Filed a complaint with the BBB before I filed with the FTC actually...
The complaint should be with ATT and not samsung as far as froyo goes considering that not only was it leaked late last year but its also been released officially with every major carrier outside the USA.
This Captivate is being advertised by Samsung as upgradeable, even though they know that the phone is not at this time (ever?). Samsung has released the updates directly for the other models of the Galaxy S but is refusing to do so with this phone. The other day they briefly had a link for the update on their website then took it down.
You are wrong good sir. samsung has released the software. It is att who is at fault here we are in. think the last galaxy s phone to receive three update. So it its slightly misleading advertisement but not false

It is upgradeable (custom roms). Granted upgrading it technically voids your warranty.

The BBB is a joke. They have no authority and no influence, really. I've filed complaints with them in the past, and all they can do is refuse to give a company a good BBB rating.
Good luck with your complaints. I doubt the BBB or FCC (especially the FCC) will find anything worth investigating...

Yes, that's what the info they got. Remember Samsung publically said the same thing when JH7 is first released. Support CSRs are the last person to know any upcoming updates. That shows how bad Samsung support really are.

I'll give Samsung/ATT until the end of September to get an actual GPS fix out, like they said they would.
I have already called AT&T about the issue and they are prepared to give me another phone of my choice if I decide to send it back to them.
Otherwise, I will probably sell it and go back to a Nexus One or maybe attempt to get a Telus Desire. I think it has the ATT 3G bands.
Alice seems to frequent these forums from Samsung chat logs. She never seems to know whats going on either.
I just went up through the ranks of Samsung customer support right before posting this. Chat first, won't waste your time posting it here as it has already wasted enough of my time. Second, phone call to "tier 2" support, had me do a battery pull and restart, obviously a waste of time, got transferred to "tier 3" support, apparently the highest level of support and where I was really trying to get anyway. Had me go into settings and turn on "wireless networks", yet another complete waste of time. However, I wasn't looking for him to fix it over the phone, I only wanted information.
Believe me when I tell you I held his feet to the fire looking for some information on whether or not there was ANY information or ANY update coming out AFTER the JH7 OTA update. He assured me there was no information on any other update in the pipe other than JH7 which had obviously already been released. I did get him to divulge that they have had "a few" other calls from people who's GPS was still not working even after the update and that the calls that had come in so far were only for the samsung captivate and that they hadn't had any other calls in regards to the other Galaxy S phones on the other carriers which seems suspect to me since to the best of my knowledge, all the other Galaxy S phones share the same GPS problems. He said all he could do was take down my information and pass it on to "research and development". I even tried to get him to transfer me to research and development to no avail.
In the end, the only recourse I had was to mail a letter to "Customer Relations" or some such thing in Texas explaining my situation. I really believe that the only thing I took from the conversation that was of any real use is that the only way they are going to do anything about the problem is if they get enough people calling and complaining about it.
Do yourself and all of us a favor and call in to voice your concern with getting the problem fixed. It only takes a couple of minutes and maybe someone will be able to get more information than I was able to. 1-888-987-4357. Sorry I don't have better news to report.

Good point, it was really hard to read that. It may be an automated bot it may not be, but the questions were so all over the place that it was impossible to tell what was going on.
Again, if this was a person making matter of fact statements - it is not someone in the know. It is just a 1st or 2nd level tech support person and they never know what is really happening in the dev world.
I didn't think there would be such a backlash against me about this thread. I was trying to be helpful and let others know that according to support, there isn't another update for GPS.
If you want to believe it is a robot, or canned, or some dumbass they put on the chats is your right. But my bubble has been burst and I don't think another fix is coming.
My strategy was to try and see if Alice would slip and let me know if there was a gps update coming out. She did not falter.
I would love to be proven wrong and would love to see the magic bullet gps fix, but i have zero hopes of that now.
The gps is big for me, but the rest of the phone is great.
I think everyone can agree this was a debacle for Samsung, and my next phone will probably be an HTC.
I will also keep most things to myself as well because clearly they are unhelpful in this forum.
We all know there is Froyo update that will be coming in a month or two. Samsung has the time to tweak the GPS more or even fix it in Froyo build.
But I don't think there is any Eclair 2.1 GPS fix in the works. All indications are Samsung has decided to move on.

Okay all jokes aside and as someone who has worked support before, reps are bottom feeders. They do not know anything about their company, their companies mission, or current development/progress. They are given a task, and their task is to find a way to keep you from calling in again while making sure that you buy a product from them in the future.
From the responses, she is not a bot. Thinking it is a bot is just silly, however, this does look scripted. Likely samsung is using India, the phillipines, etc.
If you allow this interaction to shape your feelings about your phone, I would like to question your intelligence. You're going to get this from any company. The grass isn't any greener on the other side.
Don't expect better from htc. The evo was capped at 30 fps. All the reps told anyone who asked that this would be unfixable in software because it was a hardware cap. They stuck to their story until a few days ago, when they removed the cap in software. That's not an isolated incident either. I remember when they sold phones with great gpus and advertised that fact. They didn't actually have drivers for it in the phone, so the gpu just say there inert. They never fixed that. Htc regularly lies to their customers, just like samsung.

I'm curious as to how you "know" a Froyo update is coming in a month or two? AT&T has never once officially committed to releasing a 2.2 update. The only thing that's been official is that the I-9000 was supposed to get 2.2 by the end of september, and now that's slipped back to some time in October, probably the end of the month. Samsung has to get any updates approved by AT&T. Maybe I'm missing something, but I have not seen one official word from AT&T concerning this, just speculation on top of conjecture from people on here "in the know"...

I'm in the USA so technically according to *Alice* with which I also chatted online, Kies is not supported. (of course that person provided the link to Kies Mini anyways) I was clearly told this is the JH7 update which WILL fix the GPS. From other forums I have read I will lose PC/Internet (tethering). Alice indicated yes, I'd lose that then.. oh wait, no I wouldn't.. it'd be a choice I could chose. So I downloaded and installed KiesM. I connected my phone and no surprise it didn't recognize it. I rebooted the phone. I am rooted, 1click lag fix and att bloatware removed. The KiesM found my phone and said it was unregistered and would not allow me to update it. I then closed the app and opened up normal Kies. It found there was a new version of Kies (assumed it included the JH7 update) and it downloaded etc. It also said it could update my firmware. When i attempted I get an error showing my pda, phone and software versions and states (while none are jh7) that it could not be updated. I also have tried the over the air option and continue to get no updates available. So, I can't even get this (what about half say sucks other half love) update even if I wanted to. Pretty disappointing. I really do love this phone EXCEPT that it doesnt connect to my alpine ida-x001 which I have scoured forums everywhere to see why the usb continually connects and disconnects and this second issue, poor, terrible GPS functionality. Last night was the first time I actually needed it but fortunately I can read a map and street signs fairly well and didnt need the locator beacon, just the actual address. Point of my long post, if you know how to get the update via kies let me know. If you know that it being rooted and ATT's bloatware will prevent it from installing, respond to let me know and I can try the update. I'm not opposed to it... however reluctant i am according to the negative posts..

In the US Galaxy S release party, Samsung publically promised Froyo 2.2 for all US Galaxy S variants. AT&T didn't say otherwise. So, we will take the Samsung's PR or marketing's words for granted.
I am on the Vibrant boards, but want you guys to help.
I generally remain calm and try and remain upbeat and defend... but the news (rumor/leak) about Samsung holding off the froyo release to sell more phones set me over the edge.
While nothing is confirmed, I still believe Samsung needs to be aware of just how pissed they are making our community. I'm not talking stupid class action, blah blah... I simply want our voice heard, and for a Froyo release to happen ASAP... but beyond that, I want them to adhere to the Open Handset Alliance and release their source for our developers.

This has been talked about many times already. XDA is not the place for this.
Don't know about you, but I'm sick and tired that our talents here at XDA have to do all the Quality Control and product SW support work for Samsung. For FREE.
Samsung was giving us a run-around for months and months now. This is company that made bazzillions on selling it's mobile products due to customers expecting care and updates from it.
The least we can do is not sit silent about it. As for me, I'm dissapointed in Samsung, and although I love their hardware, the software (without XDA's ROMs and fixes) is horrible. It is unnacceptable, and I want Samsung to spend some of that big $$ on its software department and quality control.

I don't know but there is only one way for them to please everyone and get users back on their side.....
Upgrade straight to Gingerbread. That would make all Galaxy S Users happy and probably keep a large % of them customers on their next phone.
Lets be honest, there were certainly issues when Samsung released their version of Froyo to select providers up here in canada. Rogers decided to wait it out and have them work out some bugs that were crippling other galaxy s phones. As you know FROYO is now available on Rogers and Canada being a smaller market, I believe it's being used as as testing ground for the firmware before it's released en mass to the much larger AT&T community. I've been using FROYO since it was launched on the Rogers network and haven't encountered any problems as of yet. I'm also not seeing an onslaught of complaining about phones being bricked or melted due to the release, so it would seem the AT&T update should be along rather soon. But what do i know?

I certainly hope so and not because i would use the stock firmware but because it would provide a much easier base to dev on than what the captivate devs have to deal with at the current moment.
Reminds me of the **** Apple and Microsoft have done with updates in the past, only in reverse. "Let's update all the devices, but make the new software so robust that the old hardware can't run it!" Only Samsung's case is quite different. Our phones are very capable of new updates.
They've got us by the balls and I'm just about fed up because we're never going to see an update. It just doesn't make sense for them from an economic standpoint and AT&T doesn't want to shell out the money. If I were in business to make and keep as many billions of dollars as possible, I'd probably behave in a similar manner.

This would make me the winner of the office pool. Check my signature, been saying it since November.
People think that by complaining loud enough they will get what they want. But honestly the people who are begging for froyo are a small subset of the total handset owners. People who are on xda are the die hard tech people who always want the latest and greatest.

We may be a small subset, but we are the ones our friends and family come to for recommendations. All of a sudden, the impact is no longer small.
I have no idea if the rumors are true, I know Phandroid will help spread the rumors but the rumors make sense.
Samsung sold you a device if it does not work they will fix it, but yes Android 2.1 is a working OS and Android 2.2 is an upgrade. They like most manufactures add bloatware, it does take engineering time to take stock Froyo add the bloat and all the carrier customizations, why should Samsung bother? Makes economic sense for them just to sell a next generation Galaxy S .
I for one love the stock Froyo running on my Rogers Captivate but I will not hold my breath waiting for Samsung to deliver 2.3 or 2.4
I agree at the end of the day 95% of the people will never visit XDA, or run Kies.
The tech geeks do not speak for the majority, this is why there were not line ups for the Nexus One.

It's been near perfect for me as well. The only complaints I have are:
1. The proximity sensor is screwed up. During a call, if the phone's screen is facing up the screen will turn back on. This means any time you hold the phone between your head and shoulder, your face starts mashing buttons. It's annoying as hell.
2. The contacts application never exits. It'll remain active in memory unless you end it. If you end it, your desktop disappears for several seconds before returning.
Gingerbread or bust.
Never again.

We are not a bunch of whiners unhappy because we don't have the latest update and demanding something we have no right to. We are a group of consumers unhappy that we have been lied to and mislead. Samsung promised this update almost at the same time the phones were released. They promised a time frame in which it would be delivered. They have not followed through on their promises. They are selling accessories for these phones that have features that will only work with the promised updates. That right there is fraud. They have released this update everywhere but in the US, which says to me that it is not a technical consideration that is holding it up. Regardless of what may or may not make sense economically to Samsung, a company that does not keep its promises deserves to have that fact spread to consumers everywhere. Let's see how many next gen Galaxy phones Samsung sells after this debacle.
I've saved them the trouble and gone ahead and switched to T-mobile and a brand new G2 (no nexus s, because I will never buy another samsung device ever again, be it tv, blu-ray player, phone, microwave, toaster, blender, pocket knife, zipper, or plastic guitar pick).
As far as the $200 early term fee? Well, I've paid it, and I will be making a trip to the county courthouse on Friday to file against AT&T in small claims court for knowingly selling a malfunctioning device and breech of contract. Should they actually decide to show up instead of calling me to settle like I expect they will, I will be citing Cuomo v. Dell as a point of reference.
After 2 non-functioning replacements, I'm done with samsung, and to be honest, it really doesn't bother me to make AT&T pay for Samsung's mistake, because AT&T sold me the phone in the first place, and could have easily given me an Iphone as a replacement when I asked them to. Maybe next time they'll think twice about using a manufacturer with a history of repeating this exact same ****.
No class action because, well, let's face it, I don't have the money or the time to pursue a class action, and as a consumer, I know that I won't be putting up with their **** ever again. I just want the contract they conned me into gone, and the $400 for the phone and the ETF back. I would suggest that if any of you are unhappy with the phone that you don't sit around and just put up with it. You need to go get another phone with another carrier, cancel your contract, and file in small claims against AT&T. When word starts spreading of this money will talk and the carriers will listen. Then samsung won't be able to sell their devices to carriers.
Thanks for making that decision easy, Samsung and AT&T.

From experience (2 returns are failures, 1 was DOA) that simply isn't true. Samsung is making users play russian roulette with refurbished phones.
Yup. This whole story just makes me all the more satisfied with my decision to go with the EVO over the EPIC on Sprint. We, EVO owners, were among the very first phones to be updated to FroYo. I've been rockin 2.2 for months now!
Go HTC and go Sprint!
P.S. I have other reasons why I would never by a Samsung phone. For some strange reason, there are way too many apps and mods that are 'not compatible with Galaxy S phones'.

Cuomo v. Dell was about defrauding customers out of money by falsely advertising a 0% interest rate. I think you are going to have trouble convincing a judge that AT&T committed fraud because you would have to prove that they sold you your phone knowing that it had hardware problems that could not be fixed. Since there are thousands of people using Captivates without shutdown issues or other hardware related problems, fraud is a huge stretch, especially when the burden of proof is on you. If you seriously cite Cuomo v. Dell, AT&T may defend against it just to prevent any example from being set.

So there isn't a press release dated Dec 20 out from Samsung instructing AT&T to "Sell through existing inventory" of faulty captivates? Citing that during a small claims hearing may not do much for me, but anyone that purchased a captivate after that press release now has a very real case against samsung and AT&T.
Alas, that's neither here nor there. I couldn't cite that case in the FILING process, or the SERVING process, only during the hearing, which precedes a settlement. You're telling me AT&T might be willing to pay a local attorney thousands, or pay thousands to fly a corp attorney down here to fight over $400?
I don't see it happening. But hey, I could be wrong. They could always attempt to countersue and not win. I didn't ask for your legal advice. I merely suggested that it may be worth everyone's time to send a message to the carriers that Samsung devices shouldn't be sold, that's all. It's not like it's any skin off your back if I win or lose a SMALL CLAIMS case, right?

I applaud your efforts, and i would do the same thing. Small claims court should be an easy victory and here is why:
1. It probably will never get that far, as the cost of the lawyer is in excess of the $ amount - assuming you are only going after the early term fee - I don't think you have a case for anything else
2. There are laws on the books about "merchantability" or "fitness of purpose". I don't AT&T or Samsung engaged in outright, but the simple fact that the phone had defects is enough - it is not dissimilar to invoking the lemon laws for cars.
Cars have 0 day return guarantee, so lemon laws were necessary. As a consumer, you went through the proper process and let them replace your device 2 times yet defects persisted. By then your 30 day return was over.
Document your experience and you should be OK if it goes to court.
I am not a lawyer but i have filed in small claims court in the past and had very good success getting results.

I guess you can perceive that the article is slamming xda by assuming our members here were hostile towards john. But the article already informs that it was just a samsung pr stunt. The title of this thread is misleading. The only thing this article does is assume that there is no ota update because it will be available via kies mini which is not a good assumption because the previous update was available both ways. This is all pure speculation because no official froyo update has even been announced.

a long while ago there was an AT&T support page showing how to find something or another and the support page showed that the firmware was 2.2, it has since been changed to a 2.1 firmware version, but as we all know, froyo hasnt happened. so, probably nothing.
Yeah the article still does not slam XDA...and as stated before a page telling you how to update does not mean there is an update.

Is this page new? It links only to Kies Mini rather than to the firmware itself, and no one seems to have reported anything about updates starting, and lord only knows, we'd be hearing a lot if it was really downloadable, and the fact that the page includes the lines
