I don't think I am firmly grasping the concept of what wares is because I received an infraction for posting wares, when it clearly was not!
I have been pm'ing a senior moderator and he feels other wise. Moderator stated that the link I posted was in fact warez. It was a link for PlayStation 1 roms at freeroms.com.
All roms are free, and thats a fact! You can go to emupatadise.me and get free roms. just like all of the other roms sites.
So, can someone explain how this was wares?

You're getting something for free, where the company SELLS the stuff.
Lets take the mupen64(N64) emulator for example. In the market, it states, "THIS APP DOES NOT COME WITH ROMS. 99¢ IS FOR DONATIONS ONLY. This app is free to download on my website(I left the link out)." No royalties are going to Nintendo. Who are the makers and founders of the "Nintendo" 64. Its open source. As well as the roms/iso's. As long as you own the game(s), it is not illegal.
So would these emulators in the market that are not kicking back royalties to the makers be considered piracy? No sir.

You realize though, by giving away those ROMs you're taking money that nintendo could of had by people buying them.
It's illegal to download ROMs unless you have a physical copy of the game.

On XDA there is a set of rules that state no wares or piracy material should be posted, linked to or mentioned so that no one is insulted, sued or damaged in any way. Your post was neglected from XDA because it COULD lead to piracy. A ROM file is clearly a copy of an original product that was at one point in time sold and profited from by the producer, but since these files are available freely then they can be downloaded by anyone with internet access and therefore if Joe Blow happens to Google "rom Nintendo 64 game blah blah blah" then XDA can pop up as a result and your post shows up. All this connects XDA with the downloading of ROM images that can be illegal depending on the person downloading such file. So my point is, it doesn't matter if its illegal or not to post a link, it matter if the outcome of posting that link on this forum (were technically we are already going against some sort of guideline aka: custom ROMS, hacks ect.) will inflict on the equilibrium of such. Your post was not harmful, but really who owns a hardware copy of every Nintendo or Playstation game that is available for download on those sites?

All of these phone ROMs and hacks are open source and as long as you respect the GPL and provide the source you used you are not breaking any guidelines.
But yes, emulator ROMs are not allowed here.

First of all I create that guide, hundreds of people have used it, and I highly doubt anyone clicked on a ADVERTISEMENT and thought it was the actual guide. The links are below that. The ad is something that I have no control over. Almost all hosting websites have those malware ads.
If you read the thread you would know it's in pdf format. First mistake, not reading. Second mistake is to blame xda for your first. Then you didn't read the page you took the shot of. Chose a site to download from.

The particular deception in play here is very easy to fall for.
That's your mistake #1: to think that anyone but the most advanced user is able to figure out that the file should be an unwrapped PDF file or whatever. There is no mention in the post that the file is in PDF format. The thread has 132 contributions, yeah, average Joe has to read 'em all, right? (And yes the second mentions that there's a pdf file involved but not whether it is embedded in some archive or what do I know).

That's funny. For someone so inclined to feel the need to 'warn' others about download sites, you sure dont know the first thing about browsing the internet do ya? This magical 'malware' link you see is only seen when you arent using a proper browser or taking advantage of adblocking.... thats YOUR mistake, dont blame xda. Well well well we just found out all your data is going to an Amazon server if you updated to the new 2.3.4 EVO and Sensation users. How long you use an app, What app you are using, The fact that you are rooted, the location you are using it from etc etc (without QIC) is being uploaded to an Amazon server un-encrypted. How's that for security? However thanks to Synergy team developer TrevE users of Synergy and the upcoming Eternity ROM from Virus will be secure against this obvious infringement of your privacy. What is HTC up to? And furthermore what other manufacturers are using similar methods? One thing Trev pointed out was your warranty can be voided immediately. They know you are rooted! The repercussions of this are astounding and frankly I am proud to be breaking this story with all of the work I have done here recently speaking out when I find are data being wrongly horded and used in nefarious ways. Kudos to TrevE and Virus for showing me this and helping the community find a way to put a stop to it. OK, I'm calling BS, or at the very least calling it inaccurate. If you look up those IPs, they belong to amazonaws.com. If you look this up, you get Amazon Web Services. It's basically a bunch of cloud/database services they offer, for people and other companies to utilize. So while it may go to an Amazon server, it is most likely not actually going to Amazon. It is still just HTC, nothing different, just a different server. Also, WHO THE HELL CARES? It's not like it is constantly sending this data all the time. In fact, I'd be willing to bet this only gets sent when you actually submit one of those 'Tell HTC' forms that show up sometimes.

I don't necessarily believe it either but I wonder if you guys even clicked on the link because there's actually a bunch of source there, and explanations of what happens when you delete certain files that are harvesting info, and the source code that was used to "defeat" the info harvesting behaviors. I think this is interesting at the very least, if not true even if it was definitely presented in a sensational way.
I don't particularly care WHERE the data is going, I want to know WHY it's being collected in the first place, especially if it is not vital to the functioning of our mobile devices, which it seems pretty clear to all of us, it isn't. Even if YOU don't care about your info and data being harvested by google, some of us do and many of us find it very disconcerting.
Also, a guy with 14 posts trolling and asking where "XDA is heading" am I the only one that appreciates how ridiculous that is?

Are you sure about that? I know reverse engineering a patented device in attempts to alter or improve it, even for one's own personal use, is illegal..found that out while modding xboxes, They even made ebay monitor xbox listings and any xbox that was REMOTELY hinted at being modded was pulled down..I even saw closed auctions get force-refunded and users banned! would that not apply to windows phones with modded roms etc? Publishing the stock roms from devices like WP7 phones (Microsoft after all is not open source like Google, and they tend to care about security and patents more), that wouldn't get someone at some alphabet agency who didn't know the ins and outs of the community to jump to conclusions?
I would hope they wouldn't, but I think a vague assurance that there is 'nothing illegal' here is a little light on legal defense..

They can't shut xda down because the roms are open source and so leaked or not are still legal, the mods always terminate threads about anything illegal.
If illegal data were on xda the law in most countries is that xda would be asked to remove that content as has happened on other sites and given that xda are not into piracy they would likely remove said content.

Modiified xboxes are illegal because they facilitate piracy, xda do not reverse engineer patented or closed source devices or systems only open source.
Regarding android roms or links the os is open source, it is not illegal to have even a leaked open source rom.

I hope that you will stay because you do great job for all of us!
Simple answer is that if the OEMs wanted to push it then they could make us remove all links to custom OEM based roms. Modding parts of these roms do violate copyright rules. Only pure AOSP roms would be allowed. But as we don't host anything here they have let us work. This is the reason No roms are hosted on XDA.
Long has XDA worked with OEMs if they ask then we pull. Make no mistake they know full well what is done here.
Don't know what happened... but my alert was put into Q&A even though it's not a question.
Sorry, for the cross-posting... but this issue is very important to all of us who care about rooting/modifying our devices. We may soon lose the legal exemption to do that.

Another thing that could happen is that there could be an Agency regulation that specifically prohibits rooting. However for that to happen, they have to authority to be able to enforce it.
As long as you are not reverse engineering, you are not breaking any U.S. law. This exemption that is expiring only clarified a defense to a law that does not exist, meaning that we specifically stated that rooting was not a crime, while there was no law stating that modification was a crime. It is a very vague, legal gray area. It's a lot like gun laws- things are not settled until they are tried in court.
So hopefully it gets renewed.

But, according to EFF: Some device manufacturers claim that jailbreaking violates Section 1201 of the Digital Millennium Copyright Act (DMCA), which carries stiff penalties.there is already such a law. Granted, there has not been a court case, yet, testing that law. But it is on the books.

Well, you may wish to read, specifically, about Section 1201 of the DMCA. It is false comfort to think that a law does not exist... it does exist. The wikipedia article on the DMCA has a good discussion. If you are more of a legal geek, then the government provides congressional report 105-796 and a summary on the internet. For information on how institutions of learning can be affected, EDUCAUSE addresses the issue on its site.

A bull****, nothing more. It is my property and I do with it what I want. They can only affect my warrenty. They can only do something if its a carrier branded and you don't buy for full price . Then device is still a carrier property

This country is already broke (not only financially, but also morally -- but that's an entirely different discussion), how will they go about actually enforcing this law? I know that phone companies can gather a lot of information about your phone remotely, but can they tell whether your phone is rooted or not?

They can claim all they want. It's important for everyone to know that if it comes to that, there is no specific law addressing this, only claims under the DMCA.
In my legal opinion, root privileges can hardly be misconstrued as copyright infringement. It's mainly Macintosh that is pushing this though- they claim that jailbreaking is illegal because of the close-source nature of their products (It's also ironic to note that many of the working conditions of their factories would be considered illegal in every country that they sell their products in).
Well macintosh and... recently, ASUS, right? and one other... last summer, but I can't recall who right now.
Let's just say... for sake of argument that carriers sign agreements with manufacturerers (when, in fact, they're different companies)... that require them to deny service to "rooted" devices based on the law... or maybe not the law... but their collective interpretation of the law...

You do realize that google gave us source, and samsung gave us source, and they both stated that "THIS CAN BE USED FOR "ENRICHMENT" OF YOUR PHONE" google android is 100% free. Even if it expired, it wouldn't effect us. Whoever the fool that initially stated that rooting will go away is false.

We might not be talking apples to apples...
I know apple has fought their phones being jail broken. But isn't it the carriers who really have the problem with it? They want to make you buy their network specific phone from them?
They can only put this law if there is one only on devices which are carrier branded. On unlocked or unbramded devices they can't do the ****. It is in my proparty and take you hand of from it, I can do with my device what I want

I'm not saying I agree with the tactics that were used here (though this whole issue is none of my business), but with the amount of traffic that website generates, advertising revenues alone COULD be well over $10,000 a month. This means the value of the domain is much more than $10,000. Now whether they do make advertising deals or not, is not the point. All I'm saying is people buy domain names all the time for the sole purpose of selling them for profit, so just because we don't like his tactics doesn't mean he was necessarily wrong. He did buy the domain three years ago and whether we like it or not he can sell it if he wants. With all that being said I'm glad to see he's decided to go through with giving control directly to cyanogen himself. Now, all the people that were directly involved in this incident have moved on and accepted the outcome. Why can't we do that as well?
