Not out there yet but might be redundant now that apple has eu ban against them for same product, as the ban will be in place in uk too apparently.

Not according to sources such as fosspatents, telegraph, cnet etcetera.
Apparently if uk sell the tab after a eu ban is imposed then europe can impose a financial sanction on the country.
It just sucks that one eu country can impose rulings on all eu countries because it means countries have no real power anymore.

I still can't understand how a german court can have the power to force an eu wide ban when any patents violated must be country specific.
I wonder if the eu decide to sanction the uk whether that would be legal even, fining a country for putting its own laws before those of another country.
Samsung may get an apology but right now they are looking at losing billions worldwide just in court cases.

I don't understand it either, and I think your supposition that it would be of questionable legality is spot-on. Regardless, as I said elsewhere Apple is only hurting itself. Every suit they've brought has garnered more awareness for Samsung--and Android--as a viable alternative to their offerings and has made them look worse than Microsoft when they were on the wrong side of the anti-trust cases back in the day. It's pathetic, period.

It is pathetic of apple but the court cases haven't made android look a better alternative because it's been almost non stop wins in court for apple and losses for android.
People generally assume that if a company holds a patent for something then they must have invented it, and therefore that they are defending their rights when they take other companies to court over it.
The big problem is that apples patents are for pretty much everything mobile devices can do yet are not standard essential, so they can refuse to licence them or charge a fortune to do so whereas their rivals patents really are essential and as such apple can use the frand excuse, not pay to use them and then cry foul when they're asked for overdue royalties.
In europe a european court can indeed overturn a member countries legal decisions.
I had to check it as was surprised, but apparently they have had that power since the nineteen seventies when member states signed a statute saying that eu law would take precedence over national law.
I really don't think many people realise how easy the system is to abuse. Apple lose a uk case so they simply go to another country and win there which makes our rulings pointless.
How would americans feel if their laws were able to be overturned by non americans? I think they would do something about it but us europeans gave away that right decades ago and now companies like apple can ban their competition in multiple countries at once with a single court case.

It's crazy that with the fierce nationalism that certain countries show they would so easily give away their control over their own regulations. I also understand that these judges also aren't electronics/software experts, but I just can't fathom how they've come to the decisons that they have short of utter idiocy and blindness or blatant payoffs.

I don't want to add to the legal troubles of my favorite manufacturer, I just want them to correct their mistake, unlock the bootloaders as promised & apologize for what I am sure was an inadvertent oversight that will be corrected in a few hours or a day or two.
You simply can't make advertisement directed toward increasing sales off new devices to developers & power users (the folks that review and fix bugs for you freely in many cases) and then break that bond, that trust built over the last decade.
Also, don't even try to say that you aren't using these social media outlets to market and advertise. I have been getting your posts and tweets, advertising your devices all week.
While your actions are certainly in violation of numerous trade regulations and laws, I don't care at this point. I don't want to make a name litigating over these issues, I just want the manufacturer that I support, to keep their word and market/advertise their devices in a fair and ethical manner. I am not participating in the boycott thread & I'm not asking people to stop buying HTC products. Just the opposite in fact. I want you to be successful. But I also want you to honor our relationship and keep your promises.
Please, take notice and make this right.
I ask all XDA members to support HTC in doing the right thing & pledge your support by joining this discussion and adding your name to this petition.
We, the members engaged in discussion in this forum thread ask HTC to comply with their advertised & promised claim of May 26th, that all future devices would have unlocked bootloaders.

Lying about S-LCD displays is another reason I avoid HTC phones. HTC used to be acceptably decent. Now they seem to lie their rears off.
Although I am a die hard Samsung user, I do support your cause for HTC to have unlocked bootloaders now and in the future. What they do could affect how other manufacturers treat their devices. I wouldn't want to see the same thing happen to Samsung phones either. Plus this also stifles development by the independent community as well.

I've always went with HTC phones, and I was considering going with another manufacturer until HTC made the bootloader statement. Now that I see they are not true to their own words, and I can't even trust a statement made by the CEO, how can I continue to trust your devices or quality.
I personally make decisions in my company regarding the devices we use in the field, and have mostly chosen HTC phones to meet our needs. If you continue this line of blame-shifting back and forth between it's AT&T's fault and AT&T says it's your problem, (we all know better considering other devices from other manufacturers are unlocked or unlockable on AT&T) you are going to loose a large contract, as I will have to find another manufacturer, and possibly another service provider.

+100 im shocked the evo 3d owners got them to unlock the bootloader. And they posted that statement when we all told them how angry we were they locked our bootloader. I cant believe tuey flat out lied about unlocking future devices tisk tisk.
It is not HTC that is locking the bootloaders. It is the carriers. They lock them because people brick their phone and claim them under warranty which costs the carrier a fortune. There is a legal battle over this currently.

As a result of the nexus ban google announced today that they will change android features such as its search function as well as other unspecified changes.
This has been apples goal by litigating, to get android itself changed, to make it appear a feature lacking sub standard rival.
It also means further court cases could result in more changes, it's a shame apple can only look good by litigating against their competition.

This seems to mean siri who can give out local results (a feature apparently patented by apple) will seem better than googles offering. No idea what else will change but it seems apples plan is starting to pay off and change android itself to make it less threatening.
This shouldn't affect european users as we don't allow software patents, and it won't affect current non google devices, but it does mean from now on android itself will be lacking certain things and as stock android is affected this means all androids in future that use jellybean or higher may also be affected.

Google can't apply their patent as it has not been granted, only applied for, and therefore cannot be infringed.
Google being a US company I think if they allowed two versions that apple would find a way to litigate because it would still be a US company violating a US patent if the software was developed in america.

The problem is that google now own motorolas patents which are essential to phones but can't be with-held even if not paid for because they are frand.
Indeed a german court ruled that despite apple not paying their fees motorola can't use these same patents against them and so google can't use their most powerful weapon precisely because it is so important that courts rule it cannot be with held.
It is worse in usa though due to allowing software patents.

Why can't google europe...or google UK, google france etc. release the software on our play store?
Hear me out for a second. IF this google now, google voice thing that is banned from the states become a apk...or simple APP that can be downloaded and installed 'only for europe' supposedly, and released by this side of the world. Why would that be violating the patent?
Then ultimately US member could install it as well which will be out of Google (US) control.
Surely there is a way around this...

Frand patents are patents essential to a product, meaning if the patent holder refuses to let others use the patents then no one else could easily make a competing product.
As a result europe make sure the frand licence (short for fair, reasonable and non discriminatory) is applied which means they must be allowed to be used providing those using the patents pay royalties.
Regarding the voice search being available unchanged in europe I'm not a lawyer so I may be wrong but logically as google would be still developing it in usa and are usa based, where the court ruling applies, they would still be developing something they legally agreed not to and therefore would still in violation.

Its an analog concept implemented digitally just like computer folders. Meaning its not a new idea, its an existing idea being implemented in a new medium.
So we have all these previous examples of "prior art" and "essentials" to any smartphone/touchscreen phone. Are the Samsung lawyers really that dim/stupid or is Judge Koh not the so called "fair" honorable judge that has ruled for Android/against Apple in the past?

From all this I'm reading its starting to look like apple pays off a lot of people such as the judge who ruled against the professor who was blown up by the unabomber despite winning the jury's vote and having a email from Steve jobs requesting to talk about using his technology... dude how many people are in the us on xda? How many people would it take to petition to remove the law that allows software patents? Its bull**** that apple can try to monopolize the cell phone market especially when most features were around long before they got their patents.. I think if we got millions of people to petition this it couldn't go unnoticed to say the least.. not saying it would change but drawing as much attention as possible is how to start a change right?

Agreed, and this is coming frome a Mac and iPad enthusiast.
In yet another Apple lawsuit in the US, and yes it's against Samsung, Apple have listed several of their patents and what they want in compensation.
Aside from $2.25 billion for lost profits they say Samsung caused by misleading people with their copied look they also list the royalties they are demanding for use of their patents. Thought it might be interesting to see just how much (financially) a successful result for Apple will cost the end user.
Bear in mind that to use Samsungs patents Apple have offered just half a cent per unit even though Samsung own a number of standard essential patents. Apple want the following per unit from Samsung for each device sold....
$2.02 for allowing Samsung to use "overbounce" patent (the bit where your phone pings back when reaching the end of a gallery for example)
$3.10 for the scrolling api patent
$2.02 for allowing Samsung users to tap their screen in order to zoom in or out, or navigate
$24 for allowing Samsung to have devices that look similar
That's over thirty dollars per device. If they win (and as it is Judge Koh presiding it's very likely they will) then the end price of Samsungs android products will have to go up to incorporate this and it means that end users will end up paying more and getting hit in the pocket for what are surely implausibly high royalties.
How can Apple pay just half of one cent yet expect over thirty dollars in return?
Apple ceo Tim Cook said "we just want other people to invent their own stuff" recently but it looks like what they actually want is to make up their less than expected profit shortfall by picking on their best selling rivals until they can bring out the all singing all dancing iphone 5, at which point presumably they will then also sue Samsung for having a large screen phone

The problem is that it would also impact all non american users to as it is a per unit cost applied to all units not (I think) just ones sold in america.
Not seen your thread, but as am not american can't sign american petitions although I would have thought you would have to petition your congressmen, or is that who you mean? I was assuming you meant petition apple.

Ohhhhh yeah. What do you expect. The Law is the Law! In the US that is common tool for making money. If they allow it, then it will hit the Courts.
Beside that Samsung has some money for rainy days ( from using the cheap plastic )
I am a proud apple hater but that doesn't change the facts. If Samsung overcharge us ( and i don't believe that ) we have another options like HTC, Moto, LG etc.

What is wrong the patent system? How can someone get a patent to ELECTRONIC LISTS?! Makes no sense at all what is going on with these patents. "songs in music libraries"? Where ELSE would you have songs, in electronic lists? Which is again patented. Someone has to be getting paid on the inside, right?
The real cost to users is probably incalculable; increasing uncertainty causes less incentives for R&D, funds for which are diverted to dealing with the lawsuits in the first place.
In the long-term, this is a good thing: the more obvious the bull**** and harm to consumers, the more likely some drastic change would occur. Knowing humans, however, it could take several decades.

Because Apple will go after them as well once samsung is taken care of, Hell they already have been. If Samsung falls do you think Apple is going to let anyone else fill that gap?
Also if Samsung falls it means Apple has a precedent as being able to successfully sue over generic shallow patents. Everyones prices will rise, not just Samsungs.
I dont thinks Apple should get royalties for basic designs and tech they did not invent

Plus, because the apple patents they now have are vital to any mobile os (displaying documents on screen, using icons and widgets, touching a screen to input data, etcetera) but not under frand terms apple can refuse to allow their use and force phones using these features off the market.
And we're talking about a company who sued a grocer for having an apple as part of their logo so don't think that apple won't sue android out of existence if they can. They will.

Here's a interesting write up about some sketchiness among the jury and the decision. In this light, it seems almost certain that at appeal is coming, if not outright dismissals on at least some of the violations under a Rule 50(b). With this much alleged impropriety, they may even be able to get a stay on the decision.
I doubt Apple is overly concerned with a low sale volume device like the Charge in the grand scheme of things. I imagine that the most that might happen is stopping production.

Cnet is reporting that Apple is requesting a ban on sales of the Charge (amongst other phones) in the US.
With appeals and other legal manuvering I have no idea whether this will really happen, but I wonder what it means for customers that have these phones... What would happen if you need a replacement from VZ?
It would be great if they just make them stock android devices with 4.1.1 like the nexus S...The resale value would double lol.
i would not be surprised to see VZW offer us a deep discount on upgrading to another device. probably something like $100 off the 2-year contract price of another device even if you have time left on your current contract. which is really nothing new, but it could easily persuade most out of the charge...
but whatever it is, I want dwith to let me know where he is going first, and I'll follow.... (just don't say iphone....)

Definitely. This is a great group I've found here. I don't want to just trade you guys in for the sake of some stupid phone. Unless he says iphone. Which would suck. I don't expect that to happen though.

First article is showing how the only device that the judge felt confident in granting a sales injunction for was one of the few devices that didn't get any judgement against it. Literally, the only device the judge thought was a slam dunk got off clean, and others that she considered to be weak cases got slammed by the jury, which when taken with the earlier reports of procedural errors and bias points further toward an incompetent or biased jury. The second article compares this case to previous attempts by Oracle, SCO, and Microsoft attempting (and failing) to shut down other FOSS projects due to fear, and speculates (with good reasoning) that this could very well be a test case for patent reform that makes it all the way to SCOTUS.
This is just getting worse and worse. The jury foreman in an interview said that he determined that prior art didn't apply because "The software on the Apple side could not be placed into the processor on the prior art and vice versa. That means they are not interchangeable. That changed everything right there." Great logic, except that interchangeability isn't part of the definition of prior art. I can just be words on a piece of paper with no actual implementation whatsoever and still be prior art, yet he managed to convince the rest of the jury using that logic. Keep in mind that this is the same guy who has a patent and admitted that was thinking of this case in terms of defending his own patent.

Suddenly and without warning today ... this hypothesis struck me and started to develop (much like an impending thunderstorm). I wonder: What if somehow Apple managed to coerce AT&T into sabotaging the ICS release with the intent of deflating Samsung, just in case their lawsuit didn't work out? In return, AT&T would be thrown a handful of Apple exclusives (since they were so bent out of shape about Apple cheating on them first with Verizon then Sprint; ironically about the same time that the Android lineup REALLY improved at AT&T). Naturally, greedy AT&T would jump at the chance to be Apple's main (excuse me) ***** one more time, right?
I guess this is coming from a place of substantial anger. I'm FURIOUS that the phone I LOVED so much for seven months was basically taken away from me. And there is not a SINGLE official word from either Samsung or AT&T about what I can do about it. So I suppose I can bring the thing back to Best Buy, AGAIN, and recieve another REFURBISHED edition (one that's only 300 IMEI numbers up from the original one), but honestly, I don't have the time or desire to rebuild the damn thing one more time (and then beg the guy at Android Assistant to please let me not have to pay again ... etc. etc. etc.)
I know ... I'm delving deeeeeeep into conspiracy theorism and perhaps I shouldn't play so many video games. BUT, maybe ............ anybody think it makes sense?

Did i miss something and AT&T officially released JB? Because I'm speaking specifically about the official release that AT&T and Samsung sent out to its customers ... you know, the legal way.

No. Dude these are multibillion dollar companies, they have better **** to deal then playing subterfuge over what would amount to a couple thousand dollars, at the most, lost from annoyed customers

Actually- rooting your phone and using a custom ROM are 100% legal.
Carriers like at&t don't like it, but its legal.

That was sweet! ALL HAIL GRAMMAR NAZI! As far as the 'discussion' goes, it should make no difference to you who releases what and when. As it was pointed out, maybe you are missing the point of this arena. Whether you develop, tinker, or just screw around with your phone, the point is this: collectively, we as a group could not care less what the carriers or even manufacturers provide for us in the way of OS updates. We seek out our own, by way of skilled and knowledgeable people who aren't satisfied with the bloatware infested offerings given to us long after the fact. As a member of this forum, you are EXPECTED to have the desire to learn how to make your own way in the android world, albeit with the help of others most of the time.This is a development and learning forum.
