Will O2 swap my sensation for the nexus s ? - HTC Sensation

ok so basically today at a closer inspection on my phone I noticed it had dust under the screen and I know it's a common problem for the sensations :/ so I emailed O2 but I was thinking I really don't want another sensation if it's going to continue to gather dust under the screen so I thought I'd ask O2 if I could swap my faulty device for the nexus I mean I'm on a 24 month contract at £42 a month so it's not like they'd be loosing out you guys reckon they'll even consider it ? This is what I sent them:

Theoretically under the sale of goods act you could reject it all together as it's not fit for purpose and then sign up for the Nexus.
It's a grey area on what is classed as a reasonable time. But given your contract is 24 months I'd say 2-3 months in would be considered reasonable.
Add tot he fact that this is a known issue you have the right to reject any offers of repairs.
I'd play hard ball with them IF you really want to change.

I work for a mobile company and the answer is absolutely no way what so ever. They will replace that handset under warranty, only after having about 5 of 1 phone with the same fault will a network provider look at the possibility of giving you a similar spec/priced phone. And got the sensation that's the s2 .

Yeh its a bit naff a know , but they will bring the contractual agreement out. Signed with that phone on that tariff. Your not the first to ask, it will make no difference if you upped your tariff to £61 a month to tariff.
Best bet is get it replaced then sell the phone and buy the nexus

Yeah, required regular maintenance is exactly the same as a manufacturing defect, well done.

I'm on my 4th Sensation, which now has dust under the screen (not all were because of dust), and I've had it, no way will I settle for another when I take it back.

This stupid dust issue is the reason I am strongly considering trading my Sensation for a co-workers Nexus S by the end of the day today. I'm now on my second one with this problem and I have seen others being on there 5th one with the same issue.
My coworker said he can live with the dust issue. I, however, can not.

Firstly, in the UK warranties have no legal standing thankfully. Instead we have statutory rights which state items purchased should be fit for purpose, you should get a reasonable amount of use out of it and if a fault develops in the first 6 months it is up to the retailer to prove the issue was caused by the user or was pre-existing at purchase.
So, in relation to your phone, the retailer (not the manufacturer) has a legal responsibility to repair, replace or refund (less an amount for use) it, without affecting you unreasonably.
You have a legal resposibility to be reasonable and co-operative with them.
Your letter is good, you've pointed out that it is a common fault which shows you've done your research, and you're willing to pay the difference to get a different phone.
Of course they are within their rights to just replace your phone with another Sensation (does the Sensation XE suffer too?). I would gently protest if they do stating that you have no confidence that the issue will not re-occur.
If they stand fast, see if they will agree to give you the Nexus if your replacement sensation also develops dust. Get it in writting.

Only thing I'd add is that often it's best along with taking the official complaints procedure approach to also send off some emails/letters to names you can find of important people within O2, you may just find that one of them picks up your case and if they do you'll definitely get this sorted

Speed up s-off (unlocked bootloader) update

Hi guys, posted it in some thread but thought it would be a good idea to have a separate thread for it.
Facebook and Twitter is the only way to speed up unlocked bootloader process guys. You want publicity, not private conversation. So it's quite pointless emailing htc, we had a win, now we need to make sure that potential customers are aware that HTC is taking it's time in keeping their word, so they hold back on the purchase. If sales figures drop, HTC will pull the finger out and will HAVE to do something about it. PUBLICITY. REPUTATION. SALES. That's what we need to address. Make sure that you mention that even average Joe which doesn't want root can be affected, as if company doesn't keep up to promises, they do it to EVERYONE. Mention that they lied about Desire getting GB (well, calling it lie is exaggerating a bit, but we want to make it look bad, and I hope you heard the news), so average Joe can't expect to have his HTC phone to be up to date for the whole length of the contract (normally 24month in UK). Make customers think before buying, even if takes only one week for all the customers to decide, HTC will definitely notice it, and will realize what sort of impact small group of unhappy customers can cause.
Also, as a lot of us hang out in other forums (i still pop in to Desire forum now and again), i suppose we could start threads there with links to this one, or just quoting it, so we get a lot more people to help us (we are a small group of Sensation owners in the end of the day). I do believe that even Sammy, LG, MOTO etc. owners will be sympathetic to our cause and will help us to become louder.
If anyone thinks this thread is pointless, feel free to mention it to mods. Only sharing my thoughts

I've been spamming their facebook page since about two weeks ago. It's extremely annoying to see their rep. respond to some dumb pic post, while ignoring real issues. I didn't expect an unlocked bootloader by now, but I do expect some kind of update.
HTC said that the desire would be getting a gingerbread update, then turn around and announce that it wasn't possible. Are they doing the same with the bootloader? I also don't understand why the ceo would comment specificallyon the evo 3d, but not the sensation. I understand that online support has said that were getting an unlocked bootloader, but who knows. It's been a month, they could easily give an update. If something isn't done/said in the next ten days, this phone is going back to Wal-Mart.
Hell, if it was just the bootloader pissing me off, then I'd be ok. At this point, I can hardly get on the browser because the data keeps locking up. I'm starting to regret selling my g2x. I'm very close to going back to my hd2 for a few days so I can actually use my phone without wanting to throw it against the wall.

Have you checked out the G2X forum and all the issues with the G2X? The fact that T-Mobile still isn't selling the G2X on the website speaks volumes about the phone.

I had a G2X, and at least I could browse the internet without my data hanging. Within five minutes of getting my G2x, I was also rooted w/ recovery installed.

With the phone off, press power and volume down at the same time. It will boot into hboot. At the top of that screen it will Eng S-off or S-on
I've been on the htc boat for a couple of years now and one things 4 shure, htc makes good phones, but it seems like they don't know how 2 listen 2 their customers. If they carry on acting and behaving in the future like they used 2 do, then the excistens of htc fades out. The whole idea of google and android is open source, that will say people like us are the developers and we can't develop and beeing be innovative if we don't have the tools to work with. Unlocked phones is a must.

How do I convince TMO to give me one?

I'm on my third G2x. I just can't take it anymore. At this point it's only partly the phone itself and partly my new disgust for LG as a company. I don't even want to use a working G2x if that day ever comes.
I've tried asking T-Mobile to switch out for a Sensation, and I'm usually pretty good at sweet talking these kind of deals, but all efforts have failed thus far. What's the fastest way anyone has gotten TMO to switch a G2x out for a Sensation? I hear a BBB complaint is fairly effective, but doesn't exactly seem to be very quick.

They're told me that if they swap out a device 3 times, that they'll be willing to swap for a newer device. If this is your third and you're still having problems you might be able to make it an easy argument. Just call and tell the truth. You went through 3 phones, and they're all messed up and since you paid with real money you want a real high end phone that works as advertised. Then boom, can I trade this for a Sensation for free? If they say no, then ask to speak to a manager.
not sure if the lemon law applies to phones but if you are on your third one, honestly, they should just swap it out for a different phone for you or give you your money back.
call and ask to CS rep. ask nicely. if you get the right CS rep, they'll most likely hook you up.

I've been told this by T-Mobile as well. After three exchanges of the same device (I think within 90 or 180 days?), you can talk to them about switching to a different device.
The thing that sucks is that not all if any care reps even know the situation with the G2X so they'll think your just full of it

I had 5 MT4G's and they sent me a G2X...
After about a week of it shutting off randomly and having to pull the battery out and put it back in to get it to turn on I asked if they would send me another phone.
Of course they wanted to send me another G2X. I asked for a Sensation... The CC rep said NO. I asked to talk to a manager and no go. She made me really mad and I told her to put me on the horn with customer retention so I could cancel my service and switch to Big Red.
I'm not under contract and they wanted me to just upgrade the line. After talking to customer retention. They credited my bill $80 and let me keep my week old G2X. I went to the store and bought a Sensation.
So... No Verizon. But I still have a brand new G2X for sale...
As most of you know from my post here about 6 weeks ago, T-mobile shipped me a Sensation for free and let me keep my G2X while still remaining off contract. If you would like to get all the information as to why t-mobile just ate the cost for the Sensation then your going to have to look through my history. The story is to ling and I've already told it too many times.

It's all about who you talk to. I had a similar issue with my previous phone, and after only one swap-out, the supervisor I talked to gave me no hastles and allowed me a full upgrade price on the Sensation. Your situation may merit a free device, but it depends on you getting the right person at the right time. Just be honest with them, let them know it's not their individual fault, and you're just exhausted from all the problems. Be sincere, and only get more authoratative if they completely refuse to help.

They are flat out lying because they gave me a free Sensation, let me keep my G2X and let me remain out of contract. Although I was a special case, they still have the power and can do so.

Supervisors might be able to but a REP cannot. Don't waste your or the REP's time, ask for a supervisor if you must and good luck.

Yes. I know supervisors can and since he said the supervisors he spoke to said they couldn't do it, I simply stated they were lying. I know their lying because one of them approved my G2X /Sensation debacle.

Don't forget they have rules and policies they have to follow too. Not a matter of just doing whatever they want. Every situation is unique.
Just an update.
I called and complained to another manager. I called and kept asking for supervisors until they said there was no one else, lol. No go. I also opened a BBB case against TMO stating my claim and that switching to a HTC Sensation would be a satisfactory resolution. Yesterday I got a call from "The Office of the President" to discuss my BBB complaint. They proceeded to tell me that TMO is only a "wireless service provider" and they take no responsibility for the (non)functionality of the phones themselves. After a long conversation of me calling them on their BS at every turn, he offered to refund me $40 they charged me to replace the G2X twice to begin with in return for considering it an acceptable resolution. I said hell no.
So I'm not sure how anyone else has gotten away with this, but apparently being a customer for 10 years and paying $200/mo isn't good enough for me to get the kind of courtesy they extend to other customers.
So the gingerbread update did not fix all the huge issues with the g2x?

Yea, I thought the update is supposed to make the g2x pretty solid...My GF just got one a week ago for free for adding a line (free all the way, no mail in rebates or activation fee).
Hers doesnt have GB on it though, how is that to go down?

Last time I tried to pull off a free G2X because I read someone on the forum was given one by a rep for being a long term customers and signing up for another 2yrs. I called Tmobile and demanded the same deal and the supervisor wouldn't let me have it. I told her 5 times that there has been people walking away with G2X at no cost for 2yr renew and bahabah to the point the supervisor demanded "my friends" number to look up the code that was inserted in their accounts..
My solution is to tell them about jrwingate6 and say my friend went through this same crap bahbahabah and in the end Tmobile gave him a sensation.. jrwingate6 will have to give you his number to make proof of that if he's willing to help you out and privately send his personal number to you. Once they see Jrwing was given a free sensation due to malfunctions G2X how can they deny you?
You know what dude times like this you should call corporate and demand to speak to the president or someone below with reasonable powers to help me out.
I return my G2X after using it for 29 days. It was lacking something and overall the experience wasn't satisfying to me I just didn't seem to be in love like my sensation. I hated the G2X!!
My GF G2x has zero problems so far. Its just as snappy as my Sensation. The camera is slow, but thats it! The battery is a million times better than my sensation!
Maybe the G2x has gotten better? Maybe you ought to ask for another G2x and see if something was fixed. I dont notice ANY of the problems listed, and I have a sensation to compare it too.

Brand New Mytouch 4g Slide for Sale!!!!

I have a brand new unopened unused Mytouch 4g slide for sale if anyone is interested. I had the original mytouch 4g and after so many warrenty replacments they told me I qualifyed for a free upgrade to a similer phone (go figure) . I don't like keybore phones so I just told em to send it to me with the hopes that I can sell it to someone and take the money and buy either a Sensation or the Amaze. How is this for a good deal. I went thru 4 warranty replacements on my G2 so they sent me a brand new MT4GS. My wife didnt even go thru 1 replacement and they sent her a brand new LG G2x to replace her Samsung Galaxy S 4G .

Yep.. So I went down to mobile today and ended up being sold on the amaze. Not a big fan of samsung build quality and apart from htc's quality control issues, they make great phones. Ive had the G2 and MT4G, and barly ever used my G2's keyboard (except when I wanted to show off the cool flip hinge). So now I definitely NEED to sell this MT4GS since droping over 5 bills on another phone! I was only planning on seeing if they could swap it out and give me credit but they said the ime on the phone was from another department and wouldnt allow a straight up swap. Damn tmobile politics!!!

Undead, how did you talk Tmo into sending you the MT4GS instead of another G2 on the 1 yr defective phone warranty?
My mom's gone through 5 HTC HD2s (because of defective), and they still haven't offered an HD7 or something of the sort at all.
Usually it needs to be 5 warranty replacements within a 90 day period. Go into a tmobile store and ask a representitive, they should be able to tell you. It HAS to be under warranty or you have to have insurence with the extended warranty service to qualify for upgrade replacement.

I would have posted in the market place but I didnt have enough posts with this XDA account. I had to use my old account I havent used since I made it because somehow I got locked out of my other one. My password stoped working and I no longer have the email that was associated with that particular account. Sorry about the post but it seemed to be the most logical solution.

i have a brand new unopened unused mytouch 4g slide for sale if anyone is interested. I had the original mytouch 4g and after so many warrenty replacments they told me i qualifyed for a free upgrade to a similer phone (go figure) . I don't like keybore phones so i just told em to send it to me with the hopes that i can sell it to someone and take the money and buy either a sensation or the amaze. When my upgrade eligibility with AT&T came up last spring I decided that I needed to familiarize myself with the Android operating system. Having been a long time iPhone user (iPhone, iPhone 3G and iPhone 4) with a mostly positive experience, I had always been frustrated by Apple's lack of Flash support and (at the time) their refusal to adjust their screen size. Little did I know that both Adobe and Apple were just "sitting in the corner" laughing at me when I came to this rationalization. Naturally, I overcompensated and went with the Galaxy Note, which, IMHO was probably not the best fit for an Android noob like myself. I did a little more research, and just on the outskirts of my 30 day return window, the HTC ONE XL was gonna debut. Bought it on launch day May 6th (before the embargo ruined the party). Like everyone else I had concerns over the lack of storage expansion from 16 Gigs - my previous iPhone 4 was 32 Gigs - but felt confident enough to pull the trigger since the 25 Gigs of free Dropbox space was on the table and according to AT&T was in play. Having been Grandfathered into AT&T's unlimited data plan and being a moderate user (I average 6-8 Gigs a month and have only been throttled twice) I felt as though I could transition to Cloud storage with ease.
I wanted to wait as long as possible before establishing my Dropbox account so I could get the maximum out of the 2 years. It wasn't until late September that I learned of AT&T purposely opting out of participating in the deal. I still can't fathom the rational for this, since its always been my understanding that not only AT&T, but all the Carriers had absolutely nothing to do with this promotion because the deal was between HTC and Dropbox. You would think the Carriers would welcome this since it would increase data usage, thus gaining them additional revenue. I'm sure that people, much smarter than myself, who contribute to the XDA forums, have the answer to this burning question since i'm clearly clueless.
Anyway, no worries, I'll just simply "Root", "Rom" and Voilà....Uh-Oh... As usual I'm a day late and a dollar short and I miss my window with the initial Root exploit that HTC closed ---- ( BTW this is in NO WAY meant as a backdoor insult or complaint to the Developers and their tirelessly Godlike work that they perpetually churn out on a daily basis, nor is it to the rest of the "awesomesauce" that describes the entire XDA Community!!!!) Now, I know in the back of my mind, there is an obvious workaround -- which I'm sure has been explained in this forum before - attach service to your previous phone for a day or so --- snag a WiFi connection and establish your Dropbox account and Boom instant 25 Gigs --then simply reattach service to your HOXL --- but ya know what....now I'm Pissed....time to call AT&T....
I started by calling sales not customer service too vent my complaint
1st Barrier ---- I get the initial non-decision making Dingbat ... As quickly as possible, I dispensed of this person and got a supervisor - I explained my issue and advised that AT&T did a "bait and switch" on me and strongly emphasized how ILLEGAL this practice is .....
2nd Barrier --- supervisor said he had no idea what I was talking about and that he had never heard of this "Dropbox freebie thing" (keep in mind I'm speaking with the sales department) --- this was easily refuted as I told the gentleman to try opening the box -- you know --the one with the AT&T logo on it that the HOXL comes in -- and to look at the paperwork inside --- it advertises the promotion!!!! Clearly his plausible deniability is out the window....
3rd Barrier --- "Can't help you because it's not our promotion..." No kidding -- that's the point..... I went on to explain how I was well aware that it wasn't their promotion and how it makes it worse because they purposely had to "opt out" --- emailed him the link to the Dropbox page explaining the promotion and How AT&T and VERIZON opted out (keep in mind the promotion is for any new HTC device running Sense 4.0 not just the HOXL) He continually stated that it wasn't their promotion for which I replied that I knew that and that it didn't matter whose promotion it was. I advised him, that I signed a contract with AT&T based on that information and that the Dropbox offer was used by AT&T as a selling tool to that end and that's why this is a bait and switch situation and that the practice is ILLEGAL
4th Barrier --- "How do we know that you were told about this offer and that our employees used this strategy...." I emailed him a link from androidcentral (Being that this is my very first post on the XDA forums protocol prevents me from posting the link that I sent ... but I can tell you that androidcentral was the original source for the "article" titled "AT&T HTC One X will have free Dropbox space, company spokeswoman affirms" and was dated Apr 24 2012) --- granted this is simply an unofficial "blog site" that can basically say anything they want but I advised him that this story was picked up by all the other major 'tech sites" and it has never been refuted by AT&T. In addition the "AT&T Spokeswomen" is Jackie Vettorino. Her official title is - Digital PR/Social Media Strategist for AT&T - She is basically their Top Dog when it comes to dealing with the press - She is widely known to many media outlets because of her role as the Point-man..er..Point-woman on "Throttlegate" last fall. I explained to him that because of her fairly high profile, it would be extremely remote that the story was fabricated or that she had somehow been grossly misquoted because of the likeliness of serious repercussions... but I did offer to three-way her office --- He declined. I also, again referred him to the materials that came in the box with my phone -- yes the Box -- the one produced and manufactured for AT&T with their logo splashed all over it.
5th Barrier --- "Did you purchase your phone and contract from a Corporate store or online through the official AT&T website ...." I told him that i didn't and that I used an "Authorized Retailer" (My friend works there and I wanted her to get the commission. To be honest, at the time I didn't know it wasn't a corporate store -- they only sell AT&T product and the only name mentioned inside or outside the building was the official AT&T logo all decked out in that crappy blue and orange - no offense to all you Miami Dolphin fans. It had been years since I had been in an AT&T store - all my recent dealings had been at an Apple store) He began to tell me that I would have to "take up this issue" with the store and that it was "out of his hands". I promptly asked him who my contract was with - He stated AT&T. I immediately repeated the question - he again correctly answered AT&T - I asked the question 3 additional times in succession and he scored a perfect 5 for 5. Finally, I asked him if he knew what the word "authorized" meant, as in "Authorized Retailer" and during my reading of this definition (straight from .merriam-webster.com) he interrupted me by resignedly asking me "what I wanted...."
Aah!!! ... Success. I went into this endeavor with the hopeful expectation that AT&T would credit my account the price of what I would have to pay for cloud storage for 2 years - It's soft money and almost always AT&T's go to when they screw up. Well after almost 90 minutes on the call, I quickly rethought my position and like any successful Rep will tell you "Ultimately, you always have to ask for it". I told the supervisor that there were 2 options:
1) AT&T could release me from my contract without penalty and refund my full purchase price for the phone...not something AT&T wants (nor did I ... again I stay because of my unlimited data plan) or....
2) Replace my HOXL with an equivalent phone that has expanded storage options at zero cost to me - of course we both knew that the only possible replacement was the Galaxy SIII
Without hesitating he asked me what color I wanted and to what address I wanted it shipped -- The phone arrived at my doorstep, Oct 2, precisely 27.5 hours from the time I ended the call. After 2 weeks and another lengthy call - this time to Customer Service - I was able to successfully argue that my contract start date should be reinstated to the original May 6th date and not the Oct 2nd citing that the SIII was not an upgrade but a replacement phone.
I created this Post not to boast or pat myself on the back, but rather as a template for other HOXL owners who may be feeling slighted by AT&T's consistently awful business practices. Hey, It doesn't have to be an SIII --- it may be a great way to offset HTC's poor decision of putting out a part deux a mere 6 months into release of their "flagship" X series. Why is it always the early adopters and loyal supporters who seem to get hosed ... but I gotta say the HOXL+ is looking mighty Dope. Although, I do question the decision of not going with a RAM increase, (can anyone confirm this?) While its not a huge hindrance, I do get a "load screen" every now and then. It just seems as though 1 Gig is really riding the line, at least with ICS 4.0.4.

No sympathy for them. First or third world. Corporations and governments take advantage of all of us in order to make another buck.

You know what else for-profit companies do? They pass their expenses down to their customers. They aren't going to eat the expense of giving out free phones like this. You're not "fighting the man". Its nice to think idealistically like that, but it really doesn't work that way. The cost gets handed down to us in the form of higher device costs, higher service costs, etc.
Their was likely no "defrauding of the public". Bonus offers like the one for Dropbox almost always come with a disclaimer that the terms of the offer can be changed at anytime, and without notice (including rescinding the offer itself). And AT&T opted out of the offer a long time before September. Just because a piece of paper has been sitting in the box since May, doesn't mean the offer is still valid.
If AT&T wanted to keep a customer happy, I can see letting him switch to another phone, if the One X is so "unacceptable" due to low storage. But it would have made the most business sense to demand the One X be returned. Otherwise its just motivation for people to game the system and get free phones.

No. XDA developers came into existence because we believe that if we bought a device, it's ours to reverse engineer or do whatever we want with it.
What you are doing is trying to game the system to get free stuff. It's SHAMEFUL.

Couldn't have said it better myself.
IMHO and no disrespect to the OP, after spending so much time talking to their customer service, I would have been very upset if ATT tries to compensate me with an S3, I would have preferred an HTC One X+, too bad is not available yet.
OP, I need to give you props for your effort. In your particular case, I think you did the absolute right thing in complaining to AT&T about the whole issue. You getting the S3 for free is just a bonus in my eyes. IMO, this isn't defrauding a company; it's a situation where the customer was promised something and wasn't delivered by the company and the company made things right.
Congrats on the phone. Although i prefer the one x, gs3 is easier to work with for roms.
I'm surprised AT&T finally gave in. I guess they realized you were persistent and it wasn't worth it.
P.S. 6-8GB isn't moderate use by any means. You're lucky to be on unlimited data.

You know I may try something similar to this. Although not talking about DropBox I genuinely thought that the HTC One X had 32GB of space (and it does). I didn't know the At&t version, or as I know now the HTC One Xl only had 16GB. And the thing is I remember asking the sales associate at Wal-Mart (which is also authorized reseller as you may know) "How much space does it have" and she said "32GBs". I was like yesss, because I have a bunch of music, take a lot of video and photos and of course fill up on apps. Now I have to constantly clear things up. And I didn't notice it only had 16GBs until my return period was up (I was too amazed at android and didn't really download many apps until later on, I switched from iOS ).
So what do you think my odds are at getting a device with 32GB?

Improper research before buying a device. And I wouldn't trust a Walmart employee to give me any correct information on phones, or an AT&T rep, for that matter. That part was clearly the Walmart employee's bad. But in the future, just do your own research. How hard would it have been to just read the box, before purchasing?
This is the exact reason that this thread is a poor precedence. Now people are trying to get free phones, for their own mistakes.

[Q] Need help, my phone died, HTC wants to rip me off

Hello, first of all I want to make it clear that my model is HTC One Mini (M4) and I'm posting here because I will get response faster, because m4 forums are pretty dead at the moment. My phone is three months old, so it roughly had like an year and nine months guarantee left. I had rooted my device and flashed CM11-nightly. Suddenly one morning the phone literally died in my hand with no reason at all. I have never dropped it, neither water damage it or something like that. I've tried everything to get it working again, with no luck. I've sent it to service through my carrier. They told me the phone will be sent to Germany (I guess HTC have service center there). I've waited almost a month and finally I got response. They told me that I've rooted and want me to pay 300$ for a new motherboard and I'm not gonna have any warranty left after paying. I've found few posts with almost identical problem, but people state that HTC fixed their devices for free. For me this is ridiculous - it is like getting a new laptop, installing some linux distro on it, because you just don't like WIndows (HTC Sense for my example) and then get billed for faulty hardware. I really can't afford these 300$ now and I have no guarantee that HTC's own hardware won't fault again and I will have to pay again. I really need an advice how to proceed. Should I try get my phone and try to send it to some other service center again and hoping for a miracle? Devices have their own specific fora for a reason, you might get faster advice, but it may be wrong.

If your gonna be charged $300 you have the right to know why and in DETAIL! I'm currently dealing with HTC with another hardware issue. And i've found them to be pretty lazy checking there phones. I've sent my phone in twice now for a faulty usb port. The first time they didn't even look at it and sent it back saying there was nothing wrong with it ...right. The point is they most likely didn't even test it and decided to put the blame on you because they can... As much as I like my phone I don't think i'd go HTC again. You want to get on to your version of trading standards.

Just recieved an email from the HTC repair centre regarding my phone repair, for my loose USB port, and I'm pissed!!!
In the email HTC has said that the loose USB port isn't covered by the warranty and they want to charge me to replace the main board?! £130!!! which I guess is near $300? Absolute bull! How can HTC charge me for USB port becoming loose after only 3 months? The phone should last the 2 years for which I am contracted! The USB/charger port should last the wear of time, or at least my contract!
Soon as I wake tomorrow I ringing them to tell them exactly this, and if they don't listen I'm going straight to Trading Standards. I'm not gonna let them cheat me on this. .....£130! £130???? seriously?!
I think this will be my first and last HTC phone EVER!
So I contacted HTC to find out why my warranty doesn't cover a faulty charger port, and they have told me because I have unlocked my bootloader my warranty won't cover a faulty charger port... I know it states this on the HTCDev site before you unlock your bootloader, but the bootloader is software while the fault on my phone is clearly hardware, and proving the phone is of poor quality build, which is something that would of occurred whether I was rooted or not. This is just an excuse to get out of repairing my poorly built HTC One mini, and proves without a doubt that HTC don't care about its consumers or the quality of the product they are selling.
I may be on a contract but I still end up paying around £400 over time to own this phone. For a device that costs this much the build quality and service should be satisfactory..
I had a heated conversation with HTC trying to explain that the fact I had unlocked my bootloader had nothing to do with the fault on my phone, but they just kept arguing that because I had unlocked the bootloader I was liable for the cost of all repairs no matter what was wrong with my £400 phone! This is just an excuse to get out of the fact that they have sold me a faulty product, and pure dis-concern for its consumers. They seem very happy to put out a poorly built device to the public and take our money.
Well I haven't given up, I won't accept that I should take responsibility for something that would of happened whether or not I had unlocked my bootloader, for which HTC shouldn't be able to take the right away for me to install custom software, as the device is my property, and as such should be able to do so.
After the heated phone call to HTC they have now got me waiting for a callback from the "HTC Escalation Team". And while I wait for that I have been in contact with "Trading Standards/Citizens Advice" here in the UK. They have told me that the responsibility lies with the seller of the phone in my case "MobilePhonesDirect.com" under the "Supply of Goods and Services Act 1982". So I contacted them and they also have denied that this is their responsibility, so I argued that they have to supply a product that meets the specification and description of what they advertise which it clearly doesn't, and as such they need to under the law "Repair, Replace like for like or Refund". I have now been passed onto their "Escalation Team", and am awaiting their response........
If I don't get anywhere with HTC or the seller, I'll be contacting "Trading Standards" once again. but in the mean time HTC have my £400 phone, which I have already been without for 2 weeks. This is all very sad and think I'll be moving back to Samsung in the near future....
Also EU laws that protect users who unlock their bootloader or root their phone, do not apply in the United Kingdom, as their laws overrule these EU rules, even though we're in the EU..... So a nice little loop hole for an uncaring company like HTC.....

Htc are completley outta order mate,yeah you've rooted but that doesn't cause a hardware fault like that...ridiculous that they are not honoring there warranty! its evident that there build quality isn't that great, thats why so many users (myself included) are noticing cracks etc . Im sorry to hear your troubles and i am seriously questioning htc as my next device also.

I just gave up. I've payed the money, because I can't stand staying without a smartphone anymore. Anyways, I'm never ever buying HTC or recommending it to anybody.
Small update. Called HTC again today after not receiving my callback. They had no record of a callback ...lies. Then they went on to tell me now that Im not covered under warranty because I have forced my usb port... Which I didn't. I argued how they could say that had done the damage myself and they could't answer. Instead they started quoting how I'm not covered because I unlocked the bootloader... Excuses excuses.
My phone seller has been back in touch telling me they can not find anything in their copy of the warranty to cancel my warranty based on software changes...
They asked me to get a copy of the repair report from HTC, but when I asked for this from HTC they refused to send the report until I paid for my phone to be returned or repaired ...I HAVE THE RIGHT TO HAVE ACCESS TO THESE DOCUMENTS!
When I argued my right to these documents I was told to I could take them to court! WTF !?
I asked for another callback to be arranged and a copy of their warranty that says why I won't be covered. He sent me a copy over email. BUT it doesn't say anything about not being covered for unlocking my bootloader. I then checked out htcdev.com again as directed by the man at HTC and again it doesn't say anything about voiding my entire warranty only that they won't cover things like your phone overheating from changing software, which has nothing to do with the charger port......
They want me to take them to court, so be it!

Its killing me not having my phone. Currently stuck using my old phone with gingerbread... But I won't let them cheat me! going on 3 weeks without my phone...
I know I am in the right! They hope I will give up. Never! They have enough of my money!
I am sick of dealing with their call centres reading from scripts like idiotic robots and will be writing to their HQ here in the UK.

Htc's customer service really sucks. I had to wait so long and you have to wait so long. I hate how they don't do anything about the one mini's plastic cracking. But I like sense more than anything else in android.
@RuffBuster In situations like these you need to remain calm, getting irate on the phone will do nothing to help resolve the situation. I've had a little personal experience with HTC Service Centers, HTC's warranty & my legal rights. Both with my Desire HD & One X.
The important things you need to remember are HTC are not liable. They did not sell you the goods, even HTC's own e-store is not managed by them. (http://shop.emea.htc.com/uk/p_htc_store_terms.aspx).
Your citing the wrong law, Your specific case would cite the "Sale of Goods Act 1979". As its the "good" that is concerned. - Source
Additionally Trading Standards will be unable to help, as HTC did not sell you the phone.
You need to pressure the seller that they are responsible. As its within 3 months of sale, they need to prove that the good was of satisfactory quality.
Your rights if an item is faulty
In the first six months from when you buy something, the onus is on the seller to prove it was of satisfactory quality when you received it.
If the seller simply says the problem must be due to something you've done, it's for them to prove that.
If something is not of satisfactory quality, you have a statutory right under the Sale of Goods Act, to a refund, have it replaced or repaired for free.

I had a similar issue with Phones4U and my Desire HD (faulty vibrate motor), if you cite the right law, they cannot push you about and ignore your legal rights, in the end I got a replacement from Phones4U not HTC.

I understand HTC are not "liable", like if you buy a bad apple you don't go to the grower, you go to the person who sold it to you. But HTC still have to provide a decent level of customer service, which they aren't, like withholding my repair report until I hand over the money. My seller needs this document before they will look further into my case.
Also still haven't received my 2nd 48 hour callback almost 3 days later, after not receiving the first one...
My phone is just over 6 months old now, but this shouldn't matter as the warranty is for 24 months, and a charger port shouldn't break before the end of the warranty from only charging and a few goes with my usb otg cable.
I am currently in contact with trading standards, htc and my phone seller to try and resolve this. Though HTC are the ones causing all the trouble...

So here's what's happened...
After phoning the HTC Repair Hotline a further 3 times asking for a callback each time, and not receiving one, I complained about the fact I had been waiting almost 3 weeks to hear back from them. I was finally given a callback from a HTC supervisor from the UK who apologized about the fact they hadn't called me back and that this was their fault, and because of this they offered to repair my phone free of charge, as a gesture of good will. But only because of the long waiting times I have suffered.
This is a WARNING to everyone on here. If you unlock your bootloader, and your phone develops a fault that requires the mainboard to be replaced, you WILL NOT be covered by your warranty! Unless you are very lucky and they don't notice you have. Your risk!
Personally I won't be rooting my phone anytime soon after this, which is a real shame because i'm a flashaholic. Just to make sure my phone is working as it should, with the quality issues I have seen and experienced...

I'm glad you finally got it sorted.
So I got my phone back, I've payed for reapairs. 2 days later my volume down button stops to work, phone boots only in safe mode, nothing helps. I unlocked bootloader and rooted, but haven't switched to rom, using original one. I really don't know what to do now. I hate HTC so much, I'm gonna throw up. Any ideas?
