Can I sell my new Skyrocket? Or will I receive a penalty? Help, very desperate. - AT&T Samsung Galaxy S II Skyrocket SGH-I727

Hello everyone,
Times are tough. I need my phone for work but at the same time I also need some cash. Sadly I have to stick with my old Captivate. My plan was to sell my skyrocket, which I am already falling in love with.
I renewed my contract with ATT today at a ATT authorized small carrier dealer (Chinese shop). They ended up giving me the skyrocket for free. But the guy warned me that if I tried to sell the skyrocket then AT&T will terminate my contract. On my contract with this shop (AWG in San Gabrial Valley, CA), it says if my contract gets terminated in any kind of way within 180 days then I will owe AWG $300 for each PCS line. I have a family plan. He said if I wait 2 months then I can sell the phone, but not to sell it right away and that I need to use the phone during this 2 month period. He also said if I had an iPhone I would have to keep it for 6 months!
I don't know if this is true because I see people selling phones on craigslist left and right. Does anyone have any advice for me? Would AT&T really terminate my contract just because I choose to use my old phone?

Its not true u can sell it your stuck with the sim card and bill for 2 years but u can sell the device ive done it so have many many others. Thats the great thing about phones with sim cards u can sell or trade them at your discretion. I traded my sgs2 for the skyrocket.

You should be able to sell it. The phone its self is not bindingly tied to the sim card it has. People do it with iphones, and well, every phone out there. I don't think at&t would terminate you for selling a phone. Now, if you sold/lost your phone with the sim card still in it and someone were to rack up alot of charges, then yeah, you might be penalized. If you do intact get charged, att cancels your contract, your cat gets eaten by a dog that subsequently gets hit by a car that gets hit by a semi, don't blame me as, I just was browsing and chimed in

Thanks guys. Yeah, I don't understand why ATT would terminate my contract out of the blue, specially for using my old phone. It just doesn't make sense or add up. I really wish I could have been apart of this great community. I hope ICS comes to you guys real soon.

I work for At&t in the city of long beach (company owned retail) and we get customers in our stores that do the same thing... if its not blackberries, its iPhones... but yeah. You could definately sell the phone, but u gotta keep the 2 year commitment.

Will a LTE sim work in a 3g phone? I know commingle from an infuse to a Skyrocket I had to get a new simcard. Not sure if that would affect your contract

Yes! I took the sim out of my phone LTE Skyrocket and put it in my old cappy to get my contacts on it..LONG STORY WHY I WENT THIS WAY...but none the less..I kept the SIM in the phone for 3 days with no issues. Works fine!

You also have to remember it came out of a retailers mouth not a corporate agent. I will only deal with cor stores. The hell with retailers

You Dont have to keep the data plan. Very common misconception.

Newter55 is correct. Remove that data plan and save yourself $25 (or $15) a month. As long as the line in question is active, you will be fine. I know going into corporate retail can be a major drag, but it beats dealing with authorized retailers... it seems like lately 95% of fraud gets tracked back to dealers... everytime I get manager escalation regarding fraud, its the first question I ask my customers.. and 9 times out of 10, it all goes back to them. The funny part is when u try to contact the dealer and they act like you are speaking Swahili lol...

If it's something like the contract that I signed with Amazon, if I remove my phone/data package within the first 6 months, I will get charged $250 (from Amazon, not from AT&T). This is partly because I got the phone for $.01, instead of $249 like I would have paid directly through AT&T.
This is usually only the case with e-tailers. I have not yet seen this type of thing from authorized retailer stores, but there's a first time for everything.

That's exactly my concern is too. I got the phone from Amazon for $0.1 and I am thinking about selling it and getting either the LG Nitro or Samsung Note but I'm worried about Amazon charging me $250.

It all depends where you bought it; read your contract. Do you have a contract with just AT&T, or do you have one with your retailer as well? If you have a contract with your retailer, for instance Amazon has contracts, you will pay a penalty if you change anything or take the phone off the line, even if you change the number. If you don't have a contract with your retailer, then you just have to deal with AT&T--for instance you bought the phone at Best Buy or a Corporate store. They don't seem to care what you do, as long as you pay your bill. Be careful, many AT&T stores look corporate, but are actually third party retailers.

I disagree completly i bought a tmobile phone from amazon and sold it no penality same with att. They dont even know you sold it amazon cant monitor you att acount too see if you changed devices on your account. You sir are wrong. That would mean if you had an old phone and wanted to pop your sim out of your new one and use the old one amazon would charge you 250 because ur not using that phonE. Amazon does not know they get money from ATT for selling you the 2 year contract.... if you terminate you contract before the 2 years then yes they can charge you for it

This is Amazon, much like WireFly,LetsTak and any other reseller they can price the phone at whatever price theyd like since they make comission off the monthly plans more so than the actual hardware. Theyll take a big hit ($200-$300) on the phone in order to make it back up with the plan.
BTW this is for new contracts only via Amazon, renewals are still $99 and Family is $149.
I just ordered one from Amazon for a penny. So long Sprint and so long samsung moment (blech)
I ordered mine from Amazon along with 3 other phones on a new family plan with 1400 minutes. Total cost after shipping: $.04.
makes me feel I made a mistake getting the phone in the first place. Good thing I like the phone.

Why would you feel like you made a mistake getting the phone if you like it just b/c the price went down? Hell, I paid $175 for mine (Family plan upgrade-secondary line) and I'm still happy with my purchase. I agree that it is annoying to see them offer such good deals for new users and screw over "loyal" customers though...
AT&T charged me $100, they gave me the $100 discount for being a loyal customer. Funny thing is i joined when the iPhone 3G came out.
I tried to get my wife to get it for 1 cent but she insists on getting the EVO, loyal yo sprint.

To be fair Amazon's a dealer like Wirefly. They make nothing on the sale of phones but get paid on selling the contracts. The Captivate is 99 dollars if you are renewing or adding a line on Amazon. Still a better deal than anywhere else. As a NEW AT&T customer I would have spent $199 on the phone at the AT&T store. I was all about to buy a Vibrant yesterday for 70 bucks on Amazon when I found the penny deal on the Captivate. So here I am.
Difference is, when you buy it from the AT&T store, they cover your warranty for the year - and their warranty is great.
If you buy it anywhere else, you have to deal with Samsung directly unless you get lucky and AT&T ships you a replacement regardless.

Not so much a mistake, I am happy with my purchase. It's just the price that we pay to get the best in tech before everyone else.
I've never done that before, and used to tout that my motorola karma was pretty much the same thing as a smartphone.
Obviously I had no clue what I was talking about.

It's what I was told from AT&T and when I spoke to Letstalk, Wifefly and so on. But FWIW, people have stated that they just called AT&T and they sent them a replacement - but that could just be a YMMV. I would try to verify as well before you add insurance in case you don't need to.
But for $.01, I'm jealous!
Amazon has such a great rep that I doubt they'd have entered the Wireless sales business without some assurances from carriers. Wirefly has a shady rep from what I was able to google.

The thing many of you guys are not realizing is that this price and other similar deals are for completely new accounts only. Upgrades or even new family plan lines will bump up the price to $100-150. Under the circumstances most of the people I know who paid for Captivates, they wouldn't have saved any more money if they had waited, as everyone I know who has a Captivate was already an AT&T customer.
And quite frankly, while the Captivate is a great phone, it's not worth putting up with AT&T over if you're on a good carrier, especially since there is/will be a Galaxy S for all major carriers.

True, but reading through Amazons policy, they only support the phone for 30 days - as do all online retailers besides AT&T itself (they have a full year). Other online retailers pass the warranty to Samsung. But for the period Amazon does cover it - they have great customer service.
I'm not saying that's bad as I never dealt with Samsung for warranty purposes. I just know that AT&T deals with warranty issues very well. But regardless, $.01 for this phone is an amazing deal. The chance of needing a replacement post-30 days might not even occur for you - and if it does - you can always try AT&T for replacement.

So I wired my younger brother the money to pick up my phone in the US and send it back with my grandparents who are there visiting... He went to AT&T today and they denied him the ability to purchase me the phone off contract. He said he tried for a little, but they kept saying that they would not sell it to him off contract. I told him to try and go back if he can, but he might not be able to due to work and my grandparents leaving soon.
Can AT&T actually deny selling the phone off contract? I told him that if he is able to go back, to tell them that it is being sold from AT&T stores for $549.00 and to ask how it is possible for them to deny the sale.
I understand that they dont make money selling phones, but rather the service, but to just deny him is crazy...
Thoughts? Opinions? Suggestions?

I have never heard of them denying someone to purchase a phone off contract. Tell him to go to Target or Wal Mart they sell att phones off contract.

they can deny anything to anyone. but you can buy it on there website. they dont want to run out and are hoping that this will attract many new contracts so they prefer to sell to new subscribers. my att reps dont care either way and i had the option to buy outright, i shoulda taken that option but it is too late now. im not sure if i can cancel an early upgrade in the first month like a new contract.

about $50-$100 more as far as i can tell but some regions are jacking up the price even in the at store. i think it is $579 on att's website. my store is $549 but some stores may be $600 or more
Is he a ATT customer. It is true they wont sell to non customers and they dont have to.
Crazy how some places jack up the price like that. The reason I cannot order it online is because I would have to pay a 16% tax for it to get through customs here in the Dominican Republic. So i have been trying to coordinate with friends and family that have been in the US and this was my big chance so say.
Pretty annoyed about this, seems like everytime I try to get a phone i am unsuccesful for one reason or another. Already had the issue with the G2X not being quad-band.
I hope he was able to go back this evening and get it... Not sure what to do next if that doesn't work out.

Either way its bad customer service for them to turn you down like that. "Can I give you $550 for this item" rep "no" ... "only $199" doesn't make sense. I'd raise hell. I realize they make money off the data plans and.contracts and how att works but either way you look at it that's poor customer relations and incorrect information directly from a.corporate store.

Off topic - I hate you because you have a Transformer and I don't.
I'm not sure I'd plunk down that much for the infuse anyway. It has the same gps issues as the captivate and nexus s phone. To me I'd buy an iPhone and have your brother send it along with your grandparents or even an atrix. I like my phones to work right.

the gps if far better than the galaxy s phones. trust me on that. it can use altered settings as it has quirks but the gps is not the same hardware or drivers and is by far improved

As long as you have a active account with AT&T then they will sell you a phone out of contract or no commitment pricing. If you don't have a account they don't have to sell it to you

+++ Inventory is thin right now. They would rather sell that phone with a contract, which they probably did short after. Or if not, at least sell to a current customer.

Do you happen to know what store in Boston he went to? I live in Boston and was able to buy one from the Downtown Crossing store with no issues. Just be nice to the AT&T reps and don't look/act like a grey market reseller

Yes, AT&T rep told me that first couple of weeks no AT&T store will sell a new phone without contract.
You have to go to bestbuy for that. I bought mine there for $599 without contract.
Another option is online purchase from AT&T's website for $549 without contract, but there may be some issues with that.

Just happened to me today as i got my Infuse...
ATT store said that they do not sell new phones off contract for the first month after release....
I had to go to Radio Shack to buy the phone...

Reselling while under contract?

Just wondering if it's possible. What I was thinking is keeping the Infuse until the SGS II comes out and then selling the Infuse and with the cash I get for it pay for the SGS.
Do I need to do anything special to my Infuse before selling it (say on craigslist)? Never done anything like this before and was just wondering if it was possible.
So far this Infuse is rooted w/ Infused v2.1. Would I need to unlock the phone? Or is the phone pretty much unlocked already with the ROM I installed?

As long as you stay in contract and pay your bill for the 2 years you can do anything you want with the phone.
It's not unlocked unless you specifically have unlocked it. Rooting and loading a ROM does not automatically unlock it.
Depending on who you sell it to keeping it rooted might be good. That's a choice you have to make. When I sell a device I usually give the buyer the option to have it rooted or not.
What ever you do just make sure you remove all accounts from your phone, especially your gmail account.

Personally, I would suggest using Odin to go back to stock, then going in and formatting both the internal and external sd cards so that you remove any of your information on them.

The contract is just an agreement to pay for the voice and data plan for two years, and there is a standard fee for breaking it (starts at $325, less $10 per month you've paid or something), and no obligation to return the phone in this case. I can't swear that AT&T won't blacklist the phone in the case of an unpaid bill, though it seems unlikely. I assume they would simply cut off service to the person's SIM and sic a collection agency on them.
Att's prepaid service, GoPhone, and devices, are unable to be resold. Contract phones can. Do not know why, but its stated in the terms of service for each.

You just have to pay an early termination fee, which is like $300 and goes down each month towards zero. It's basically a loan for the cost of your phone.
No matter what the phone is yours to keep.
I've sold about 5 phones over the passed few years and everyone I was under contract. I've never had an issue nor did the buyer. You don't have to do anything special. AT&T doesn't have to be notified for any reason. It's your phone. I've even told reps I was selling my phone while I was getting an upgrade and they didn't care one way or the other. Just make sure all your personal data it wiped. That's a must.

anybody considering tmobile?

Long story short ive been with verizon for a year and change. This is the thrid time ive been charged for a phone ive shipped back to verizon. Somehow they cant find it in their wharehouse even though fedex says it was delievered. I spoke to upper mangement and they gave me a free gs3 for the troubles "lost my unlimited data" as part of the deal. I was assured i wouldnt see a charge this month and boom, there it was today. Now they reversed the device charge but im stuck with the extra $35 government surcharge. Im kinda ticked and am thinking about canceling my contrct and going to tmobile as they are cheaper and have unlimited data again. Anybody else experienced these type of problems on verizon?
Sorta seeking advice. Im fearful of ever shipping another defective device back. With sprint i could take it in locally and they would fix it or swap it out on spot.
I'm sorry to hear this. I've shipped like 20 things to Verizon literally and it's made it but I was considering tmobile too. Grab a gsm phone and rock it. But it really depends on your coverage.. Tmobile can suck like hell in some areas. They let you buy phones by adding payments to your bill every month and they work with you if you need an extension on your bill.
Verizon charged me for a whole year for a line I wasn't using because I had it suspended and not unbilled suspension. I had no clue there was two different things. And I even told the rep I had no phone for the line so please suspend it. I only found out it was on when a rep called me saying they were hitting the switch because I had another line under my social that was unpaid.
In short.. Give them a go.

Yeah i mean i love verizons coverage but this being fearful to ship phones back when i pay for warrenty is crazy. Tmobile has good coverage here. Gonna call up verizon tomorrow and see what can be done. If nothing ill check out other carriers in a few weeks. Im just frustrated today.

The tax usually comes off on the next bill cycle. You don't see it right away when they refund the charge.

I know this but the point is i shouldnt see any charge for their screwup. Iet alone 3x already. I feel as im being punsihed for something that is beyond my control. Thats why im upset.
Well I moved to Verizon from T-Mobile because their coverage is godawful pretty much everywhere I ever spend any time.

Yea i left sprint after 5 years becuse of horrible service. So i wouldnt go back there. At&t is not worth it so im left with tmobile. I know they have good coverage here and a good lineup of phones. The unlimited data may be a plus too. Ive wanted to go gsm for some time now.

This. Yes, Tmobile without a doubt is much more affordable... But they do not come in comparison to Verizons service. Verizon honestly has the best coverage, but their customer service is lacking heavily compared to other carriers. Of course this is just from my personal experience...

I think customer service is lacking at all companies today. The lack of knowledge from reps throughout different companies and industries is just mind blowing. Seems like no one gets trained on the products they sell anymore. They just make stuff up and unless you educate yourself you would never know that you are being lied to most of the time from these people.
Don't know if it has to do with lots of turnover, lack of training, or companies just not caring but it really is sad when a sales guy or service guy does not know their product and the average consumer doesn't know enough to challenge what they are told.

Very true. I don't think any training is needed when you read your responses to your customers off a computer. Most of them give very generic responses. It's funny actually.

Verizon is amazing with business customers. Above and beyond anything I dealt with when I had a tmobile business account, and Verizon does have the best coverage and the fastest speeds. What is the point of unlimited data when it doesn't work when you need it.

You are the only one that posts your location. I'm in Houston and you have to be within the Samsung radio range of the towers throughout Texas. During hurricane on Tmobile if it works at your house normally 3 miles from freeway you have to go to freeway or tower to get service. If we travel in Texas my son who is on Tmobile has to use my phone. If you are more than 3 miles from any major freeway in a metro area in Texas under good weather conditions you can hang up any signal. Tmobile only rents the towers that are on the freeway in Metro areas and about every 10 miles in between. Verizon either buys or rents every tower in the state. That is the difference.
after comparing prices im certain we will give tmobile a try next month. probably get myself the note 2 and my wife a galaxy s 3.

I think they do. They have signs every were around my area to "test drive" there service. I'm thinking about switching because my wife is jealous of NY s3 and wants one now and I'm not gonna pay Verizon's crazy prices for there new share everything plan....and loss my unlimited data!

I have a sweet deal on Verizon, 3 lines unlimited with 1400 minutes, plus insurance on the 3 lines, with wife's discount, we pay $165 a month. I have never had anything but great customer service, sometimes you need to call a few times to find the right rep! I would never leave Verizon, coverage cannot be beat.
I thought about TMobile but when my wife and I went into a local store they told me $150 down per line (to go towards the phone cost apparently) which gets refunded with a rebate then they wanted $20 per month for 20 months (so $400 per phone). I laughed in their face and said I'll stick with VzW where I can pay $200 for a phone and have better coverage.
You'll be sorry if you go with T-Mobile. Good luck going on any sort of vacation. Biggest regret of the carriers I've had is T-Mobile. I paid the $200 ETF and ran. Which ended up being $285 after all thee BS fees. $23 government related usage fee? Never had to pay that until I terminated. They rip you off, on top of their crap service.

idk my contract ends on September but i asked on t-mobile and they said the earliest i can renew my contract with full discount and everything will be in march on my b-day but i might just wait till a holiday so i can get those juicy specials so maybe the s4 or note 3 on the 4th of july

My contract is due next week. I want a Nexus 4 and use it with a prepaid service. Here in PR, TMo signal is not good or maybe is this phone not being able to pick 3G. I don't know. My gf got a Note 2 and it's great, but without contract is too expensive, worth 2 N4. So Nexus it shall be.
Im waiting on my N4 to get here. Ive already bought the sim from straight talk. I advise any of you guys that plan on using straight talk to goto walmart.com and buy the att micro sim while its in stock. After they are gone no more att straight talk byod sims. Apparently they lost a contract with att to sell just the sims. Ill be picking up two more in the coming weeks if they are still available just because.
Chris if you are going to goto a att mvno make sure you can bring your own phone. Most of them restrict you to their phones. Atleast in the states they do.
My contract expired over a month ago and as always it will depend on $$$. I want my next device to be LTE capable. It's great that T-Mobile is finally implementing LTE yet it's only in a few markets right now. last time I looked the Note 2 was the only LTE device T-Mobile had. I heard they'll be getting the LTE capable Galaxy S3 soon. Until T-Mobile steps up with adequate devices it's pointless to upgrade yet. Just my opinion.
I'm on Chris' s same track. I also live in PR and Tmo's signal is unpredictable. My contract expired 3 weeks ago, and my wife bought me the Note 2. I can't complain, I'm in love again with my device as i was with my SGS4G. Battery life is amazing, considering the 3100mAh and running pure stock, with some bloat removed. :thumbup:
I still lurk around this community and test some of the Roms here, as I gave my SGS4 to my son.

You can buy a SIM cutter for a few dollars that will punch a micro out of a standard one.

Or download templates online or borrow a micro one and line it up and cut it with scissors or just wing it. lol. I have an old prepaid card that I use for unlocking iPhones with (still legal in Canada) and I just winged it and cut it and it works.

Its not a matter of the sim size. They are going to stop selling the att brand sims. It will be only T-Mobile brand sim cards.

Does that mean that they'll also loose the tower contract with ATT? I haven't looked into it at all but isn't the tower contract part of anti monopoly law? If so is this ATT's way of finding a workaround?
I've got to say that getting off the subsidy-based plan makes far too much sense to me now, especially with T-Mobile re-farming the spectrum in the US. With better alignment of the bands, I find it hard to consider a T-Mobile-crippled phone (both hardware and firmware). When you take into account the difference in price in the plans over a two-year period, even if it is only $20 a month (and it is significantly more for me), that is $480 -- which is probably more than the subsidy would "buy" you anyways.

Yep. Add to that that unlocking a carrier based phone is "illegal" and I'll only be buying non branded phones. Plus the international versions always have better specs than the US versions anyway. I don't live in an LTE area so that is far from a deal breaker for me.

No just the sims for the byod plans. I just ported my number to straight talk today. It was a pain in the ass but ugh finally. From the limited info given out straight talk just lost sim card contracts. Tower usage is still the same. But if you get the t-mobile sim you CANT connect to the att towers.
Unlocking your phone is not illegal as long as you get permission. I am on the fence on that as I think people shouldnt buy phones subsidized then unlock pay etf and change carriers. But if you have been a customer long enough for them to give the code it shouldnt be a issue.
Is the note 3 and s4 going to be LTE? I live in Tennessee and im sure theres no LTE out here but it wont bother me any.
And isnt it only illegal to unlock a phone if it was bought after a certain date? Or is it legal if you buy it straight out or from another owner
