Is free apps considered as commercial use? - General Questions and Answers

Hello friends,
I want to ask if free apps which are monetized by admob considered as commercial use or no ?
I mean i publish some apps on google play for free but i monetized it by admob but sometimes i need to use some icons or images from the web in these apps and i find the license of these images is (Commercial use : Not Allowed).
So can i use it as i publish these apps for free ?

If you are making money with your app in any way shape or form, it is commercial in nature and therefore infringes on those resources licenses. (Icons, images, etc.)
Doesn't matter whether or not your app is free it's still commercial because you profit from it.

Here the term "website" also applies to "app".
Its obvious: if you make money, its commercial. No ifs or buts or whats, that's it.

But seriously, profit = commercial.
Think about it, you are using someone else's work and making money with it. That's stealing. Unless the license specifically says you can, you can't use the images without making arrangements and possibly having to pay royalties.
So please, don't break the law. Well break the law if you want I don't care, but just don't steal someone else's hard work...

Oh no, the legalese... Yes, it depends on how you use the images, okay. A blog is personal, even though you may have ads on it... Its like a YouTube channel. But with your app, you are offering a service. A free "ad supported" service, but a commercial service nonetheless.
If you really want to take this farther, you're going to have to ask a lawyer.

Thread should be closed and removed. Warez is not alowed and this thread is dumb.
On the other hand, people post warez links here ALL the time by posting ROMs.
Beyond that many ROMs contain software that carriers/manufacturers need to pay for and people install these ROMs on phones that did not come with the corresponding software pre-installed.
Just because this software is not available as a seperate purchase and doesn't require activation/serial etc. doesn't mean that it's not "warez".

why pay $30 when you can get it for free. the only people who are complaining are the ones who paid for it and now they feel dumb. and honestly it is overpriced anyways.

So, did this guy try to sell a warez copy of CorePlayer? If not, I cannot see the relevance in your reply.
The Difference...
The Admin & Moderators spend a lot of time discussing this exact issue and there is a difference between Roms (and the software that is included in them) and cracked commercial software.
First, Cooked Roms allow us to customized our Operating Systems which we have a license to use. It's similiar to adding/removing features from our desktops OS except because of the embedded nature of our devices the process is more involved. Don't want Office Mobile the only wayto remove it is cook a Rom.
Second, usually the applications included in the Rom are not commercial applications. Here is GPS Tool or Quick GPS available for purchase? Even when a commercial application is included in a Rom it isn't a version that is commercially avaliable; look at the taster version of TomTom and Cyberon Voice Dialer/Commader. I belive that the version of Sprite Back-up included in the at&t Roms is also a different version which won't upgrade using the commercial versions.
We acknowledge that we are in a gray area legally and as such we have to be very stringent about what we do and don't allow. If we become a Warez site then XDA-Developers will surely close down or loose all of the good that it currently offers simply to provide Warez.
Also as a community of DEVELOPERS we are as a community against stealing from developers.
It is a fine line we walk but in the end it is up to you our forum members to help us walk this line or abandon us as we refuse to allow WAREZ.

I did actually buy quite some software. But when it comes to playing videos I still use TCPMP instead of CorePlayer. And guess what, that's freeware!

You sir, are an IDIOT! I can get anything for free & I'm certain I know of more sources than you could ever dream of. That said, while there are certian thing that are limited trials, or have no trial version & I will usually download to test those. Just like SK Tools, which is a great app, so I PURCHASED IT.
Guess what, if everybody was a scumbag thief like you, developers would stop making the programs you use. So it's because of us so called "stupid" people, that you can even cheat the system. Think about it idiot! If everyone was stealing your $hit, you'd stop making it, right?

From what I understand, jail-breaking doesn't allow you to steal commercial software. It basically allows you to install un-signed apps. You're looking to steal software. This isn't the place to do it.

You're exactly right. I've jail-broken many of my friends iPhones and it doesn't allow you to steal commercial software, it just lets you install unsigned, user made apps.
And stealing software is illegal (DUH!) and not acceptable to talk about here.

I find it unreasonable. This was clearly done at the whim of the movie studios in the name of anti piracy measures. The reason I can be sure is the moronic logic. Anyone willing to pay in the first place wouldn't be the pirate type. Who is going to pay to watch it just to pirate it? They are making it so people who root their phones can't pay for the content. That leaves one way to view it, piracy. Also if you are smart enough to root a phone, you can certainly fire up a torrent. Shame on Google for bending over to the mpaa and movie studios. Can't say I care all that much though. The studios are shooting themselves in the foot. People will only take so much bull**** and keep dealing with it. If only they had even half a clue what consumers want.

That and in time a hack will be made to bypass the check for rooted devices. Google should know that already ... as they said themselves that as long as there is security in place there will be a procedure to bypass it...

Really? The only device you can watch video on is your phone? Almost everyone else has a range of choices - theater, DVD, Blu-ray, Netflix, TV, etc. Phones pretty much suck for watching movies, they have small screens and poor audio. The market continues to move toward large screen home theater systems. You don't know what you're missing.
I fear that Android's time as a fully-open platform is limited... If they want to play nice with the corporate world, doors are going to get shut on our faces. At least that's how I see it...

Huh? Android was never "a fully open platform." The kernel (only) is licensed under the GPL, but most of the rest is licensed under Apache or similar, which has no requirement to provide source. Google makes everything fully available to hardware manufacturers only. That they've made most of it available to anyone is through their generosity, it's got nothing to do with being "open" in the FOSS sense.
What _is_ "open" is application development and distribution - no need to get the gardener to pot your plant inside the wall.
Don't like Google's terms for their forthcoming movie rental biz? Write your own app, and start your own competing one. Google hasn't done anything to stop you.
At the end of the day 10 dollars is too much for a movie. There are way more professions that should make that kinda money. Teachers and doctor's and people like that should be the paid people not the producer who gave input of a video. I'll pirate till they choose to reduce they product

So, you rationalize your illegal actions, instead of just avoiding the product altogether. You're the problem, not the solution.
Good to see a few people see how reasonable this is. To Google consumers, developers and the 'big wigs' come first, not the tinkers and hackers. As others stated, Google is in the business of making money.

Thanks man, I work in the film industry and never can seem to get the point across that its how i support my family. People seem to have the perspective today that well i don't have the money then they buy a case of beer or something and download a movie and its no big deal. Its just like software developers you need to support the community and I'm sure most do but I can't blame the studios for protecting their lively hood. Pirating moves does effect people. However I am a rooted user and still feel its to bad I can't buy movies on a rooted device as I would on a regular basis.

I'm a father of two and they have been using the net since young age as I think the sooner they would understand the dangers and the positives it would be better than delaying the inevitable.
The backslash was that the oldest gain too much knowleged and has been online not behaving well.
I've surf around the XDA and Google and have not found an actual Android app that is cost effective and actually reliable enought to allow them to continue without supervision of all what they do.
Any suggestions out there, even from the more "dark side" ?
What I've found so far and a few comments on my opinion:

I tend to go to the highstermobi app but not sure if there could be a better app with the missing features this one has.

I definitely have no affiliation with any of this companies and actually I'm looking for something other than this as these do not fullfill my goal.
I can erase the reference to all apps. I wanted to avoid members to say "I did not google or search around".

Here is the issue that you will face. In many places apps like the ones you want are deemed illegal. Even if installing on your child's device. Might want to look into the laws where you are.
Apps like that are also not allowed to be talked about here so I hate to say it but you won't be finding any help on the matter here.
As a parent of twin teen boys. All I can say is sometimes you have to let them learn things on their own. You can't protect them forever.

you can discuss about this apps but not linking them as you did with prices as well, are you interested on the price or usability , I would say the last so you can discuss about this. You already have an advice above so you can get feedback without linking them

The one that has gained knowledge from using the Internet would probably circumvent anything you did anyway, in a way, your plan would only fuel his fire to learn more to bypass whatever you do, so in effect, you'd be pushing him the direction you don't want him to go even faster than if you just left it alone. With that particular child, you'd have to completely restrict their access to the internet, which is virtually impossible in today's world.

Exactly. Not to mention that with the schools and topics of learning these days. They probably already know how to bypass it. I was amazed the first time I caught my boys sending messages encrypted in their pictures. When I asked where they learned it, they learned it in school. This is when came to understand that there was nothing I could really do about it.
We always want our kids to surpass us. Which they normally do but that comes with some hard pills to swallow as a parent lol.

PLEASE do not pay for firmware which should be free anyway. And PLEASE dont install software on your Windows machine using Admin when you do not know what you are installing. You have been warned. Outlets like FunkyHuawei are not community , they are not us. Devs enjoy what they do and if you want to contribute all the better, make a donation. But do not pay the stupid amounts of money to people making a fortune from FOSS
In the meantime, add your voice to those who are protesting with Huawei in the hope that they will rejoin the community and reverse their decision to remove free codes for unlockers like you. Only by adding your voice will you make a difference. Paying guys like FunkyHuawei stupid money like $50 for unlock is stupid ... your just creating a demand when instead we need to engage Huawei.

I totally agree with you, paying $50 bucks, this is the first time i ever had to pay for the unlocker code, i already used samsung, motorola, xiaomi, none of them charged for the unlock code. For me isn't onle 50 bucks, is RS 200 + charges. I don't feel good spending this money like this, i prefer to donate to some one that really help the community.:good:

Exactly. The timing of this thread is also comical. At this point, even funky huawei cannot provide bootloader keys - at any cost. The bootloader unlock "service" is down/discontinued.
Also, the guy running Funky is an XDA member. (and was before it's existence) I agree that his prices are absurd, but it's not a service anyone else provides nor is it something you have to use - just wait for Huawei to (hopefully) push the update to your phone.

Look at this guy, lost all respect for you for this comment. Xda have allowed funky to do what he does. Accept it, Goronok is correct, nobody is forcing you to use funky, if people are stupid using in your eyes, let them be. This has been discussed to death already

I am sorry to hear it might be considered a cancer. I'm just a user (with only a little amount of understanding) that wants to put Nova Launcher on my EVR-AL00. I guess I'm being a tad selfish.

Thanks for your post brother!!! This is exactly what I have been shouting about in my other post, glad there are people on this earth who have same vision as me! Im suprised the mods did not ban you yet!! they have deleted some of my posts regarding funky! definitely there is some affiliation.
That being said, How can we obtain the codes for a lower price, perhaps even free, as it should be? I refuse to pay these 3d parties, not because of money, but out of principle. I'm a business owner, and even if I had an unlocker in my hands, I would not charge for it, I would release it in the public. Android is open and should stay open. Period.

I do not know why XDA would remove some of your posts. I suppose if a post is against their forum policies in some way , i could accept that. But if there is indeed affiliation to paid services without express declaring such, then I would find that most alarming for a forum as huge as XDAdev and it would without doubt proceed to lose integrity and trust. I have not seen any evidence of affilation but that's just me. Objectively, as I say, there's no harm provided there is transparency and members are 100% aware that XDA are affiliated to this individual for whom I have the utmost contempt for becuase he is profiting from what is a FOSS community and doing so on the back of Huwaei corporate decisions which XDA are openly objecting to. Can't have it both ways !!

I posted something like why would you pay for such service in a funky thread, and my post got deleted. From that day I've made a statement in each post I made for the mods to stop deleting my posts. You can read back my older posts. It made me aware that something was going on this forum that was supposed to be free speach to help the open community..

I'm sorry mate. Seems beyond me. Tried today, I can't seem to get past the bootloader so. No code. No unlocked phone, So can't remove the APK using adb, right?
Or do I need to find earlier firmware before it was KOd...
This is starting to go into the too hard basket. I'm not in the tech industry.
I think it would be easy enough if I had the unlock code...... If Huawei are no longer giving them out, I mean how do I get it? Does seem to be interesting that the while of China closes down, the codes are no longer available though. I guess it points toward that it is more of a Guanxi thing than a coding thing, so...

I am an idiot.
I did not need unlock. My problem was my dodgy work PC....... I have always used it, mostly successfully. Your name though, signifies being correct. So I went onto my MAc and tried again. OMG. It worked
I am now running NOVA sans the launcher.
Oh - I am so sorry for annoying people here.
On the plus side, I have saved my self coin once the CNY is over and unlock codes are being sold again.
sigh... I posted in multiple comments too. I guess I need to go apologiZe and edit in those ones too.
