I Have the unlimited data plan with ATT. I started streaming tv and downloading files more often. Close to a week after I got an email saying I have reached the top 5%. I turned data off as soon as I got the message and it turns out the top 5% is 10gb.
I also never got these notices they speak about.
"Before you are affected, we will provide multiple notices, including a grace period."
My previous data usage was around 500mb a billing cycle. I'm not the typical data hog most cycles.
Now I'm wondering how the define the top 5%.

I hit way more than that for a few consecutive months last year. It sucks that "unlimited" is anything but.
@OP: 10 gigs is pretty huge, considering I hit around 1-1.5 gigs a month doing everything, even occasional GPS, excepting streaming audio and video.

100 users in your area, of which 70 use less than 500 MB, and 25 are within the 2 GB mark. Remaining 5 are over, say, 8 GB. These 5 fall into the top 5%. But I don't think they send alerts to all 5. It should be hitting those guys across a normalized top usage level. I may be wrong here, but this is what is my thinking.
Let me put it this way, none of my colleagues (over 20-30 of them have an android 4G device and everyone gets atleast 3-6 emails account synched, apart from others activities), even cross a 1GB mark. I am kinda the only one who even crosses this mark. I don't want any comments on their competency at usage and such, but just stating facts.
I use 5-8gigs a month, I'd be surprised if they ever notify until my plan unlocks.

10gb in the first 10 days of a billing cycle is a ridiculous amount of data. That is 30gb in a cycle if I kept up this rate. I don't plan on keeping it up though.
I never got the warnings that att mentioned in their memo. The only one I got was that I had reached the top 5% an my data will be slowed for the duration of the billing cycle.
Its understandable why they have a sort of soft cap.

Hm... yeah. I hardly break a gig. But I must ask.. do you ever go on wifi? One month for two weeks I was on vacation outwest and I streamed a ton of my favorite show the mentalist. Hardly cracked 6 gigs. Also, went on wifi about twice all trip... so do you use wifi at home? Or are you in a city and you are always connected or something?
What I don't get is that last month I had 10 gigs and i asked the guy if i was in the top 5 percent. He said no. Now this cycle I barely hit 6.1 gigs and i got a text saying im in the top 5 percent. How in the heck can i have 10 gigs and not be in the top 5 and then use 6 gigs and be in it.. I live in the middle of bum-f**k nowhere. And I have not gotten ANY warning text or been notified of even a grace period. A bunch of bull I say.

And it is still labled Unlimited and should not be crippled in anyway.. if he wants to use 50GB then let him they should of thought of that before selling these phones with those possibilities and saying all you pay is $30 for unlimited which more users use less which level each other out but don't sell a car and say you can only drive 10,000 miles a year or we will slow your car down... etc... its not right its not what its advertised as and its wrong.

No what they are doing is bull****, wether ur are or are not an AT&T fanboy, unlimited means unlimited I have the unlimited and I was capped last month by usin my Sirius/XM internet radio app, not tethering so thats bs.... Its bad custormer service to limit in anyway an unlimited plan not to mention if they upgraded their damn network like they were supposed to not just on paper..... Im in an HSPA+ area but the H+ network is running HSPDA for some reason even after upgrading the towers last year!!!!! Orland, FL

It seems like bad customer service, but the intention of it is to keep the network from being over crowded. You will be limited by the network if enough users used this amount of data. ATT says the merger is part of their strategy to alleviate the strain on the network. I'm ok with the speed reduction. Just sort of suppried I was able to reach it.

The issue with abusing a network is when genuine users (as in people who use less data, and use it for official work like connecting to vpn, etc) find it slow, and complain to AT&T. Incidentally, these kind of users are normally less, but pay a lot of money to AT&T. And when they complain of low speeds, AT&T does all it can to keep them happy.

This is again becoming one of those posts that pop up once in a while for data issues. So, to cut it short, don't abuse the network. Unlimited is unlimited, just that at lower speeds so others can too share the network. 1 person who uses 20 gigs can be overlooked when 100 others using 200 MB can be serviced.

You are getting EDGE like me. TMO throttles after 5GB until next bill cycle. But then, We are on the "LARGEST 4G Network" arn't We?

Yup, increase coverage and speeds, lower the data cap in half, and use up your data in half the time! I think if I did the math right, I can cap out 5gigs in about 9hours of watching netflix via my playon app alone; which is about 20min a day for a given 30 day month. They should of kept the 10gig at least, considering EVERYTHING this phone does practically uses the internet.
Wow, I didn't know they did that. I thought I used mine a lot, but I just checked and I only use about 500-600 MB a month, lol

wow wtf are you guys doing with your phones? tethering to your PC and broadcasting 1080p video on ustream?? My next billing cycle starts in 5 days and I've only used 250mb (I'm in a 4G area). I use my data A LOT too - youtube, surfing the web, market downloads, facebook, twitter, etc. I use an app called Line2 for my incoming/outgoing calls and text msgs which relys on my data and I still don't get close to 1GB.
I will tell you how I consume 5GB quickly.
I am an independent IT consultant where my clients don't allow access to their network with my machine. Therefore, I am tethered 12hrs every business day. Syncing a 3gb IMAP mailbox all day is a lot of data alone!
I consume 1GB every 3 working days.

Then you should have the common sense to have a better internet solution than tethering.
I've never run into the data cap, not because I don't use my data, but because I'm actually wise about it and don't carelessly burn bandwidth. Use Wifi when available, don't try to consume as much data as you can.
How many of these threads do we need about how the OP didn't bother to check usage or ***** about data throttling?

Hey, we have no data limits at sprint..
Except you'll be lucky to see more than 300 kbps in most areas during the day with 3g, and ~2-5 Mbps on 4g. We have people in the evo forum *****ing about the extremely slow network, ready to jump ship to vz or elsewhere.
I've come to the conclusion there is no ideal solution. Each provider is a compromise of different elements such as price, service, data, features, etc.
Common Sense? I was answering a question as to how one can get the to 5gb limit, period.
Common sense says Tmobile should have told me about the 5gb threshold when I agreed to a contract, and fine print is not acceptable.

Common Sense? You are expecting a Corporation sales person to be honest with you? They are interested in one thing and that is selling a product. They don't care if you get screwed in the end. They will just take your $200 ETF when you find out how much they lied to you... Well didn't disclose the TRUTH to you and you move on to the next corporation that does it to you in another way. That's what business has come to in America.
A warning would have been nice around 4gigs. TBH, if you say you use the web all the time and only have 4-500megs usage your lying. My biggest data drain went into streaming TV and music from my home server. I was unaware t-mobile even had a limit until i got the message saying I was cut off, because when i had my BB i would usually only average about 20megs a month usage. Hell, I ALMOST went with a 200meg connection, but didn't want to feel restricted so I went with unlimited.
These phones are beast, as they should be with a 4+meg connection! It just doesn't seem fair to offer us all these gadgets and offer us their TV packages and crap then take it away just barely into the month because we actually use what they advertised to sell the product!

On average my apps have been between 2-3megs each...
So at ~87 custom apps, that I have actually kept and not just downloaded to try, at 2.5megs each that's 217.5megs; a total which almost meets your usage so far alone.
Well, I'm in my first month with TMO and already got my 5GB notice. Isn't it nice. I get a ripping 20 KB/SEC on my best download but, usually around 10 to 12KB/SEC on AMERICAS LARGEST 4G NETWORK. That happened right in the middle of a SW update and their CRAPPY network could not even handle a text message and the download at the same time. They cut me down to 5KB/SEC and it took close to 2 hrs to DL 50MB. What a deal they are giving us. The big problem is the only company that I have ever been happy with is no longer doing business in my area. Lots to look forward to.
This morning I got a txt from att I am in the top 5% of data users witch is odd since my billing cycle is to the 15th how i get that high in one day. Unless they where referring to the previous month but i checked and that peak at 1.8GBs so im confused.....I know that means throttling im just wonder what the line is anyone know??
just ran test for 3244/741kbs I guess my last month got throttled.....lame 1.8 shound not put me at top 5% if they offer 2gb plans >_>

They won't throttle people with a tiered plan. If they go over, ATT makes money off them. So what they are saying is, you are in the top 5% of unlimited users in your area.

I have to agree. If they are pinging you for 1.8 then I would definitely complain. They offer 2 and 4 Gb plans. Unless you exceeded the 2 then I do not know why they would say something. As it stands, you are already paying $5 extra a month for the "unlimited" and if you are not exceeding 2Gb by much then they are still making money off of you. This is pure greed. They are so worried about losing some money that they are now finding ways to force people to a limited plan. This top 5% of the area is a load of crap. Surely they can make it where once a person exceeds 2Gb AND they fall in the top 5% then send the message. I would think this would be a basic programming of rules.
I always wonder if they have "exceptions" to this rule. I can guarantee that if the top 5% only uses around 1 to 1.3 Gb, then they say absolutely nothing. After all, if a user has never exceeded the 2Gb in years, then making them pay $25 vice $30 would be draining their own pockets.

So have I! thats why this is so strange to me, one month I peaked at almost 8gb and nothing and my nov peak was 2.5 so now 1.8 is their new magic number its total crap, I think there is no top 5%, how can only 5% of unlimited users be past 1.7gb in Orange County. Remember that the unlimited still has a clause built into the TOS of "Fair Usage" THe unlimited plan was made when there were only feature phones and then for the few that got the first smartphones. It was mainly set up for Business users that needed it while out of the office. Now that every kid and their grandmother has a smartphone so they are doing away with it after the unlimited was abused. IT started with the Icrap users always streaming stuff. Now you have every one using the cloud and the data rate from some people are just not acceptable. Mix that with the fact that no one reads the TOS and this is what happens.
Well I've gotten the message for the past 3 months, at the moment my download speed is 131 kbps and upload speed is 1648 kbps I'm gettin screwed I feel, I've been with Att for 11 years now and now this crap. Took 22 minutes to download a 2.99mb app from the market. I'm not switching to a tiered plan gonna download 24/7, tired of getting this message every month at the 1 gig mark.

I average around 3gb a month. My company pays for my phone and I'm grandfathered in the unlimited. Not sure what AT&T totals my usage at since I've never seen the bill but my app usually says around 3gb.

Downloading is too slow. If you want to eat up as much data as possible, try uploading video to something like drop box 24/7.

AT&T revealed today that it has made some adjustments to its data throttling policy for customers still subscribed to legacy unlimited data plans. Customers on these unlimited data plans will now have a higher data cap before throttling kicks in. For those on HSPA+ plans the cap will be 3GB per month, while the cap for LTE customers will be 5GB.
AT&T’s unlimited data throttling policy was instituted back in October of the last year, but the company never did reveal in detail what the data cap would be for throttling, merely stating that only its top 5 percent of heaviest data users would be affected. Early last month, the company came under fire when some customers discovered that their unlimited data plans were being throttled after reaching only 2GB of data use, despite the plans costing the same as a current tiered 3GB plan.
It looks like enough pressure was applied that AT&T is now responding by raising the data cap and being more transparent about exactly where those thresholds sit. The caps are now 3GB for HSPA+ subscribers and 5GB for LTE subscribers, which is certainly a welcome boost up from the 2GB cap that appeared to be in force regardless of whether a customer was on an HSPA+ or LTE unlimited data plan. Users can check their monthly data usage by dialing “*data#” on their mobile phones.

Wow, that's a lot of data! I use around 10Gb average, and I'm pissed about being limited to 5Gb. In fact, last month was the first month I have ever been throttled. That's far from "Unlimited". And don't give me that BS that "they don't promise unlimited speeds". At 0.14Mbps I can't get one damn song to buffer on Google Music. It's freaking terrible! Google maps is near impossible to use. They might as well turn our data off at those piss poor speeds!
I just hope we can get at least one dev to come up with a solution so we can stick it to AT&T!

THey throttled me last month without notification. Took a level 3 tiered Engineer to tell me they had a glitch in the system with unlimited data users. I said BS and they gave me my last months data charges refunded. It was just a matter of time before ATT got tired of taking heat for this hot topic.
Canceled my unlimited data plan two weeks ago to change to the 3GB tiered plan, because they were throttling me at 2GB. This "update" to the unlimited plan makes me furious!

Some of these users that you are disparaging do have jobs that require them to leave their homes (for days sometimes). Some of them are drivers and are on the road most of their time. Some work in jobs that have closed networks.
It would be nice if everyone was living on welfare or disability checks, sitting at home achieving those 800 gig a month stats.

Some of these users that you are disparaging do have jobs that require them to leave their homes (for days sometimes). Some of them are drivers and are on the road most of their time. Some work in jobs that have closed networks.
It would be nice if everyone was living on welfare or disability checks, sitting at home achieving those 800 gig a month stats.

The reason I use around 10Gb a month is that I can't use wifi at my job because we are hard wired due to the work we do (very secure), so I stream a lot at my job. Also, my gym doesn't have wifi and I work out 4-5 days a week (@ a minimum 2 hours each time) so I'm usually streaming music via Google music there. It's easy for me to chew through data, but I just don't have access to wifi very often.

Ofcourse not, my high usage has always been because if i have an unlimited datat plan i will use it. I use it to stream while on the road, which i am on 4 days a week and sometimes more.

They never will, but this shows that they are willing to compromise, and not just ignore us.
I'm sure that if we keep trying, we may get the cap raised, at the very least for us LTE users, let the 3G users (See: iPhone) stay stuck at 3GB, us LTE users (just need an LTE phone) deserve more.
i streamed netflix to my phone constantly for a whole billing cycle and maxed out at 9 gb and thats the most intensive app on the market. Whoever said they use 20+ gigs a month is a little crazy and i do believe when people use that much it does hurt the other users on the network. and to the guy that said hes streaming stuff at his job...how come if your job is so secure how are you allowed to plop down and stream movies or music? it baffles me how i tested it and maxed out at 9 gigs but some people can get 20+ in one month. That's too much. Also you will find out that if people continue to do that instead of allowing you to keep the unlimited when you sign up for a new contract they wont let you take the unlimited with you. Also i streamed music for 5 hours on pandora and it only hit 150 mb of data so you must be either never sleeping and on your phone 24 hours a day or abusing your unlimited data plan.

I'd like to know what you think of a guy like me that has to drive for a living bringing merchandise from big warehouses from across this nation to retailers so you and everyone else can buy what they need on a daily basis, and not only merchandise but groceries for your nearest food store and you come here and judge my high usage, who are you to judge the long and lonely nights i have to be away from my family so that you and everyone else can go to they're nearest grocery store and buy they' re food to put on your table. Next time stop and think before you call someone crazy for using 20+GB or more a month.

I can see how being on the road and constantly using ur phone can get you 20GB of data. Personally I feel AT&T should have a separate special plan for people who are on the road all the time due to work. Thanks for bringing us stuff btw!
Not too pleased about a text saying im using too much data on an unlimited data plan. 3.5GB Used in about 3 week or so isnt tht bad considering todays phone features and my speeds of 1Mb up and down load bandwidth. Any way through or around this fair use policy thing? I want to keep enjoying my new galaxy s3.

3.5GB in 3 weeks is top-tier data usage. You'll be able to find language about it in your contract.
As for getting around it. No dice. You signed the contract agreeing to (however they're laid out) the terms which allow them to throttle/cut you off if you're using a lot.
It's possible, too, that your primary data usage location is on a particularly congested section of backhaul, which will cause problems.

Unlimited Data does not mean it's completely Unlimited, there is a cap of either 1GB, 3GB, 5GB as such and if you go over that limit they will slow down your speeds. Yes, there is Unlimited Browsing, but that's just for surfing. How you used up 3.5GB in 3 weeks is beyond me and absurd!
Mobile Data browsing is for surfing not be used as a replacement Wifi.

I youtube alot. 600MB this week. Music, phil de franco, sourcefed, =3 ray willliam jonson, movie trailors. And i have it all in HD or atleast high quality.
I use my wifi when possible. Thts about 13GB in the 3 week.
As you are a heavy user, consider moving to Three when your contract is up. They do all you can eat data packages.

It's easy enough to consume large amounts of data on a monthly basis just because OP has used 3.5gb doesn't mean he hasn't got a life.
I consume loads of data as I stream my music to and from work, Spotify makes up most my data usage. Watch videos at work when on my breaks now and then via YouTube.
Anyway to answer your question, Three provide unlimited data and GiffGaff also. Three are good but depends if signal is good in your area.
If your in a contract then nothing you can do and do not continue to exceed the usage, you'll either get charged for it or lead to a ban.

Really people are still using the old "use more wifi" bullcrap!?! How about phone companies stop spewing crap about "unlimited data" when its not really. Who are they to tell me that I cant use a service that I pay for as I damn well please.
Why should I need home wifi when Im paying 90 bucks a month for my cell service and I use my phone as its meant to be, a mini convenient replacement for my computer.
Its all about technology and cell providers need to catch up instead of slowing us down.

Sprint user here, yeah. 1GB of data was gone in a few days & hell, that was just the phone doing background syncing & photo uploads.
Gotta love unlimited data.

Haha. That is funny. I consistently use upwards of fifteen gigabytes a month. This is with going out with friends everynight, bmxing, designing and writing, and other lifey stuff. Technology is meant to intergrate with your life; not to take you away from it.

All depends on the tarriff and the language of the contract.
From personal experience, I agree with the others. 3 is probably the best network for you if you honestly don't want danger of throttling / warnings and are prepared to pay the price.
Long story short - due to the ASA bringing in new guidance, people can't say unlimited and then limit you in any volume related way without making that clear in terms and offer description.

I understand but don't agree with AT&T's throttle policy. But this is just ridiculous (see screenshot below).
.01 Mbps!!! Ridiculous... speeds this slow make my phone practically unusable!! And this is "unlimited" data... haha.
I know there is nothing I can do except grind my teeth and take it or go elsewhere.. I hope AT&T loses a lot of business because of this.
I understand throttling to an extent... but to throttle at 3gb with technology today. HD videos, Netflix, YouTube, internet radio, posting pictures with the phones 8mp camera.. of course data usage is getting bigger and limits are getting smaller.
I don't go far over 3gb, its hard to with these speeds.. but its normally the last week of the month that I get throttled. So I would most likely use 4gb, maybe 5gb. I read that 4g phone plans have a 5gb limit... and honestly I thought the Infuse was a "4g" phone... any way for an enormous and very profitable company to stick it to the little guys.
I also noticed that I get throttled at different usage. I use data monitor to track my usage and I've been throttled as low as roughly 2.5gb and at max I'll get to maybe 4gb.
Does anyone know how exactly we are throttled? It can't be automatic if it varies this much, can it? I imagine some well paid old man in a suit counting his stack of money, laughing and randomly hitting a big throttle button. Haha.
I apologize for a semi useless post and ranting away.. it's just been one of those days and needed to blow some steam.

I feel your pain, but from a different direction.
We only have the 200MB per month AT&T plan for each of our 5 Infuse phones and don't go over that.
Most of our internet activities occur at home where we use our Wifi router.
But that single Wifi router feeds up to 5 phones, a pc, and three laptops.
After somewhere around 5GB in a month and our ISP (Clear) starts throttling us slower.
It definitely kills the experience when you can't watch a video from start to finish without waiting for it to buffer a few times.
Unlimited Text, Talk, and Data, only $45/mo: Prepaid Straight Talk SIM Port your number over, and tell ATT to go fornicate themselves.
I am rated at 7.2mbit up to 360mb. I will grab another test once I'm throttled. This is o2 in Munich Germany. They say throttled speed is 64k. We will see.

I feel for you, but at the same time all carriers are doing this or will be doing it in the near future.
If you look at the current growth of mobile data usage and consider the spectrum they have to work with it's not sustainable. You can only fit so much information in a certain amount of bandwidth.
I am almost always near wifi, so my monthly data usage rarely excedes 200-300 mb. I'm on the 2gb plan but have never even used half of it.
Personally I wish companies would charge for what you actually use. (at a reasonable rate of course)
That will never happen, because they can't do the legal gymnastics to call it "unlimited" and they would scare off the early adopter and trendsetter types.
I left AT&T for Straight talk and left my 400 Meg twice as expensive plan behind for unlimited talk, text and data and now happily tether my Thrive Tablet to my phone on the back woods farm of my grandparents in Kentucky for Christmas where AT&T couldn't even connect! :good:
The thing you are forgetting is Straight Talk isn't true unlimited either. I have them and I'm talking from experience. I've gotten lucky and used almost 5gb and not been throttled but they are getting worse about it lately. I only used 1.6GB this month and they throttled me. There is no rhyme or reason to how they do it but they do it. 2GB and less you are usually fine on ST but if you goto howardforums.com and goto the Straight Talk section they have a thread on the throttling. Some people use 4-5GB and have no issues but some use a bit over 1GB and get throttled. It's honestly still WELL worth the cost because to even get CLOSE to this on AT&T for a single line will be around $110 a month.
I have 3 GB data plan and I think that's enough for me
If you are on single person plan, I also think that straight talk will be better choice for you

Throttling never makes sense just like the family share plan it's an excuse to get more money. I got fed up with ATT and left for t mobile. The plans are cheaper and I get true unlimited. With a rooted phone I tether and sure it's not true Lte but I still average 8-10 Mbps and that's perfect for me.

Maybe I don't know will enough about AT&T, but I believe you party same amount of money even you are under contract or not right?
Then all you need to pay is phone cost. There are some good phones with LTE and under $100.
Or you have choice of straight talk which gives you pretty good amount of data with super cheap cost.

Just wanted to chime in for a second. I had Straight Talk on my Infuse 4G for almost a year and while the service is pretty decent, I noticed that in a crowded AT&T cell I get kicked off. Also, I notice that (very rarely) in some places I don't have access to 3G service whereas other people with contract AT&T do (might be a modem thing, though, not 100% sure). There is supposedly an unspoken limit of 2GB of data per month (and some say even 100MB per day at most), but I have been careful to stay under both of those limits, the maximum I have used in a month on ST was 1.4GB.
Now I'm back on AT&T with 6GB Mobile Data Share and 2 lines (our Skyrocket i727s) and I have to say that the service is more consistent than I had on my time with straight talk (I've witnessed at shopping centers and malls I got kicked off of the data network more than a few times in favor of AT&T customers due to crowded cells), that and the LTE is great and the Skyrocket is just an all around awesome phone. I know the i727 is long in the tooth, but $.97 for a 1.5GHz Qualcomm S3, 1GB of RAM, LTE and that great 8MP camera is too hard to pass up. If you're broke like I was, it's a good deal.
Just my two cents. I know AT&T is a PITA but it could always be worse...you could be stuck on Sprint paying for 4G in an area with no 4G like I used to, lol.
