Nolan lawson's great pokedex app is being requested off of the android market by nintendo, lawson has agreed to do so and stop all work on his program
details as follows
A legal representative of The Pokémon Company has responded to me via email. He has confirmed that TPC would like Pokédroid, and all similar apps, to be removed from the Android Market. TPC’s stance is apparently that they don’t want any Pokémon-related apps at all for the Android platform. They feel that such apps infringe upon their copyrights and compete with the print versions of their strategy guides. I will make a proper post about this once I’ve gathered enough information.
Today I received an email from Google explaining that Pokédroid Donate was removed from the Android Market due to a DMCA takedown notice from The Pokémon Company (a subsidiary of Nintendo). The email begins:
This is a notification that the application, Pokédroid (Donate) with package ID com.nolanlawson.pokedex.donate has been removed from Android Market due to a violation of the Developer Content Policy. Please review the Content Policies and Business and Program Policies before you create or upload additional applications. Note that repeated violations may result in a suspension of your Android Market Publisher account.

Anybody using the app has known about the chance of this happening. I Want to thank Nolan Lawson for making me feel like a real pokemon trainer while having this amazing app

If I were Google, I'd tell the guy, it's not because you violated policy, more because Nintendo didn't like it, be more modest.
I'm a Pokemon fan, and annoyed by Nintendo's attitude to this, they aren't going to make people suddenly rush out and buy an official strategy guide. People will just fire up their browsers and look at one of the millions of fan-made pages to get their information.
I would also like to thank the devs that made these apps, Nintendo should be hiring them and making an official Pokemon app, as it's clearly what people want rather than having to carry a large paperback book just to check what level a pokemon evolves at.
I just downloaded it and backed it up for the hell of it, maybe it can still be distributed that way.

Would ask the dev first as it's technically piracy.
My phone is off for repair and I won't get it back until this has vanished, would like a copy of it to reinstall once my phone is back, but don't want to disrespect the dev by getting a dodgy copy.

whos it hurting? i mean its not like nintendo has their own pokedex app in the market or something...oh well. in a way i guess he can feel complimented that his app got popular enough for nintendo to notice!
I prefer Chimpokomon myself.

So I see a bunch of folks around xda mentioning, even recommending applanet.
i`m certainly not opposed to free but I just cant figure out why they want permission to access to log in credentials when installing the app.
Would anyone smarter then me like to give their two cents on this?

hmmm. I don't remember it asking me for credentials....I got the apk and installed it, and it launched......maybe it used my stored credentials? hmmm. I did not give it too much thought as I have 2 google accounts. 1 for junk and another more serious. They could hack the junk one all they want.
Lemme clarify. When you install the app. The permissions page pops up telling you applanet wants (among other things) permission to access your account credentials.
Very few apps I have seen need this level of access.

Agreed ... baring in mind that there are apps on the Market that require really suspicious permissions as well, regardless of whether they are free or not. It's probably worse with APKTor, which is not designed towards secured downloads

You other guys aren't even reading what he's written
"The permissions page pops up telling you applanet wants (among other things) permission to access your account credentials"
As in - when you install an app from the market, it tells you what it's going to access on your phone and asks for your OK. He's asking why an app would want access to your credential information portion of the phone (as opposed to just SD Card Contents, etc). He hasn't said ANYTHING about trying to pirate apps!
BTW, I've never seen one ask for that.

By that you mean what? That people opposed to pirating apps shouldnt read threads by people that do?
Im also opposed to pirating. Yeah, if the app is free and you cant get it, then ask the dev for the apk, but knowingly taking a paid app without giving a donation or any recognition to the dev is wrong.
Just my opinion.

Having said that. Everyone is entitled to their opinion and since the awkwardness of the apPlanet apk changed my mind about installing it I don't even see a need to continue those thread.
BTW. Some apps are ridiculously expensive and I still don't see a reason to pay upwards of $20 dollars to a group of investors just to find i still can't edit word documents.

There is a big difference in "circumventing software limitations imposed by others" on a device you have bought and own and blatant pirating of apps
So, everyone on xda has no morals? Im sorry, but thats a ridiculous statement. People on here mod free apps, or they will mod paid if you have proof youve paid for the app. No roms have paid apps in them unless theyre put in by mistake and then theyre taken out.
And yeah, there are ridiculously priced apps (navigation for £40 - £80) but people do buy them.

Applanet is a warez source - this site has a very strict policy *against* warez, which is probably why the "hacking" aspect of it is tolerated.

That still doesn't make stealing an application right though does it? Don't forget that you have 24 hours from making your Market purchases to uninstall and get a refund if it doesn't suit your needs.

I though this subject was not about pirating but more about why an app asks for some rights.
btw applanet is not only for pirating it also provides free apps unavailable on the market.
in addition it seems to not providing anything anymore the last past days....
There's supposedly a new release coming soon, and they're fixing the server end of it as well.
I think what it boils down to is if you're uncomfortable with the permissions an app is requesting, then don't install it. Better safe than sorry right?
Actually its only 15 mins to return the app. Still its better than ios

Any idea as to what happened to Twin Blades?how come its no longer in market place. thanks
http://www.wpcentral.com/twin-blades-pulled-marketplace
Going the way of Apple, eh? but luckily Apple changed, hence the advent of great games like Resident Evil and Dead Space
its a disappointment indeed. im also wondering as to why they need to take out twin blades from market place because of the mature rating? not all kids can buy a device that is costly as windows phone, and to think most windows phone owners are matured enough to handle such content.
if this is the case, good and exciting games are being removed from circulation, i think i might as well stick with my wii. too bad wii doesnt have phone integration lol.
thanks for the info

Yeah they changed alright, hence the requirement for all apps that use external subscription (Kindle, B&N, Rhapsody..you name it) to instead go through in-app purchases, giving Apple a nice 30% cut. That's right. They want 30% of Kindle's sales that go through iPhone.
I'd argue that a "Mature" rating from the ESRB is not the same as what Microsoft meant originally when referring to "Mature Content" in their Marketplace rules. There has to be some common sense about this stuff. Blood and gore is not the same as porn.
Damn
I bought the app months ago, but installed a new sd card. Does anyone know who I can contact about getting the game again or refund my money. Rather have the game, it was great to waste five or ten minutes.
Please keep things other than app releases OUT of WP7 Apps and Games, and please read the stickied rules at the top of each forum you are in.
~~Tito~~
It sucks, bit keep in mind kids can sometimes purchase this stuff without parental consent. Theonly way to prevent this from happening is to just not let it get on the marketplace. Google hs a no porn policy for Android market, ad well. I can name examples of apps that were pulled from well known entities, but I don't want to go there...

I think that Google should do a better job of scanning/screening apps before they're released for mass consumption. This should be the first line of defense, but as you stated, it ultimately comes down to the end user being smart about what they install.
Agreed. It all comes back to why we get irritated at some new users posting when they have a problem and post before looking for the answer.......they dont want to read. Good practice would be to read the reviews before downloading.

Well I don't know where Lookout gets their information about not calling it malware but according to wikipedia
Malware, short for malicious software, is software (or script or code) designed to disrupt computer operation, gather sensitive information, or gain unauthorized access to computer systems. It is a general term used to describe any kind of software or code specifically designed to exploit a computer, or the data it contains, without consent.[1] The expression is a general term used by computer professionals to mean a variety of forms of hostile, intrusive, or annoying software.

But that sounds exactly like what this software is. And I have seen it before on my phone. It doesn't matter how careful you are even if you do read the reviews on the market. I had a free game called Bocce Ball. It had great reviews. Had it for many months. Then one day it wouldn't work unless I updated it. Low and behold I had notifications pushed to my notification bar, my homepage was hijacked, and I had search icons on my homescreen.
There lies why apple may be superior and I hate to admit it. It actually is in control of everything that gets posted on it's market. And with the variety of OS versions out there for android, Android is starting to look like Windows more and more everyday.
People will download anything these days..

We all know how easy it is to cheat developers and find apk's on the internet. Well it seems developers are complaining and if nothing is done then they will focus on the iphone appstore matketplace. More details in this articule http://androidprirates.blogspot.com/
Ever heard of installous on iOS? Piracy will find a way. If most resort to only iOS, chances are piracy on the Apple platform will also skyrocket.
The thing is, trying to fight piracy head on is an uphill battle, and after so many legislations, millions spent on safeguards and lawyers, and bashed sites (megaupload, piratebay?) pirated stuff is as easy to access as before (and for a lot of stuff, its even easier today).
I believe that if piracy is costing so much money, then there's a problem with the business model. Labels and record companies had to accept this when they adapted the napster model to online stores like iTunes and Netflix, and stopped charging ridiculous amounts of money for CD and DVD without added value (remember the last time you paid 30 or 40 bucks for a 10 song CD back in the 90s? Now its usually a buck per song).
Bringing down sites that offer pirated apps will cost more money than what it's worth, it's just information that can and will be put up again in a docen other microsites.
Troughout history it's the black illegal market that has innovated and pushed the legal market fordward to meet people's demands. In this case, i believe a lot of piracy on android is the result of not having alternative payment methods (how i long for iTunes-like prepaid cards on the playstore). Also, such an open source platform could make better use of the add-serving model the internet is based on, after all, that's how Google makes money anyway.
Well it's impossible to stop piracy. They should just make app's cheaper and more people will simply buy it. Profit for everyone.
Don't assume that 100% of pirated app downloads were going to be bought. But the issues facing Android with piracy are no different than Windows for example. Nowadays most expensive Windows programs contain a way of activating online when first installed and some even check the software key when downloading updates. Even with this, there are still pirates that get around activation. But there are still plenty of programs and games being made for Windows even though its had these problems with piracy for decades, despite what "Don't Copy That Floppy" warned. I don't see Android being any different, developers and Google Play will just adapt better app activation.

Absolutely agree with you on that. The only way to fight piracy is better protection and online activation can improve this situation (like in case with the activation via Steam account for PC games).
Even though there is piracy in appstore , I still think android is much easier to pirate. There is no jailbreaking needed , just one click and install.
There's no point removing sites like this.Pirates are gonna find a way around it. just make apps cheaper and people will buy them
Yeah your right plus the googleplay store isnt good when it comes to refund. You can buy the game save the apk , then get a refund. Its like there is no way developers can win.
I got a question for android developer here on xda-developers , how has piracy effected your games or what do you do to make some money on andriod market.
What are the ways you made money ADs, IAP, etc. Share your tactics to go around piracy!!
A person from india recently commented on my blog that the reason for android piracy in india is there are no ways to pay , so the only choice you have is to pirate games and apps.
Piracy is ultimately inevitable. Trying to stop it is just pointless
Sent from my SCH-I535
True you can't stop piracy but there are signs that piracy on the mobile platforms are slowing down. This was the reason that Installous shutdown because they weren't having as much traffic as they used to.

nobody really cares, Android is primary OS for developing countries, like Brasil, India, China, Africa, east europe & cis, and if google would DRM its Play well ppl in that part of world will turn to some opensource alternatives like Firefox OS, Meego, Tizen etc etc. And Google will find itself with declining android phones sells and even less revenue. It's like with Windows, till Vista it was easy to pirate and B.Gates intentionally did that to grab market share from Apple. And only then, in 8th version they made some good antipiracy lock with addition to cheap affordable price. Now it's easier to pay $70 for upgrade from W7 to W8 than look for loaders and sorts
To combat piracy, provide value added services to legit owners like perhaps a unified scoreboard, gaming social features, and more. Similar to steam.
Also, malware should be encouraged to propagate outside the play store lol

He then published with the same app name, app description as well as the same assets (music, sounds, graphics) claiming as it's his own work.

Collect all the project files you have that were used to create your assets, or purchase agreements if you bought your assets, and find a good lawyer. You will likely find many who will take your case at no up front charge if you have all your proof of authentication in order.

I wouldn't try anything until you have your lawyer initiate a legal binding letter
I'm an attorney (I practice in Ohio) and I agree with everything noted above. It won't be that hard for an attorney to get these removed from the other app stores. He's not located in the US, it seems, and that could make it harder for you to stop him from selling it through foreign channels, but your attorney can at least get this pulled from the big stores pretty easily. I used to have to do this all the time when I worked as an attorney for a US software company. We had problems like this pop up across the globe. It sucks, but you should be able to get this squared up through an attorney. Just don't contact the guy personally. Let your attorney do the work. Otherwise you can end up encountering some pitfalls.

Thanks @jonny6pak @electrikjesus for the advice, but I already contacted them myself.
I contacted the App store and the WP store (I could wait of course). The App store contacted us shortly via mail stating my complaint among other legal stuff. He had to prove he didn't infringe my rights, but he just answered that he pulled it off the store. So I guess that was quick.
I'm worried about WP store, he doesn't want to pull it off... but I will wait a few more days maybe I'll hear from their legal team.
@Argurth I will report.
He made the game with unity3d so he must be also in violation of their license, stated in section 2.5.:
http://unity3d.com/legal/eula
Just wanted to share some thoughts....
Apparently this guy or a group of them are exposing themself as MicroLink studios and We Inc. companies. They have a few games, all suspicious in both accounts. Anyway I won't bother with it...
Previous month App store forced owner of the We Inc. with my complaint to remove the app, but WP store did nothing (no communications after I provided them a certified signature). I had to contact the owner and explained the situation (all violations) and he disabled the app without any reply.
The MicroLink studio has released Cocoman previous month on the popular markets (App store, G.Play, WP store) which is a fine clone of my Tapazoic.
Now if you search the WP Store for "Tapazoic" they will throw you Cocoman which I guess is a "great suggestion" for the owner.
So I guess there is no hope for indie devs these days.
