple will win because they have patents that are not subject to frand so don't have to let people use them.
Odd thing is that apples licence offer to motorola, which stopped the injunction on iphones in Germany, is still less than motorola asked for yet judges order them to not sue apple as a result.

Yeo, I know it was Apple who started it all... I just feel sorry for the time wasted in court, only to slow down the other side, time and money which could be used much better.

Things got worse for motorola today as apple won court case over the android gallery and they have to change it or all their products running android get banned and recalled.

First of all you have to consider the source of this information to be able to evaluate the spin on this. Florian Mueller is a anti Google/Android pro MS mouthpiece who tends to be clueless.
This is a lifting of the preliminary injunction. The case itself is still pending, but It'll likely to take quite a while to finish up. Granted this isn't good news for Motorola, but it's NOT the end of the road.
Check out Groklaw for a different slant on this and other issues (eg Oracle/Google)

Actually he uses android devices as he has a Samsung that was affected by the german court case against them last year and he is actually very knowledgeable.
I follow his work and have not noticed any pro apple bias but the things he states are facts, motorolas cannot sue apple using their patents for the duration of the appeal which is between one to two years so how would any bias change the facts?

Motorola sued after apple didn't pay licencing fees in 2010, something apple still won't pay. Bit different to apple suing because phones can auto complete text for example.
Motorola sued for a good reason but apple do so to stifle competition.

saw this and i thought i would say that apple originally started all of this by suing google and HTC first
they r trying to hold back developemnet becuz thats all apple has done is steal and try and stop competition
in the long run apple will fall
and ppl only buy apple products cuz they br pretty i buy google products for quality and interfacing
all in all apple products r made for the stupid and wealthy while android/windows r made for ppl that want to improve thru the reason y google is open source
