Patent Reform Petition - General Topics

I urge everyone to take one minute out of their busy lives to read and then sign this petition from the EFF for patent reform. It's very simple, and very well thought out. Many big players and developers already support this. Please do your part as an American Citizen and a member of our great community to stop the patent tyranny that Apple had taken advantage of.

Please reshare this to everyone and every forum you know.
Shifted from Outer Space

I'm British, not American, but I've signed anyway. I find the current state of affairs with respect to patents absolutely disgusting. If it carries on down the same paths then it won't be long before Barack Obama has the ability to sue me simply because I happen to have two arms, two legs and have been born after him.

I posted a thread about this already at http://forum.xda-developers.com/showthread.php?t=1751455
But it mostly just turned into a flame war..

Oh it's fine. People can flame me if they want. I didn't start the petition. I'm just passing along what is a very well written reform thesis

To XDA, My reaction to Samsung RUSE

To the board of XDA.
Please give us more credit than what was proposed from Samsung. You are dealing with real people here, and no one is being paid to be a part of this great community that has been growing.
I found it offensive and belittling to all members that the solution that was brought forth was to try to establish a sub forum with specific brand in mind, for all our issues and concerns. We know, as well as them, the problems and concerns we have with our devices.
This site is "registration free", all they need to do is come in to each of the carriers forum and read what our concerns and issues are. Instead they try to take us on a rollercoaster ride that was very counter productive plus a waste of time. A mirage sort of speak for their political gain. In no way it benefited the members here.
I was actually shocked that it went as far as it did. The "hype" that they created was nothing like I've seen. They even posted a youtube video as a metaphor what was in store for us. Giving a false hope and yet tarnishing their company name even more.
What was the main goal? To sugar coat answers?
We want real world solutions, not the same redundant answer we've been getting (or poll).
Bottom line: A real fix. That's if they really cared
As a billion dollar company, Samsung, they can hire hundreds of people to go through all the post in these forums and collective data for themselves. As fore mention they know it's "registration free".
But someone was being paid to come in here to minimize bad PR. He was doing a job! And it was easily revealed. We, as members, are here voluntarily of our own free will. That's what makes this community so great. Keeping it real.
I know XDA was only looking out for our best interest, right? But I can say, "I saw this coming from a mile away".
*grabs torch and pitchfork*
Just wondering why SamsungJohn whats to create a "poll" when we've already gotten the shaft!
Come on guys no need to let it get out of hand. Let it go for now till we get more info.

Apple and Google 'anti-poaching' agreements..your take.

Was going to post in Off Topic, but I thought this might get buried, and thought it mighty important, also, general and on-topic..lol
As you may have heard, there is currently a lawsuit from some devs against software giants like apple, google, adobe, just to name a few. The lawsuit alleges that these major software companies have agreed not to hire anyone from a rival software firm while they are still working for the rival (i.e. Apple treats you like crap? Google isn't going to hire you and treat you any better), what's more they agreed to tell their rivals when one of their employees is submitting their resume and seeking employment at their rival firm. Also, after you leave, they don't want you working for their rivals either..there was talk about even FORMER employees being blacklisted from employment at rival firms.
Recently emails have surfaced between Steve Jobs and CEO of Adobe at the time who informed Jobs that his anti-poaching agreement was 'likely illegal'. As someone who is getting into development now, and am quite the noob, this really lifted a veil off of a world where corporations are using the developers and then ruining their careers or locking them into having to work for the same company, if they want to work at all, for the rest of their career, without opportunity being given to have better benefits because of an almost mafia-like agreement between these software giants.
Is this typical from you guys' experience?? And what is your opinion on it..if you have one..
Most of the places I've worked at have had some kind of similar thing in the contract. It's generally been that I can't work for direct competition within a period of x months after leaving the company. I've never heard of anything going into the depths you've mentioned though, but if Mr.A and Mr.B agree not to employ each others staff then I don't really see what you can do about that.
http:// http://www.huffingtonpost.com/2012/01/20/steve-jobs-anti-poaching_n_1220244.html?ref=technology
Tell me what you think about wonderful pacifist lefty Jobs now ifanbois lol
Also, Google 'FOXCONN'..that place is awful, another thing that troubles me about technology and apple specificlly..apple directly employs over 100,000 people, and indirectly over 700,000, yet only 45,000 of those jobs are American, mostly designers and the guys who work at Corning making gorilla glass for i-stuff..I was looking at becoming an engineer or programmer, but I'm beginning to wonder if it is a 'morraly sound' decision lol
I dunno what exactly the government doesn't like about it, unless the rules are in place to keep companies from hoarding skilled employees on the assumption that it gives them some kind of competitive advantage.

Thread moved. Would advise you to read forum rules and post in correct section.
...oops, but forgive i don't understand why this would be in 'android development' 'android general' because it isn't about android specifically..but many smartphone manufacturers/software companies not excusively android (???) forgive i sound dense..but I did read and do follow the rules (I thought!) so I just want to know exactly why this was not considered to be in the right section (the news article I posted was actually Apple-heavy, definitely not 'android development general discussion' thread material I thought surely.. )

ReACTing to ACTA

I know that most of you guys are aware that ACTA is similar to the whole SOPA and PIPA thing, and I know that there are a number of threads already on XDA about, but this is kinda different.See,first of all,SOPA wasn't some secret agreement, everybody in the USA(well, everybody not living under a rock) knew about it and its consequences.ACTA is kept secret, and, especially here in Greece,we've learned to NOT trust politicians after they pretty much ravaged our rights in property and in living with dignity. We saw our salaries drop to nearly zip,we saw banks take our homes,we saw our brethren living in the streets because these total a$$es that rule our world decided to do so.
However, until now,we at least had the freedom to write about it,to share our opinions,to express ourselves. We were,at least as far as the internet goes, free. This liberty is ours people. It's yours,it's mine. It's not their's.
We can all agree that this is not about politicians suddenly deciding to start internet censorship, nor is it about them caring to protect any copyrighted material just because it's right to be protected. It's copyright holders who try to enforce it upon us.It's them, these guys that are perfectly willing to kill us just to add 10 more € to their billions-worth-of piles of cash.
So,starting from the last point I made. That is what will hurt them-hurting their wallets.Yeah, protests and blackouts against SOPA and PIPA were all good and stuff, but it was only the beginning.Protesting is not enough. They don't care about our freedoms or something. It may have worked in the US,but do you expect the guys who don't respect the lives of the millions of European tax payers to respect your freedom of speech on the internet or anything? The answer is clear, and it is NO,they won't.More drastic measures have to be taken.Examples include:
-Not buying any copyrighted material, including music CDs,DVDs etc.
-Not going to places like the cinema, where copyrighted material is shown.
-Not spending any money online for copyrighted material.
And many others like these. We,for once, have to react as consumers,as the people without the money of who they are nothing. We have the power-we just have to use it.And,for Christ's sake,we have to react as free people.Nowadays we tend to forget that we are indeed free people.Or at least we are supposed to be.
I'm not stating that what I have to say is absolutely right,as I'm very biased towards blaming these guys for anything. But I really want to hope that many other people share my opinion.
Mods,I know that there are already threads about it,but please, for once, let us be heard. We are about 4.5 million people in here.We have to be heard.I'm not talking about myself,I'm only 1/4500000 of this community. But guys like the news writer team, the guys at XDA TV(Azrienoch is the best at rants) and people well connected in the world outside XDA can really make a much bigger difference than I can.
So guys, put your wallets and credit cards inside your pockets, don't give your money to these guys.Start sharing this stuff.Facebook,Twitter,YouTube, you name it.Tell your friends,kids,parents,neighbours,bosses,co-workers.Start bothering your government.DO SOMETHING!ALL OF YOU!
I think we all deserve a free tomorrow, with all the rights our ancestors spilled their blood for.
So,no one cares?I'm surprised, seeing as we'll be among the first to be targeted...

Yes, let's all take the time to provide our email address to an organization looking for donations to advance ideas that have ZERO chance of ever seeing the light of day. The last patent reform effort hasn't even kicked I yet. Congress won't look at this issue again for another 50 years, least of all at the urging of these hacks.

Anonymous hacked www.ussc.gov!

Everyone needs to go check this out it is HUGE http://www.ussc.gov/
http://www.youtube.com/watch?v=WaPni5O2YyI&feature=player_embedded
Citizens of the world,
Anonymous has observed for some time now the trajectory of justice in the United States with growing concern. We have marked the departure of this system from the noble ideals in which it was born and enshrined. We have seen the erosion of due process, the dilution of constitutional rights, the usurpation of the rightful authority of courts by the "discretion" of prosecutors. We have seen how the law is wielded less and less to uphold justice, and more and more to exercise control, authority and power in the interests of oppression or personal gain.
We have been watching, and waiting.
Two weeks ago today, a line was crossed. Two weeks ago today, Aaron Swartz was killed. Killed because he faced an impossible choice. Killed because he was forced into playing a game he could not win -- a twisted and distorted perversion of justice -- a game where the only winning move was not to play.
Anonymous immediately convened an emergency council to discuss our response to this tragedy. After much heavy-hearted discussion, the decision was upheld to engage the United States Department of Justice and its associated executive branches in a game of a similar nature, a game in which the only winning move is not to play.
Last year the Federal Bureau of Investigation revelled in porcine glee at its successful infiltration of certain elements of Anonymous. This infiltration was achieved through the use of the *same tactics which lead to Aaron Swartz' death. It would not have been possible were it not for the power of federal prosecutors to thoroughly destroy the lives of any hacktivists they apprehend through the very real threat of highly disproportionate sentencing.
As a result of the FBI's infiltration and entrapment tactics, several more of our brethren now face similar disproportionate persecution, the balance of their lives hanging on the severely skewed scales of a broken justice system.
We have felt within our hearts a burning rage in reaction to these events, but we have not allowed ourselves to be drawn into a foolish and premature response. We have bidden our time, operating in the shadows, adapting our tactics and honing our abilities. We have allowed the FBI and its masters in government -- both the puppet and the shadow government that controls it -- to believe they had struck a crippling blow to our infrastructure, that they had demoralized us, paralyzed us with paranoia and fear. We have held our tongue and waited.
With Aaron's death we can wait no longer. The time has come to show the United States Department of Justice and its affiliates the true meaning of infiltration. The time has come to give this system a taste of its own medicine. The time has come for them to feel the helplessness and fear that comes with being forced into a game where the odds are stacked against them.
This website was chosen due to the symbolic nature of its purpose -- the federal sentencing guidelines which enable prosecutors to cheat citizens of their constitutionally-guaranteed right to a fair trial, by a jury of their peers -- the federal sentencing guidelines which are in clear violation of the 8th amendment protection against cruel and unusual punishments. This website was also chosen due to the nature of its visitors. It is far from the only government asset we control, and we have exercised such control for quite some time...
There has been a lot of fuss recently in the technological media regarding such operations as Red October, the widespread use of vulnerable browsers and the availability of zero-day exploits for these browsers and their plugins. None of this comes of course as any surprise to us, but it is perhaps good that those within the information security industry are making the extent of these threats more widely understood.
Still there is nothing quite as educational as a well-conducted demonstration...
Through this websites and various others that will remain unnamed, we have been conducting our own infiltration. We did not restrict ourselves like the FBI to one high-profile compromise. We are far more ambitious, and far more capable. Over the last two weeks we have wound down this operation, removed all traces of leakware from the compromised systems, and taken down the injection apparatus used to detect and exploit vulnerable machines.
We have enough fissile material for multiple warheads. Today we are launching the first of these. Operation Last Resort has begun...
Warhead - U S - D O J - L E A - 2013 . A E E 256 is primed and armed. It has been quietly distributed to numerous mirrors over the last few days and is available for download from this website now. We encourage all Anonymous to syndicate this file as widely as possible.
The contents are various and we won't ruin the speculation by revealing them. Suffice it to say, everyone has secrets, and some things are not meant to be public. At a regular interval commencing today, we will choose one media outlet and supply them with heavily redacted partial contents of the file. Any media outlets wishing to be eligible for this program must include within their reporting a means of secure communications.
We have not taken this action lightly, nor without consideration of the possible consequences. Should we be forced to reveal the trigger-key to this warhead, we understand that there will be collateral damage. We appreciate that many who work within the justice system believe in those principles that it has lost, corrupted, or abandoned, that they do not bear the full responsibility for the damages caused by their occupation.
It is our hope that this warhead need never be detonated.
However, in order for there to be a peaceful resolution to this crisis, certain things need to happen. There must be reform of outdated and poorly-envisioned legislation, written to be so broadly applied as to make a felony crime out of violation of terms of service, creating in effect vast swathes of crimes, and allowing for selective punishment. There must be reform of mandatory minimum sentencing. There must be a return to proportionality of punishment with respect to actual harm caused, and consideration of motive and mens rea. The inalienable right to a presumption of innocence and the recourse to trial and possibility of exoneration must be returned to its sacred status, and not gambled away by pre-trial bargaining in the face of overwhelming sentences, unaffordable justice and disfavourable odds. Laws must be upheld unselectively, and not used as a weapon of government to make examples of those it deems threatening to its power.
For good reason the statue of lady justice is blindfolded. No more should her innocence be besmirked, her scales tipped, nor her swordhand guided. Furthermore there must be a solemn commitment to freedom of the internet, this last great common space of humanity, and to the common ownership of information to further the common good.
We make this statement do not expect to be negotiated with; we do not desire to be negotiated with. We understand that due to the actions we take we exclude ourselves from the system within which solutions are found. There are others who serve that purpose, people far more respectable than us, people whose voices emerge from the light, and not the shadows. These voices are already making clear the reforms that have been necessary for some time, and are outright required now.
It is these people that the justice system, the government, and law enforcement must engage with. Their voices are already ringing strong with a chorus of determined resolution. We demand only that this chorus is not ignored. We demand the government does not make the mistake of hoping that time will dampen its ringing, that they can ride out this wave of determination, that business as usual can continue after a sufficient period of lip-service and back-patting.
Not this time. This time there will be change, or there will be chaos...

I am also glad you sleep at night; I was quite worried, thanks for sharing. You must also sleep good at night hiding from how corrupt the government can be. PS: all Anonymous is doing is pointing the corruption out, which is why I sit back and enjoy.

Yawn. Wake me up when they do something productive like, you know, filtering source code of big businesses and the like. Hacking an official website frontpage is what amounts to graffiti on a public building. Nothing to be so boisterous about.
