Shame really, as its probably a hardware defect and they could replace the phone and I would be happy.

Wow. That was a pretty piss-poor response from the Expansys employee. I've had trouble with Expansys before but was going to buy through them again (the Touch Pro 2). I'm going to take my money elsewhere though now, pay a bit more, but at least get to deal with someone who doesn't have an attitude.

Indeed, very shocking and something I would never tolerate from a member of my teams or company. Here is my response, just in case they delete it:
"Thank you Yoni and Anita. For the record, I have spoken to your sales team, 3 times over the course of the week on the phone and 3 times via email - maybe now you can understand why I am so frustrated? I had the RMA form emailed to me and fully filled out by myself as early as Wednesday however, I was advised that I needed to wait for a response to this Forum post BEFORE an RMA number would be authorised - hence the 2 phone calls and 3 emails to chase this up. I question why its taken a week for this and also why i STILL have not received the RMA number?
BTW, for a period yesterday your main customer services number rang four times and then went dead - i tried this three tmes, with the same result.
Pete, your response is unprofessional and unwarranted. Volunteer, part time, full time or community service, when you respond with that red banner you are representing Expansys and all its employees. If you wish to be rude to a business customer who is clearly frustrated and has been let down by the support process you should first; ensure you are in full receipt of the facts, two; remember you are representing THE company and three be curteous - no matter how rude the customer is. A well trained customer services representative should never be sarcastic, pedantic or patronising. If I was an employee of Expansys who get there monthly rent paid by people like me (and my company) and I had read that response I would not be a happy on how you have spoken to a potential sales lead for many thousands over the next few months.
This clearly demonstrates why using untrained volunteers to help on a support forums is a very bad idea.

Btw, to anyone else reading this thats not a wana-be-lawyer company. I have now spoken with Expansys worldwide MD and I have a brand new unit in the post. The senior management team have now gone some way to restoring my confidence in Expansys.

It certainly clearly demonstrates why using the wrong mode of support for a device is a bad idea. As the guy on the forum told you, there was an RMA form on the site. Personally, I would have called for an RMA initially and I would have been calling customer services and not sales as you state you did. Before getting so wound up about it, why don't you take a step back and look at it from a logical point of view? How would a public forum be able to discuss individual faults? For anything that is specific to you such as a return, It's always going to be better to contact the company direct with a phone call or an email, a forum just isn't the place for that kind of thing and to be fair to the guy that snapped at you, you were taking a quite abrasive tone. Maybe you didn't intend it that way, but it certainly came out that way in text.
Ok .... first off why are you getting wound up unless you are PeteGraham?
second, I did phone sales and emailed "enliven". I was told to post on the TECHNICAL SUPPORT forums for them to confirm it was an issue.... note, its a TECHNICAL SUPPORT forum.... thats why i posted my "indivivual fault". I was told that until they said it was an RMA (by Yoni) then I could not return it, does that make it clear?
For your information the head of corporate sales has said to me, and these are quotes, "we dropped the ball on this" and "we made an utter mess of it" and "Roger (the MD) will be performing a complete review of the sales and support process" based on my email conversation and the evidence presented to him.
The sales line who messed up by telling me I needed to post on the forums, the guy on the forums (whether he likes it or not, DOES represent Exanpsys as he comes across in RED) and acted unprofessionaly and insultingly without first knowing ALL the facts.
Get wound up all you like (not sure why? You weren't involed in the drama) but Expansys have now appologised to me and as soon as the MD/Head of Corporate Sales were involved, very quickly replaced the unit - no questions asked. They have now gone a very long way to restoring my faith in them.

And btw, the person on the sales line also emailed me the RMA form at the same time but again told me to post first for an RMA number.
I've also informed them that the "If your goods arrive faulty or develop a fault within the first 10 days, you can return them to eXpansys for repair or replacement" is in breach of the Sales Of Goods Act here in the UK and they are breaking the law - note, this instruction is applied to both consumers and corporate customers.
So, like the guy on the Expansys forums, maybe you should be in full receipt of the facts before posting (oh.... and read the Expansys FAQ for a start!)

About a month ago (Jan 20 I seem to recall) T-Mobile had an offer where you could get a free upgrade to a G2, only on their website.
My family had three G1s on our plan that were past due for an upgrade, since December, so we jumped at this offer.
We couldn't get the site to work, however, so we called in and a representative assured us that we would be able to get the three phones for free. We would have to call back the next day to do so, though.
After calling back the next day, we received another representative who told us that the offer was an error and shouldn't have been put online. Our response was simple- That's your problem, we agreed with the other representative in good faith and we should not have to pay for an error on your end.
After waiting about a week for that other representative to look at the call logs (which he never found, by the way), he called back and told us that since we've been waiting for so long and he never found the logs, we could have all three phones for free. We already knew there was an upgrade fee of $18 that we would have to pay, that's fine.
Now, a month later, on our bill we have three charges of "One Time charge for Handset Upgrade Revenue" that amount to $199.00 each. That makes our total bill for this month a whopping $1000.
This is far from "free" that we were promised. I am hoping it's a mistake on their end, but if I call them up and they start throwing in all of these excuses and explanations for why a "free" phone isn't free, is there some sort of agency for Customer Fair Treatment or something that we can report them to, or is there legal action that we can take?
Please, if you have any other advice or tips, it is greatly welcomed.

Sorry to hear about this. I've had a few issues with tmobile in the past 5 years i've been a customer, they've always been pretty good about resolving things to my satisfaction. I'd suggest a few things:
-If you have a twitter account, tweet something about your problem to @tmobile. It might not sound like much, but tmobile has some very active people working on twitter. When i had an issue around a year ago with my minutes and texts vanishing without being used, a tweet was really all it took to get the ball rolling. I got a direct message back within an hour, and recived a call the next day to let me know the glitch was fixed and offered me compensation.
-The Consumeris (consumerist.com) is a consumer advocacy blog. I've seen lots of stories on there similar to what you're dealing with (many from other providers too). From the stories i've read companies such as tmobile pay close enough attention to the site, and are quick to resolve any kind of issues that could result in bad press.
-If all else fails, last i checked tmobile offers a buyers remorse period of 30 days (might be less), if you arent happy with your phone for any reason, you can return it within that time.
I'd reccomend calling them and telling them if the issue can not be fixed you would like to return the phones. Another thing to maybe metion, if you where up for new phones, then your contract must have also been renewed, perhaps this could be considered a breach of contract on their part and you could mention that in a way that suggests you're thinking of ditching your contract over this (just say something like "verizon has the same deal in store").

Honestly, if they can't fix the issue, tell them you want to be transfered to the loyalty department because you want to cancel. Those guys can fix anything. If you still aren't happy, file a claim with the better business bureau.

File complaints with both the BBB and FCC. I had an issue with Sprint not honoring a discount coupon I used when I signed up and kept getting the runaround, but a BBB and FCC complaint led to someone higher up to contact me and get the matter resolved. Based on some google searching, it does appear T-Mobile responds to FCC complaints.

Interesting... I don't think the buyers' remorse thing would work, cause we have had the phones for over 30 days... and offering to give them back would be bad on our end because honestly, we love these new phones!
But yeah, the breach of contract you mentioned is a good point. We renewed our contracts so that we could get these phones, and if they take the phones back yet keep us locked in contract, I'm certain that the groups mentioned by the other posts (BBB and FCC) could help us out.

Thank you very much. I hope either or both of these can help if the situation turns into something nasty.
I have to harass them to make sure they apply discounts or whatever, and they tried to wiggle out of my student discount when I activated my line...
Ah well. They're almost half the price of Verizon and my service is pretty good here.
We just called T-Mobile and a representative confirmed it was a mistake and dropped the charges.
We still have to wait until the next billing cycle to see for sure, but I think this has been resolved.

Reseller ratings, unfortunately, is not a good sample to seek accurate reviews from. 9 times out of 10 customers only use this site to leave negative comments. While only 2% of all orders actually leave reviews to begin with.

Ordered 2 HTC Butterfly and they were cancelled without explanation
Last week I bought 2 HTC Butterfly, from Negri Electronics. At first, the site wouldn´t let me buy 2, so I bought just one for $ 779.50.
I came back the nex day for the other one that I needed, and saw that the price had gone up to $ 818. I really needed these phones so I bought it anyways. A few days later, I get a refund notice from the 2 sites I used to pay for my purchase, Paypal and Amazon, and no email, no explanation whatsoever from Negri. There is something very fishy about this company, I´¨ve been researching online and found several complaints about them.
The phones I purchased and were cancelled without any reason are listed as IN STOCK on their web site, if I were you I would stay away from these people, just my 2 cents.

Very sorry to hear about your issue. Did you ask anyone at NegriCare about these issues before posting on this board? Often times asking a customer care representative you are able to get an answer so your post on this board is complete. Instead it just leaves others in the dark thinking that we did something deceitful.
If you have an order number, you can contact [email protected] and you can check on the status. Here are some possibly reasons it was canceled.
1. You paid with Google or Amazon and the order was considered "fraud" and it was canceled. At this point no email is sent from our behalf.
2. You paid with PayPal for a color BLACK Butterfly, which is not released. At this point the order would be canceled after 30 days automatically. We do not have the option to extend that.
3. The order was canceled because you sent an email to request just this. In this case your order would have been canceled and no email would be sent.
These are all possibly scenarios. There isn't anything "fishy" about canceled orders. In fact, it happens alot. The screening process is quite involved and out of our control. Often times the customer would be furious with us when we didn't do anything. This is why it's best to contact the company prior to venting on message boards as it might not have been under our control.
Please contact us at your earliest convenience. It's never nice to be called "fishy" and we would like to make sure that you don't have that opinion of us any longer.

You will always find complaints if you look hard enough. We just hope that you are able to see past the petty issues that a few customers had and focus on the great experiences others have had - and posted about.

I had a misfortune to buy a defective phone from this web-store. After the return, multiple emails, delays, unreasonable and unfair offers, they have finally suggested a partial refund which I agreed to just to be ignored once again. Today, 7 months since return, our dispute is still not settled. I wouldn't call that trustworthy.
Something has happened to them. Their "contact' page is missing. and my replies to my existing email chain are unanswered for 3 weeks.

I personally would keep away from Chinese phones, generally because they tend to not have any support afterwards. I looked through this site and however designed/presented nicely, the reviews are mostly of customers asking questions about the product. They seem to respond back though so that may be a good sign (even though they're using the reviews section as a forum, which is deceiving). Sorry for not exactly answering your question, but that's just my 2cents.

you are probably right about support ,sadly not so many own those phones. actually i am buying that kind of phone, because in last half year i lost two phones (they were both stolen by somebody). now i do not want to spend much money on a new phone.
including taxes and DHL shippinig i can get a full hd phone for approximately 220€ (about 290$), and that is why i am interested in buying China phone.
i will have to think a bit and search the internet, whether it is worth buying cheap phone and hooping for best, or spend at least twice as much money for Nexus 4, Sony Xperia Z, or other flagship devices.

I use dx.com for my China gadget shopping. They are trustworthy and have a decent support staff as well as forums. They accept paypal. The only downside is sometimes the shipping can be slow but anything shipping from Hong Kong is generally slow. They have name brand Android phones as well.

I think i can tell you something, I think there must something made you misunderstanding, i made two orders in chinapadmall.com, they response very fast and reply my every email and live chat, maybe the email sent to your junk box? it seem the live chat time from China time 9:00~18:00, you can try to see and try again. and even over 45 days, they accept return and refund, don't worry. one of my friend experienced it. it is better you tell him your order number first, so they can confirm soon. when refund the money, you must will get a coupon as a compensation( my friend got the coupon, hope the same as you).
and by the way, if they didn't answer you, how did you sent back the phone? where you got the return address?
hope your problem will be fix soon....

address gave me Jerry or so chatting calls himself. So far I have sent the phone or returned the money. On Friday Jerry said the chat today I would give the tracking number, but I ask you and I closed the conversation. No I think I have been scammed, and the address to which returned the phone was not the same that came in the package where they sent me the phone. ie they send from an address and returns go to another company and another direction, even in another city. All this is very rare and worst is that after almost 3 months I am still without my money and no mobile. SO I would not buy ANYTHING IN CHINAPADMALL. COM

I think I know where is the problem, the problem is not CHINAPADMALL.COM didn't answer your questions, it seem you returned the phone to the wrong address ( wrote in the package?).
if you purchased the phone via paypal in the store, it is better you follow the refund and return rules of paypal. you should dispute in paypal and ask for return and refund, paypal will show you the address that you should send to. remember never do not send to the address wrote in package. if over 45days, it is better you contact their after service for address before you sending. as I know, many package sent from China the address wrote on package are address of POST AGENT COMPANY, not the real seller, because the agent handle all for seller, seller only need prepare the package for picking up.
i suggest you keep contact CHINAPADMALL.COM , tell him the tracking info, ask him for help for find the package. if sent to the POST AGENT, they also can have it back, but will take many times, it is possible to get your money back, CHINAPADMALL.COM wont let you lost money, as I know my friend got money back and got a coupon for compensation and he made a new order with the coupon( 8USD discount for any item).

PS: I should have some form of official or judicial claim a refund of my money or sending mobile. I have no problem with china mobile. Nice power for third price of regular brands with good workshop quality. Only problem is support...
.My phone I received from om them was faulty and they have asked me to return it to them. I have done by DHL but it seems to be being held in customs in Shenzhen. Is it legal to return a phone from UK to Shenzhen? Why would customs hold it?
Perhaps it just takes some time for clearance?

Re the above apparently the seller has apologized on facebook for copying some webpages so I guess thats ok then, if you say sorry then your not guilty of copyright infringement, But tell me this if they are genuine, why, after spending enormous amounts on their stock over 600 items, all apparently in stock, yet they skimp on their website and pinch other sites copyright material?
How have they come by all this stock?? the bigger established sites seem to have problems getting stocks of the Jiayu S3 3Gb version, but apparently they still hve stocks and still sending them out, and at an amazing price too, and by the way its not just this forum involved theres a couple more HERE and Here from Russia and Poland and I'm sure their are many more around the world where forum users have ordered from this site, and do you know why?? because if you google 'club1941 review' see which result comes at the top of the pile.
XDA is probably the most well known site of its kind in the world it is trusted and has an excellent reputation, and I will wager that many people have seen that review and taken it as gospel, I don't doubt the reviewer's honesty and the review of the phone seems unbiased and detailed, however the glowing review he gives of the website, without any knowledge of their history and integrity I believed has caused many to order from this site, how many of you ordered from club1941 before you saw that members posts on here? and that reviewer has admitted he received payment for that review in the form of a refund of his payment for the Jiayu S3 3 gb that he purchased from clu1941.
I realise that I'm probably p**sing into the wind and most of you will just wait and see what comes in the post, and more will probably order, tempted by the unrealistic prices, as I was.
And I wouldnt be at all surprised if the first few packages to arrive are genuine, that's not unheard of.
I'm not an expert on paypal and their ways, so if you have any queries paypal related please ring them up and ask advice if you go to the contact page in your paypal account there is a free phone number there, that's in the uk anyway.
Some of you probably think I have a chip on my shoulder regarding this site, and you're probably right, I dont like people who try to steal from me, or anybody else, and I'm old enough and ugly enough not to care what people think.

Yeah. Something is flying for sure an that something may be many,many things.
Seems like they do ship the items.
Judging from the tracking number most likely it's from Singapore.

Making refund when there is clear proof that something is already sent sounds to me like pure confession of a scam by the seller?

Why would the buyer open a dispute after he received a tracking number if the buyer isn't trying to scam the shop?
Have you ever tried going through the Paypal dispute process as a seller? It's a long and painfully drawn out process. The whole thing is completely biased towards buyers. If it was a proper and fair system theres no way oscarblue48 should have been able to open up a dispute after the tracking number was provided. This gives the seller a chance to actually send the goods, and the buyer to assess the goods before any action is taking.
Obviously these guys are new so maybe the shipping guys didn't notify the ordering guys. Hopefully they pick up the error soon enough and oscarblue48 doesn't end up scamming the shop.

Seller had number of days to reply his dispute..they didn't do it, they didn't wait, they refunded immidiatelly as they do not care about the "picture" of Jiayu coming @oscarblue48 way. Picture with proper SG track.

This one was specifically made to discuss how legit or not legit club1941 is. Also I don't find the price surprising since the official price from Jiayu's weibo account is 899 CNY for Basic and 999 CNY for Advanced http://www.weibo.com/jiayuyt, which would be just under $160 USD for the Advanced
