Patent will be disallowed, apple will patent it later and sue google. Pretty sure with apples money and "luck" that's what will happen.

People don't seem to understand a lot of the phone company litigation (despite Apple being the clear market leader on spurious litigation) is tit for tat, and it was that way in mobile phone manufacture before Apple came along.
In many cases both (or even more ) companies all use patent infringement against each other as nothing more than a leverage tool. Bit like a wild west card game where everyone has sawed off gauge under the table.
What often happens is ........ essentially nothing, the lawyers get rich and the marketing depts screech about stolen tech (often tech that was developed by other companies ages ago), but behind the scenes everyone agrees to allow use of their stolen tech.
Sounds bonkers but it happens a lot, think companies litigate to see if any competitor will blink, But its like a card game .... everyone has a hand and the result is often a classic Mexican stand-off.
This seems like one of the main reasons Google acquired Motorola (in case you where wondering) Google with Motorola's old patents is a PROPER mobile phone contender (Google has its own gun under the table now mofos), without the patents they would have been very vulnerable to the court room battle tactic, now they can just play the same game.
As litigate and counter litigation can actually stop phone manufacture and sales for everyone involved as manufactures can be legally forced to halt sales or production .... if everyone involved fires a suite at the others ........ everyone gets shut down ...... so you see there is a perverse self interest in everyone eventually agreeing to carry on as before the litigation.
I know it sounds nuts, yes they do spent millions on these cases, often to achieve nothing but the same equilibrium that existed before the court case.

Can Google really do anything against apple since android is open source? I'd love to see apple get a taste of their own medicine.

to be honest this whole patent fight b/w the two is getting a little redic. The Apple v. Samsung dispute that includes apples slide unlock is absolutely absurd to begin with. Apple filed for that patent AFTER another phone manufacturer had already had a device out using it. Which was the basis for one judge dismissing the patent all together. Fact that its gotten through others is comical to me...

I saw this in another forum and thought I would also share it here in the Sensation Forum.
Well I'm not a Apple or MS fan, but Apple is throwing all it's punches towards Android it seems. Just shows how much of a impact Android has had on them and will have in the future.

Apple is just full of crap.
This will blow over, it wont have a huge impact, they wont be able to sue much for damages even if HTC did loose. Android is open source, they will either find a loop hole or just work around it for future releases. No worries here.

I like to see Apple suing more OEMs so they will gang up on Apple and sue back togather in revenge, and if at the end of the day HTC loses and got banned from selling Android devices in the US market, American consumers will probably be stuck with smuggled products.

Hmm.....IIRC,international patents last 17 years.
Two years of appeals....
I suspect that in the end,Apple will get theirs.
The sad part is that I don't dislike Apple,they just don't impress me.
It was only judge who ruled in Apple's favor. It's still going to be reviewed by the whole panel of judges. This isn't even close to a "victory" for Apple. Yet.

It really sucks they lost out on the Nortel patents. It would have helped a lot. But honestly, this patent trolling has to stop. It's getting ridiculous now.
The only reason why android is getting all these random lawsuits is because its a threat.. Apple never cared before Google bought android. YES android existed before the G1 from Google, Google bought android out and took it to new levels, which we all thank lol.. The big players do this all the time, Apple Vs Microsoft, Apple Vs. Samsung, Apple Vs. Android... Well microsoft owns part of Apple's stocks, and vise-versa, its a way to move money around without being blunt obvious..

Even if HTC loses, it won't really change anything except their profit margin. They'll end up paying Apple something per handset for use of their intellectual property but won't have to redesign the handsets. But now that they own patents that Apple's theoretically infringing on the whole thing could be a draw anyway.

Steve Jobs fostered this sort of thinking by Apple back in the garage days, and although they have found ways over the years to manipulate their groupthink disciples and the non-techie commonman into believing that they have changed, it's never really been any different. Small wonder, since Microsoft and Apple basically created each other, and forged their own business personas together... an endless game of backstabbing between two foul companies, whilst at the same time they attempt to destroy anyone else in the middle.
Companies like Microsoft and Apple make me wish that anti-trust investigations were more centered around *groups* of corporations, rather than simply individual ones. A lot more of the real dirt going on in the tech markets would maybe get scrubbed off of the floor, so to speak

Apple Sues Again

Well, sadly, in another thread regarding the shipment delays I made the poor mistake of defending Apple and claiming the shipments being held by the ITC was likely a routine screening and not being held up because of Apple.
Turns out, I was wrong. Apple has filed a formal grievance with the US ITC today saying that HTC hasn't actually resolved the software issues and should meet as an emergency and re-enact the ban blocking imports of HTC phones.

This is just more over-aggressive bull**** lawsuits for no reason. HTC is in no position to even directly compete against Apple in the market, and ultimately is doing some of the most unique software and hardware design in the industry.
At what point does this whole mobile lawsuit nonsense come to a boiling point?
Also, as a point of full disclosure, and because I don't really want to ***** about Apple being the worst company on earth, I do own use and love my iPad, Macbook Air, and iMac. I do own an iPhone 4S but as of recently it sits off in a drawer while I use my HOX.
This thread was not started with the intention of people piling in to say how Apple is terrible, or builds ****ty products, but rather have a conversation about the challenges of the mobile industry moving forward. As each company tries to innovate and release compelling products the likelihood of overlapping features and functionality is inevitable. How does the industry encourage innovate without trampling intellectual property rights? (or in other words, **** Software Patents)

What gets me is how many of these patent disputes are actually FRAND (fair use) issues.
I'm waiting for some judge to put down his iPhone and see things clearly. Patent law is out of control and companies are only using it to maintain a monopoly or remain profitable to their stockholders when their product is actually no longer inovative and has lost market share (see also TiVo)

Power users choose android and the rest use iOS their lawsuits won't convert anybody. They're always suing somebody haha. Samsung, HTC, might as well sue Google and the rest of the world.

This has little to do with rightfully protecting intellectual property, and everything to do with patent trolling and using the law to attack competitors.
Android has gobbled up market share due to the fact that manufacturer are willing to give people variety and choices. Meanwhile, Apple is trying to lock everyone into one device form factor.
This also more represents Apple's failure to innovate, rather than the opposite. The iPhone has hardly changed its looks after 5 iterations. Aside from different backing material, it has looked almost exactly the same. And few internal hardware innovations as well. Aside from moving to a better screen, and a better camera, the hardware has only had incremental improvements (CPU and memory) over its entire lifespan.
The one form factor business model has benefited them in many ways, but we've come to a point where people now want bigger screens on their smartphones. Apple has simply run out of new ideas in the present form factor. Their biggest recent innovation. . . Siri (chuckle). They are stuck and they know it. If they move to a larger iPhone (and also a smaller iPad, or "iPad Mini" as its rumored) they begin to experience some of the OS fragmentation that they have criticized Android for so many times in the past.
I don't mean to complain about Apple so much, or sound like a hater. They make some nice devices, and have contributed some nice interface design to the smartphone world (earlier in the iPhones history). But its clear that they have stopped innovating. Instead of coming up with new ideas, they have chosen to use petty methods of attacking their competitors.

It was the first Mac (or Macintosh back then) not iMac and the year was 1984. It played during the Superbowl. The irony is that 1984 (spelled out) is a book by George Orwell which was published in 1949 that dealt with a society under total government control. Apple's claim during the Macintosh commercial was that they were going to show the world how 1984 (the year) was not going to be like 1984 (the book). Apple has become the antithesis of what it proclaimed back in 1984.
I really tend to agree. While no one can argue that iOS and the iPhone were amazing innovations, and helped spur the mobile industry as it stands now, iOS has really stagnated on innovate.
There haven't been amazing new features / innovations to the platform in awhile and it seems Apple cares more about others not doing what they have done in the past then focus on what they can do in the future.
I think everyday there are more examples of software design that should be open and licensed rather than closed IP. Things like "pull to refresh" and "pinch to zoom" are functionalities that exist in natural user interface and simple should be able to freely licensed to all software developers.
If Apple approached HTC and simply said pay $X dollars per device to have open cross licensing with Apple's software licenses this whole bull**** could be put to bed in a legal manor.
I just feel like software patents are going to be increasingly difficult to develop and protect and that these major players in the market need to understand there will be functionality overlaps. As such I want to see this bull**** end and cross-licensing begin.

That is rational. Apple has no interest in negotiating nor being rational. They are the highest valued company in the world. They have no intention of licensing IP. They have so much cash that they don't know what to do with it and there is no sign of their revenue stream stopping any time soon, so they don't need the money. This is just a pissing match at this point. Apple's intention is total "Thermo-Nuclear-War" annihilation of Android. Things might start to get a bit different now that Steve Jobs is not around...but perhaps it is too soon. Not that I agree with Apple.
I just think patent reform is needed. Competition is good though. In some ways I think Apple has helped HTC. Now HTC has notoriety. Everyone I've recently showed my One X to asks to hold it, and then while holding it they are wowed and act as if they are handling a rare illegal piece of contraband. This HTC One X is now notorious. So even though sales were stopped because of customs I think more people now know what HTC is and that it represents a credible threat to Apple. People will want what they are told that they can't have....human nature.
This is why i got away from apple products not going to support their lawsuits... im tired of hearing this stuff but of course its not going to stop...
Instead of innovating they use wide spread patents to squash competition.
It's not just a problem in the phone industry, patents are way too wide sweeping, long lasting, and powerful these days. Try and remember patent law was created to promote innovation not crush it.

I have experienced this too and with my old Samsung Captivate as well. When people see an Android phone they are wowed by it and by the ability to make it what YOU want. When they see an iPhone, it's just another iPhone, there's nothing special anymore, nothing "magical." I used to get excited over iPhone announcements back in the days where I was a poor high school student yearning to have a smartphone. Now, howveer, I find the annoucements boring because really, there's nothing to be excited about anymore.

Well, it looks like that's exactly what happened, and HTC refused to license.
"Apple reportedly asked for $5 - $15 per device to settle Android patent dispute" (I'm not 'allowed' to post my source link, but if you google that headline, you should find it on the Dow Jones website. Article is dated May 5th, 2012.)
So HTC just went on their merry way and knowingly infringed on the patent. If they didn't see this coming, then they're idiots.
That said, I LOVE this damn phone! I see why Apple might have a little envy smeared on their faces!
Does anybody know what exactly it is they are claiming infringes on their patent still? I thought this was resolved with the adding of HTC Linkify Dispatcher. I've used the AT&T ROMS and I've seen how annoying this has made the UI compared to the Rogers version, what more do they want?

Thanks for clearing up my ignorance, that's totally what I meant to say, (reference to the book by G.O.), and the point I was trying to make, lol.
I don't totally hate on apple my MacBook pro still best computer I have, and its almost 4yo, and still kicks ass media wise. But this lawsuit thing is just out of control.

My View on the Apple Injunction

Let me start off by saying that I have used both iOS and Android phones and I have always found Android phones to be superior. So don't flame me. This post is directed towards all the "apple haters."
Apple is not entirely to blame. In fact, they are pretty smart for what they are doing. They are using the patent system to their advantage. So don't get mad at Apple. They are playing the game smart and winning. Get mad at our absolutely screwed up patent system.
When a game is unfair and there is a player taking advantage of the situation, do you blame the player? No, you blame the stupid game. The same logic applies here.
In my opinion, instead of #boycottapple, it should be a call to reform the Patent System.

Finally someone gets it. Apple is simply playing the game with the rules that are set. They aren't the only ones euther. Just look at Motorola who got a injunction against the xbox. The us patent system needs to be reformed.

E.g Voice search existed before siri.. and once siri was introduced Google did nothing, not a single injunction against it, because siri was titled 'voice assistant'. and now after Google announced Google voice Apple went berserk and said it's against their patents.. wtf?

What I want to know is why is Apple allowed to even bring suit against Samsung when the offending software was created by Google and exists on all Androind powered hardware? This "issue" isn't specific to Samsung hardware.
Maybe I'm just ignorant on the patent in question, but it seems like Apple patented something the PC has done for years. If you do a google search on Steve Jobs, the results from multiple sources is all displayed in the same browser. Am I not understanding the patent correctly?
To me, apple just seems butthurt that android is beating them in marketshare. The new IOS obviously ripped off the notification bar from Android. Just seems like this is what operating systems do. They take features from one and figure out how to apply them to theirs to make their product a little better. I dunno, but apple just makes me sick. Richest company in the world, and act like paranoid control freak misers.
One, there's already a huge thread on this.
Two, anything within the law is okay, regardless of what's right? Coolios. So if the law gets changed tomorrow and it allows for companies to engage in assassinations in the furtherance of their goals that would be okay? I'll be a little less extreme. What if corporations became legally able to engage in espionage and sabotage of competitor's facilities. Would it be okay if Apple did that as well as long as it's legal?
Apple's lawsuits are slowing development and innovations from other companies and are wasting the courts time when they could be hearing cases that actually have merit.
Also, just so you know it's quite possible that both the iPhone, iPad, and iPod will be going under injunction here soon as a result of a recent hearing, so it's all good right?

I think Apple has pushed this so far that even those who love the Apple ecosystem have gotten tired of it. They are signing their own death warrant by both alienating even their staunch supporters and by stifling the very innovation that has become the hallmark of the mobile tech industry. iOS 5 and 6 literally owe almost every added feature to Android and to a lesser extent WP and R.I.M. It is the excitement of something new that put Apple on top but it is clear that without Jobs at the helm the company has become stagnant and seeks to bleed other companies dry rather than remaining a viable prospect in the marketplace. Tim Cook is clearly not competent for his leadership role if he thinks litigation is a viable long-term solution.
Apple will die soon enough, without Steve they're nothing

I haven't seen any evidence that most apple users are really bothered by apples anti android tactics. There are still millions longing for the next iphone and saying that apple are great.
Apple won't die off, they still sell incredibly well and have done for the past five years. They are succeeding in most court cases and the only people really bothered are us android users, not people whose views cook and co are bothered about.

I've actually seen a number of users on various forums who have gone with other devices when they were about to upgrade their Apple wear. Maybe it's just the fact that those who have strong opinions will be more vocal, but if ten people are moved enough to comment, then ten times that many might be on the same train. Even if it's just a pipe dream I would love if this would all finally backfire on Apple the way that it should.

I've seen people do the same but they all own android devices too, with apples new patents on everything from touch screens to displaying data on a screen I just can't see them going anywhere but up unfortunately.
They own patents that literally every mobile device can be seen as infringing so they have unlimited court case ammunition if their sales do drop and they need to make more money, they have judges in germany and usa imposing bans on rivals to limit competition and they have enough die hard fans to keep their business doing well even if the rest of the world did stop using their products.
I would love to see apple taught a lesson but the nearest anyone came was a uk judge telling them to apologise to samsung. What happened? Days later apple got an eu ban that overrides uk law.
They have unlimited resources and top lawyers, they also have patents on things every mobile device needs. They can't really lose.

Well, Samsung just made their newest salvo so we'll see what comes of that. I really does appear that it's going to take a concerted effort from Sammny, Google, maybe a few others to fight this effectively. What amazes me is instances of Nokia and Microsoft supporting Apple in some of its previous complaints.

Might not be a large percentage, but when loyal users move away there's also the influence they have on other buyers. Apple has built itself on perception and between the increased reporting of Jobs' tyrannical leadership and Apple's increasingly public patent mongering I can at least say this won't do anything to grow Apple's marketshare.
Apple will die gradually..so they are frustrated. Sony & Samsung will rule the world.
Who cares. Apply are dying... No one will even remember then in 5 years time.
Sadly, there are a lot of apple fan-boys who will buy their products for the sake of the brand. Sad but true. But at least this showed that other companies have at least a fighting chance legally with the absurd limitations apple tries to impose on them. When i hard brick my phone i'm gonna slap an iphone sticker on it and sell to those apple die-hards for $$$

Odds are Apple won't die. Even IBM survived it's almost devised. That said, if they continue in the same way there relevance in the market is is in for a rather sizeable shift.

all these patents war is just useless, why can't apple just stop suing samsung and just try to make better products ? the reason apple is trying to ban samsung's products is because it's just too good that apple is scared.
also, some of the patents are ridiculous, rounded edges, square shape, it's a universal shape like for what apple made such patent ?

As much as I dislike the ruling, it's a legit reason. Depending on what your talking about (The Sammy vs. Apple case). Samsung CLEARLY copied a lot from Apple, just take a look at the 1st Galaxy S. It looks like a modded iPhone. There's no getting around that point. I'm not the biggest fan of Apple, but me wanting to make it big as a business man. I need to see things from an unbiased point of view. That's why I have little, to no problem with the ruling. It's just business. You can also make the counter argument that none of the current Galaxy Devices look like an iPhone, but they didn't get in trouble for those. It was just the OG Galaxies. About the gestures things, there's certain ways you implement gestures. Samsung was using a patented way to implement gestures. But as I was saying earlier, it's just bossiness. Now Motorola is suing Apple for many Wifi, and Data patent infringements. That pretty much covers all there devices with a Wifi Radio on it. Now you don't see people complaining about how bad a company is. There happy that Apple is getting sued, so am I. But is it fair to Apple, and there products (Not just iPhones, but Macs, etc) not really. But it's all business. Apple sues Samsung, now Motorola pulls an Apple on Apple. What a magical world we live in. We should see the positive in this whole thing. The phone world should stop being flooded with ****ty phones, and company will create better devices. Apple put the fear of Steve into every OEM.
I'm also inclined to agree with the victory for Apple for the Samsung v Apple case as well...
I like Android. I consider it (vastly) superior to iOS. That does not mean I will always back up other companies that produce Android devices simply because they use Android on their phones. In my opinion, the older versions of TouchWiz did have some striking similarities with iOS. This does not mean I think Android is a copy of iOS, it just means I think an early stage of a company's skin looked very similar to Apple's.
Also that corporate email stuff and that mention of Google warning them could not have helped their case.
I see what you guys are saying and since I've never even picked up a Samsung Galaxy I probably shouldn't say anything at all. But hasn't tapping icons on a touchscreen, the color white & rectangles been around for quite a while now? The DS being my first and only smartphone this is my only experience but it does make me wonder where it will stop. Only tinkering a bit with an iPhone & an iPad.....I was absolutely astonished as to how similar the versions of MIUI were to iOS when I have run them. The theory and the code (although probably different programming languages) have to have huge similarites. Do suits like this open up the door for Apple to begin suing individual developers for "copying" their OS? If so....they don't stand a chance against Apple's vast legal resources .....or am I just pulling one outta my big ole butt?

I think that because the Android os is open source, the individual people developing are going to be exempt. They are just going off what was put out there. With everything being open, Apple should have been able to see from day one and been in court then, maybe they just wanted us all to love the os and take us users by storm into the Apple world.

I don't see this as Apple vs. Android at all; it's more Samsung vs. Apple.
I'm loyal to Google and Google warned Samsung of the similarities. This makes taking the verdict a lot easier pill to swallow.
The true problem is the patent office. Stop allowing people to patent basic **** like rectangles with rounded corners.

That's exactly the problem! If you can patent, as Samsung claimed "rectangles with rounded edges", where is it going to end? Should all devices with one button below the screen be considered as patent infringement? The point of a patent is not to protect a brand, it's to allow a revolutionary new idea to have its chance at the market...
That said, I haven't actually read the verdict in any detail. Did the jury claim patent infringement, or trademark infringement?
Apple copied a lot from microsoft, they had made a pc that is completly portable and a couple years later apple made a more polished version called the ipad, but microsoft didn't sue.

What PC are you talking about? AFAIK (which is not very far), Microsoft has never done hardware except for the Surface tablet.
Apple also stole the original GUI from Xerox

Point blank, Apple is upset because they can't do any better than android, so they have to sue to help themselves feel better. I swear corporate bullies is all they are LoL They're latest upgrades/updates are just catching up (still haven't) to what android has been offering for years, so they sue in efforts to slow down progress IMO anyway. Which will never happen. They want to be a monopoly in a world of freedom...impossible!!!

Comments about this or that company didn't sue Apple when they did this or that are probably under-informed. Many companies have contractual agreements to not litigate over vast areas of intellectual property. For the present discussion, perhaps the most well known is the agreement between Microsoft and Apple. Those guys were in court pretty much non-stop for years. Perhaps some of you youngsters in the audience didn't know that Apple sued MS, claiming that the Windows UI was derivative of the Mac UI. Anyhow, at a certain point, I guess they both realized it was mutually-assured-destruction (or some other line of reasoning), and the two companies signed a far-reaching non-aggression pact. Other companies have similar arrangements. It's quite common.
As someone said earlier, it's just business. These companies are not refraining from going to court because it's the morally correct thing to do.
Assuming the verdict and penalty were arrived at justly (I wouldn't know one way or the other), the only place that fairness comes into it is that Apple seems uninterested in getting licensing revenue. They want to stop their competitors from using their patented stuff, which I think is a bummer for us consumers all around. Contrast with Microsoft, which has a tidy business of getting royalties from almost all Android phone makers. You could call that a rip-off, but those other companies agreed to it, and the cost is probably insignificant compared to your overall price for a current smart phone.
The way I see it, competition breeds innovation. Money makes people play dirty, but it's how they deal with it that'll eventually make us better phones.
Android is a collaboration of multiple companies creating their own flavors, with Google at the tip of the spear. Apple is a closed door who makes app developers pay to create programs that make their company money. The only thing apple has an advantage of is grabbing celebrity endorsements for their one size fits all equipment.
I honestly think apple is running out of ideas. They need a breakthrough, and they thought Siri was it. As much fun as it would be to act like Tony Stark talking to Jarvis, I don't think it's any more useful than our Genius button. Software just isn't there yet.

Actually the suit was thrown out because Apple built Mac os from the open source Xerox GUI. In those days patent suits were more realistic. Logical thinking of you can't patent something that is a copy. Now the patent law has become very unrealistic and out of control.

Agreed at the patent office being the real problem. Did Henry Ford get a patent on 4 wheels and engine in front? Does Gibson sue everyone who makes a "Les Paul style" guitar or one with Humbucking pickups? No. The root problem here is that Steve Jobs, and in his absence Apple in general, is too lazy to out innovate anyone so they want the market returned to the days when they WERE the innovators. I personally prefer devices like the DS and the original G1 because nobody is ever going to mistake them for an iTurd. And yes... I would drop my SIM card in my G1 again before it would touch an i device.
Xiaomi better be careful with releasing a phone with MIUI as stock os though... If the new one looks as much like iOS as the one I tried for DS... That could be a problem. It just makes me sad because most of the GUI patents Apple was awarded they didn't even come up with.

The Tablet PC was out long before the iPad. Go watch some episodes of 24 and you'll see CTU use one. XP Tablet edition was out before Vista.

But we all know Tablets as we use them now would have never have been with out Apple. Apple sparks the idea, then company's try to battle it out. Take the iPhone, touch screens where not a huge thing. iPhone comes out and BAM! Market floods with Touch Screen phones.

Or 2001, yes? I actually watched that after all this Apple/Samsung/Other garbage started... Most exciting.
What I was actually saying is that *Microsoft* does not make hardware, HP, Dell, ect. make hardware and Microsoft licences them hardware. Nitpicky, I know. That's how I am. Sorry!
That said, I just looked up tablet PCs before and after the iPad, there is a marked shift... From huge, bulky stuff (with resistive touchscreens and/or styluses) to sleek, thin, multitouch devices.
But then, I only know what I've picked up, I've never researched anything about this.
I hope you guys realize this is all just a publicity stunt for Apple. Rather than spending $$$$ on advertising, they would spend it on getting into legal fights with Samsung. And in the process they can prove to the uninformed consumer (a surprising majority of the population) that they were the first to come up with the ideas, and they are the innovators.
And they actually came away with some money from their main competitor as well. It's a win win win for them any way you look at it.
I can't even remember the last time I saw an ad for the iPhone, or any Apple product for that matter.
A VERY good point gtmaster303! It goes back to the saying, "There's no such thing as bad publicity".
