Selling a contract handset.. - General Topics

Hi,
Just want to see if anyone has info on this.
I get my upgrade very soon and was thinking about getting the XDA 2i and reselling it on ebay. I wanted to check if this was legal under my contract? Bearing in mind I'm only selling the handset.
Just judging from how the XDA 2's rocketed on ebay with their release , thought might be able to cash in...

I've done it loads of time, I always get bored of my phone before the 12months is up (18months in my MDAIII case), but its only been to friends, who are normally on the same network.
No doubt its against your T&Cs, but hey ho!

Dont tell them, as long as you keep your contract paid up there will be no problem, if you default on the contract they will probably block the imei of the phone.

Yeah.. I might just keep the phone myself lol or hangon for my upgrade a while longer.
tho i like thel ook of the SX1...

How much is an XDA2 going for on eBay these days??

Done it many many times.
Ive even check T's&C's they state any items that were aquired with the creation of the contract remain your property and will not anything to do with the network.
Sim cards however are the networks and can be recalled at any time

I think I lost my Fuze, should I get another one from ATT insurance...

Hi, wondering if anybody can help me out with ATT policy. I was visiting my grandparents in Toronto when I lost my phone the day before I had to fly home to Los Angeles. Unfortunately I did not have time to look for it since I was busy packing for the trip home. Anyways when I got back I called ATT to tell them my phone was lost and they said they will sendme another phone when I pay my deductable.
Anyways I have two questions
1. Would it be possible to wait until the Touch Pro 2 comes out next month and ask for that as a replacement + cash if needed?
2. What happens if my family manages to find it and mail it back to me? Will ATT know that I found it and force me to return the replacement? Would they even care after i pay the deductable?
they'll probably just send you a refurb fuze and likely refuse the upgrade, especially when the fortress is a new release. i can't see them upgrading you even with cash.
att won't know you found your phone. i had lost a phone and reported it and found it 1 month later and went on to use it fine.
You guyz are lucky, wonder if these giant beast are so nice. :O

Seriously? Do you even know what you're talking about? :| If you report a phone stolen and find it and use it, it's no big deal UNLESS you get a new one via insurance. Then it's called fraud. You have to pay the deductible for your phone if you want it via insurance and they'll send a brand new in box one to you. No, you cannot wait till the TP2 comes out and exchange it for that. That will only happen if you've warranty exchange your fuze a lot and you complain to AT&T a lot. Quite a few people have done this. If you really didn't know, AT&T can track you via IMEI. They know which account is linked to which IMEI. They will know when you're using a blacklisted phone or when suddenly a "stolen" phone is being used on the same sim card. Don't take that risk
1) TP2 isn't comming to AT&T anytime soon, and they will never give you a better phone plus cash
2) I believe they put a status code of a bad or lost ESN id on the databases, so the phone can't be used again on the AT&T network. It may even come up as a stolen status.
That won't stop you from being able to use the phone as a PDA

#2 is not true, but #1 probably is.
I believe Cassetti is right about #2 When you call it stolen, they block the esn id so the thief can't use your phone.

the fact is : its not true. Proven fact.
thx for the info guys, i called up att and told them what happened, paid the deductable and picked up a new fuze. I ask them what happened if i manage to find it and they said most likely they will let me keep it as a back up but i would need to call them to reactivate it or something like that.
guess i;ll just skip the touch pro 2 and wait for a WM7 device or that rumored microsoft "pink" zune phone lol...
It is not blacklisted. If you find it you can use it or sell it. You don't have to "reactivate" or anything, just put a SIM card in and off you go.

Premium handset protection... Lost phone?

what does Tmobile do with the lost phone in question? do they disable it ? I'm wondering how they prevent people from selling their phones and getting a replacement under warranty for a profit..?
Not sure but they know. Put your sim in another phone, call them, they will be able to tell you exactly what phone you have.

Let's say my friend, Swim, has a Tmobile phone that he has insured through their PHP plan. He knows that if it were stolen or he lost it, it would cost him $130 to replace. He also knows that he could easily get $250-350 if he decided to sell his phone. So he is thinking about selling his phone and then just telling Tmobile that he lost it, so that he not only gets a newish replacement phone (possibly even an upgrade), but also pockets over 120 bones. Question is, does Tmobile deactivate his first phone somehow, so that whoever bought his original phone is essentially screwed?

Nope the person may not beable to use it!!!!it's a 50/50 chance long as the other person does not try n give Tmobile the imei # they should be gd

I have 2 things to say, and they're contradictory.
1. Official T-Mobile PHP Handset Protection FAQ (http://support.t-mobile.com/docs/DOC-1722) : Says phone will be disabled. Specifically:
All lost or stolen devices will be blocked from access to the T-Mobile network. Devices claimed as lost and stolen will no longer function on the T-Mobile network.

2. I used to be a tier 2 T-Mobile PDA Tech Support rep. I never once had a customer's phone not work due to being stolen/blacklisted. Not once. It was not in any of our troubleshooting steps to check such a thing either. As far as I was aware, there was NO WAY to block a stolen phone on T-Mobile and that's what we told customers.
Things might have changed - it's been about 18 months since the location I worked at was completely laid off and shut down. A lot can happen in that time.
Now.... do you want to take the chance? Go for it. But don't say you weren't warned.
So, let me get this right. You are asking in a public forum about committing insurance fraud and the forum has recorded your IP address also. Insurance fraud is a felony in most States. Makes perfect sense to discuss it here. If anyone on the forums assists you in any way then you have both committed conspiracy to commit insurance fraud. Conspiracy in and of itself is a crime even if you never go ahead and commit the crime. Smart.

Can I sell my new Skyrocket? Or will I receive a penalty? Help, very desperate.

Hello everyone,
Times are tough. I need my phone for work but at the same time I also need some cash. Sadly I have to stick with my old Captivate. My plan was to sell my skyrocket, which I am already falling in love with.
I renewed my contract with ATT today at a ATT authorized small carrier dealer (Chinese shop). They ended up giving me the skyrocket for free. But the guy warned me that if I tried to sell the skyrocket then AT&T will terminate my contract. On my contract with this shop (AWG in San Gabrial Valley, CA), it says if my contract gets terminated in any kind of way within 180 days then I will owe AWG $300 for each PCS line. I have a family plan. He said if I wait 2 months then I can sell the phone, but not to sell it right away and that I need to use the phone during this 2 month period. He also said if I had an iPhone I would have to keep it for 6 months!
I don't know if this is true because I see people selling phones on craigslist left and right. Does anyone have any advice for me? Would AT&T really terminate my contract just because I choose to use my old phone?

Its not true u can sell it your stuck with the sim card and bill for 2 years but u can sell the device ive done it so have many many others. Thats the great thing about phones with sim cards u can sell or trade them at your discretion. I traded my sgs2 for the skyrocket.
You should be able to sell it. The phone its self is not bindingly tied to the sim card it has. People do it with iphones, and well, every phone out there. I don't think at&t would terminate you for selling a phone. Now, if you sold/lost your phone with the sim card still in it and someone were to rack up alot of charges, then yeah, you might be penalized. If you do intact get charged, att cancels your contract, your cat gets eaten by a dog that subsequently gets hit by a car that gets hit by a semi, don't blame me as, I just was browsing and chimed in

Thanks guys. Yeah, I don't understand why ATT would terminate my contract out of the blue, specially for using my old phone. It just doesn't make sense or add up. I really wish I could have been apart of this great community. I hope ICS comes to you guys real soon.
Also, your sig on your internet speed and it being comcast = hilarious haha. For a second I thought it was your mobile phones speed!

You would only be penalized if the line in question is cancelled. I work for At&t in the city of long beach (company owned retail) and we get customers in our stores that do the same thing... if its not blackberries, its iPhones... but yeah. You could definately sell the phone, but u gotta keep the 2 year commitment.

Will a LTE sim work in a 3g phone? I know commingle from an infuse to a Skyrocket I had to get a new simcard. Not sure if that would affect your contract

Yes! I took the sim out of my phone LTE Skyrocket and put it in my old cappy to get my contacts on it..LONG STORY WHY I WENT THIS WAY...but none the less..I kept the SIM in the phone for 3 days with no issues. Works fine!

You also have to remember it came out of a retailers mouth not a corporate agent. I will only deal with cor stores. The hell with retailers

You Dont have to keep the data plan. Very common misconception.
Newter55 is correct. Remove that data plan and save yourself $25 (or $15) a month. As long as the line in question is active, you will be fine. I know going into corporate retail can be a major drag, but it beats dealing with authorized retailers... it seems like lately 95% of fraud gets tracked back to dealers... everytime I get manager escalation regarding fraud, its the first question I ask my customers.. and 9 times out of 10, it all goes back to them. The funny part is when u try to contact the dealer and they act like you are speaking Swahili lol...

If it's something like the contract that I signed with Amazon, if I remove my phone/data package within the first 6 months, I will get charged $250 (from Amazon, not from AT&T). This is partly because I got the phone for $.01, instead of $249 like I would have paid directly through AT&T.
This is usually only the case with e-tailers. I have not yet seen this type of thing from authorized retailer stores, but there's a first time for everything.

That's exactly my concern is too. I got the phone from Amazon for $0.1 and I am thinking about selling it and getting either the LG Nitro or Samsung Note but I'm worried about Amazon charging me $250.
It all depends where you bought it; read your contract. Do you have a contract with just AT&T, or do you have one with your retailer as well? If you have a contract with your retailer, for instance Amazon has contracts, you will pay a penalty if you change anything or take the phone off the line, even if you change the number. If you don't have a contract with your retailer, then you just have to deal with AT&T--for instance you bought the phone at Best Buy or a Corporate store. They don't seem to care what you do, as long as you pay your bill. Be careful, many AT&T stores look corporate, but are actually third party retailers.
Again, read your contract/contracts. Don't trust the advice of people who haven't read YOUR contract.

I disagree completly i bought a tmobile phone from amazon and sold it no penality same with att. They dont even know you sold it amazon cant monitor you att acount too see if you changed devices on your account. You sir are wrong. That would mean if you had an old phone and wanted to pop your sim out of your new one and use the old one amazon would charge you 250 because ur not using that phonE. Amazon does not know they get money from ATT for selling you the 2 year contract.... if you terminate you contract before the 2 years then yes they can charge you for it

[Q] Wanting to switch to the blaze questions

Hello all, and first off, let me say congratulations on getting official CM10 and CWM support!
Here's my story (and before anyone asks, I have searched the forums for an answer, but was unsuccessful with finding my specific questions): I am currently on AT&T (was Alltel before they were bought out) with an HTC Aria and my contract for a grandfathered plan was up long ago. It is time for me to upgrade to something a little more modern and I have settled on the Blaze because of its size (I'd like a GNex, but my hands are too small) and a number of reasons. But the biggest reason is that, as I understand, it has full compatibility with both AT&T and T-mobile's 3g (4g for t-mobile) and 2g/EDGE networks.
I don't really like AT&T as a company and I also really like the monthly 4g plans that t-mobile offers. My problem is that according to t-mobile's prepaid coverage map, I won't have data service for most of the area I travel back and forth in (upper midwest USA). And as much as I dislike AT&T, they have good 3g service almost everywhere I go. So, I'd like to be able to take my current sim card and switch it and a t-mobile sim at will while I test out both service providers.
Therefore, my questions are as follows:
1) Where is the best place to buy a blaze off contract? I'd like to get one on ebay because of the price (~$200 is what I have set aside for a new phone), but there aren't that many there, and even fewer that specifically say they are unlocked - which leads to question 2.
2) Can I unlock any phone that is not on a contract (basically anything I would buy used online)? I spoke with a rep from T-mobile and he seemed to indicate that I could only unlock a phone if I was the original purchaser of it and the plan (and account) to go with it. Therefore, according to him, I would have to make sure the phone I bought was already unlocked, otherwise there would be no chance of unlocking it in the future. I would think (possibly incorrectly) that as long as I have a t-mobile account (I plan on buying and activating the $30 monthly 4g plan as soon as I receive the device to compliment my current ATT service), they shouldn't have a problem with giving me the unlock code because they did not subsidize the phone. Could anyone clear this up?
3) There are a number of sites claiming to sell unlock codes for a myriad of devices. I would consider something like that if there was no other way to unlock a second hand phone, but only if I was sure it would work and the site was legit. Are any of these sites legitimate and have you had experience with any of them?
It would be considerably cheaper and easier to find a used device that isn't unlocked, but like I said, I'm not sure if that would bite me in the rear because there is a strong chance that I will stick with AT&T due to them having service where I travel. 1.) Good luck. Not many people are willing to sell their blaze, especially after the past couple weeks three weeks ago you could have had a lot of takers ebay would be your best bet
2.) Tmobile rep led to you like they're supposed to. anybody can request an unlock code for their phone. Naturally if you're on their plan, they'll verify that you are the owner of the account, but still. That being said, just because you can ask doesn't mean they'll give out. If you had a plan (not prepaid) for a year or two in good standings with no late payments and said you were going out of the country for a couple months and want to use your phone on a foreign gsm network, they'd bee more inclined. As a brand new prepaid customer, good luck. Best of buying it unlocked or getting the unlock code elsewhere.

And use paypal when you can, you could always claim you didn't get the service you paid for. Same goes with ebay buyer protection.

Like the other reply. If you bought it from t mobile and said you had to go out of county for work. And would appreciate the unlock code to use other GSM networks. While away. They get commission, so if unlock is the deal breaker, they'll prob give it to you. Or if you ask enough pple. Nicely I'm sure someones bound to give it to you.

I've been with t mobile for 12 years if I happen to stop at a t mobile (which I plan too) ill ask for code

But the biggest reason is that, as I understand, it has full compatibility with both AT&T and T-mobile's 3g (4g for t-mobile) and 2g/EDGE networks.
I don't really like AT&T as a company and I also really like the monthly 4g plans that t-mobile offers. My problem is that according to t-mobile's prepaid coverage map, I won't have data service for most of the area I travel back and forth in (upper midwest USA). And as much as I dislike AT&T, they have good 3g service almost everywhere I go. So, I'd like to be able to take my current sim card and switch it and a t-mobile sim at will while I test out both service providers.

Have you considered a carrier like StraightTalk? StraightTalk is a MVNO which resells both T-Mobile AND AT&T service. You can specify what kind of SIM you want when you order it online. Their service prices are pretty good, and in theory their network is basically either AT&T or T-Mo depending on which one you pick.
I've seen mixed reviews on their service and whether or not they'd throttle you on excessive service... some great, some bad, so it'd be caveat emptor, but if your usage pattern doesn't change, you'll likely be fine. Either way, it's up to you to do your own research (as someone else mentioned).

I like eBay. Craigslist can be a little scary because the phone may or may not be stolen. T-Mobile and AT&T have already started disabling phones by their IMEI that have been reported stolen by the user or by the insurance. Soon they'll also start sharing that database, so the phone won't work anywhere in North America if that's the case. There are plenty of scams when it comes to craigslist where a "brand new phone" is purchased and then suddenly reported stolen because it was noticed missing from a back room.
This was my biggest fear in buying my S3. On eBay you get to see things like ratings on the sellers so you can find someone trustworthy, like I did Also, make sure to exercise common sense. If something's too good to be true, it very well may be.

You can unlock any phone you buy, legal or otherwise. T-Mobile has never cared if I was the original purchaser or not, and they shouldn't. They'll only care if it's an original T-Mobile phone or not. T-Mobile will give you an unlock code for a phone as long as you've had 90 days of uninterrupted service. On prepaid they want you to have 60 days (I think) with enough of a balance in your account to pay for another month's service. Not sure about the prepaid requirements, but you can look those up online.
Also, if you just wanna test service, I wouldn't do the monthly 4g $30, I'd do a daily. $3/day gets you relatively unlimited access, and you only need a few days worth to make a decision. Plus, you likely wanna switch to one of the better all-you-can-eat plans, and wouldn't want to be stuck for a month with the cheaper plan. It isn't easy to switch until the month is up.

I've had good luck purchasing codes from eBay. Never had them not work. But with everything eBay, make sure you're using someone reputable.

If it's cheaper to find it locked, then just get it locked and buy an unlock code later. If you aren't going to use AT&T service, then you don't need to SIM unlock the phone anyways. The phone will automatically work on t-mobile, unlocked or not. Finding a good carrier is difficult, I know.
If you decide to try straight talk, you could probably go with a T-Mobile SIM that wouldn't require unlocking the phone. If you find the service lacking, you could switch to an AT&T sim and then deal with unlocking the phone.

If it's a T-Mobile phone and you have T-Mobile as your carrier, you can call customer care and tell them you just got service with them and are going overseas and need it unlocked so you can use a foreign sim card in it. Thay usually works well.
If not, ask to speak to a supervisor. When transferred, ask the person if they are a supervisor or just an escalation rep. If they are not a supervisor, ask them if they can help you still.
If they won't, ask to speak to an actual supervisor and try again. If all else fails, you do have a window of time to cancel, so you can always tell them you are thinking of canceling and they will probably transfer you to a retention rep. That one's a gamble since you're bluffing.
If retention won't help, hang up in the middle of a sentence and call back. Chances are, you will get a different call center and you can say you got disconnected and try the process again.
That gives you up to 6 potential reps who can help... and they can. I was customer care for a couple years and then in corporate engineering for several years. They are flexible, you just have to play the game.
Probably not the answer you want, but it's what you will have to do to get it unlocked quickly

I have always stayed away from anything that requires a cable. If they can't get you a code based on your IMEI, I don't bother. I used one of those once and I don't remember if it ever worked or not.
The daily plans don't seem to be well advertised on the site. I found them this time around by going to the "no annual contract plans" and then scrolling down to the bottom for daily and other services. Check it out here. I believe their prepaid coverage map hasn't been updated in ages on the site. Supposedly their prepaid coverage map is about 98-99% like their postpaid one. The main difference between the two is that prepaid doesn't allow you to do conditional call forwarding. This is necessary if you want to use another service for voice mail instead of T-Mobile's crappy voicemail.
When I signed up for Tmo they gave me 30 days to confirm if I wanted the contract. You can get a plan and if you dont like it you can just return it before the first 30 days are up and only pay for the minutes you used. This was a big deal for me as I cam from ATT like you, but needed to knwo how well the Tmo service was. I would suggest getting the unlimited everything for $60 a month. Tmo I must say has pretty good customer service. I have had a few problems with them but all it takes is a little social engineering on the phone (saying sprint/whoever will pay your ETF) and you can get some pretty good stuff
I got $10 knocked off my bill for the duration (18months or so) off my bill for an overcharge I got. I also got two free blazes 2 months before my contract was up for free as well. Plus, when/if they are bought out there is a good chance contracts will be altered/changed allowing you to get out of your contract early

On a side note, does anyone know if the new 64 GB microSDXC cards are supported by the blaze? I just know that I'm gonna feel the pinch of 32 GB eventually, lol. (I already had to be picky and choosy about what was on my 16 GB card before it died)

nope. there's not many devices out there that support SDXC yet. As time goes on, it'll gain more popularity, but lets face it, as awesome as it is, the blaze is only a mid range device. I wouldnt trade it for any other phone out there, i love my blaze, but still.

Well, that's mildly disappointing, but it doesn't affect my decision making about the phone. I'll have to somehow get by with only 32GB of storage. Speaking of which, how close is a solution to the camera only being able to save to the paltry internal storage? I do like to take lots of pictures with my phone, so this is obviously something I would hope to find a solution to.

Yeah. In a sense, CM9 has a bunch more features. When CM10 started, they basically started from scratch, and the focus was on project butter and some other things. Then they had to start forward porting their CM9 additions into CM10. There are a bunch of things in CM10 now that weren't there just a week or two ago. I think the camera thing will come, just like other features. It seems like the features are starting to come quicker too.
Keep an eye on the changelog. It lists the changes with each release

I bought a 64gig card off Newegg about 3 months ago and it's been working just fine in this phone. In fact, what I read online indicated that just about every "recent" Android phone had no problems reading them at all.
So hey, ther'es that.
And yeah, having 64gigs is nice, especially since this phone has such small amount of user storage on the phone.

all 64gb microsd are categorized as sdxc, and most of recent android phones do work with them.
I just switched to T-Mobile and got 3 Blaze phones. They should arrive today. I only took them because they were free, and I didn't want to pay for GS3's. I'll be selling one right away after the Note 2 is released. If your still looking for one in a couple weeks, lemme know.

Dude, can I ask a HUGE favor? can you not root them immediately?
I'm trying to help the dude that's been helping me with the CM access. He wants to get a copy of a partition in a virgin state (ie... not rooted or modified at all). He's trying to find a way to reset the flash counter. I'm trying to assemble a stock ROM that will be pre-rooted and won't trigger the counter.
If you can avoid rooting 1 (or better yet, 2 in case more testing necessary), I'd really appreciate it. And it'll help the community in the end

Do not buy used phones: you are powerless!

So I know this type of discussion isn't really related to developing but since this forum was basically THE Android forum for me, I would like to get the word out here. I don't want another victim like me to happen; I hope this will help any future phone buyers from falling into the trap I did. This is going to be a long story but I hope I can clear up all this confusion about used phones, so strap in!
I bought an iPhone 4S last year from a guy on Craigslist; he offered to meet at an AT&T store to verify the clean IMEI and this action alone made me go against my gut instincts, which were telling me this guy looked kind of sketch. He was a white male in his late thirties, pot belly and dressed really sloppily; also had a slight hunch. But you can't judge a book by it's cover right? His story was that this was his wife's iPhone and that he sold his own a few days ago because he wanted a Samsung Galaxy S3; the phone had one more year on-contract and came with the original box so I knew it wasn't stolen. I gave him my $400 after inspecting the phone and left. Fast-forward to this week...
The phone was given to my dad to use on AT&T a month ago; I used the phone on T-Mobile for almost a year and nothing unusual came up. Just two weeks ago, my dad started getting messages saying "This device has been blocked from network use. Please call your service provider..." Not making much of it or even feeling any panic because I was that naive, I thought to myself "no way the previous owner would call in a year later to blacklist his phone. Who would even do that?" I called AT&T and after an hour, the representative was getting annoyed and said "I'll open up a case; wait three days." Three days pass and I had no word from them; I called in again and after another hour l found out my case was closed and got transferred to the supervisor. To sum up what he said: the phone was fine on T-Mobile until it was registered in the AT&T system, the owner can block a phone years down the line because the "30 days since it's loss" translates to "30 days since it's last been used by ANYONE," and that even if I have proof I bought the phone, only the original owner can remove it from the blacklist. So wireless carrier's have this huge hole in their policy that creates victims for people who buy phones secondhand and they honestly don't give a crap because it earns them money. I asked "so there is NOTHING to protect people like me? You can't even tell the police who this guy is?" He brushed me off and told me to call the police and open up a case, even if the police do get involved though, he said their company will stay quiet.
So I ended the call, speechless and dumbfounded. Lost, confused, and frustrated, I went to the police station in my city, but it turns out I lived outside the city limits so I had to call a dispatcher in another county; after the short conversation, the dispatcher told me to wait for an officer to call. The straightforward police officer, being much more friendly and understanding than the people at AT&T told me "since the phone wasn't actually stolen, it's a civil issue; the only thing you can do is try to find this guy and take it to court. We don't get involved in these kinds of matter. I know it's tough to accept but the wireless companies just want profit and this policy that creates victims like you gets them what they want. This happens all the time and us police officers can't do anything about it. I'm sorry for your loss and I really wish I could help but this is the truth; you're left to your own devices now. Whenever you buy a phone secondhand YOU TAKE A HUGE RISK!" I'm hung-up the the phone in a better mood than I was because someone actually had sympathy for what had happened to me. Left here with just an e-mail address, I knew there was no hope of finding this guy; this person that was a criminal in a moral sense, and yet was not in a legal sense. What this guy did, the police officer said it's COMPLETELY LEGAL!
So the best I could do was go on Craigslist again and find someone who wanted a phone with a bad IMEI for parts or use overseas; I guess luck and karma were on my side and this guy quickly responded, wanting to buy the phone for $200. It turns out he worked for a company that fixes phones and ships them overseas to sell. I knew this guy, who was in his late twenties and rotund, was trained in buying phones; he brought a toothbrush, SIM card remover, and various other tools to inspect the device. I was uneasy during and after the deal; left scarred and paranoid from the previous Craigslist experience. To show how paranoid I was, I even went to a bank teller, asking him to check if the money he gave me was fake. After this ordeal, I realized that spending that extra $300 to buy a brand new phone is worth it; all this stress, mental exhaustion, and time is worth saving by putting down that extra money.
But the problem wasn't over; I bought a T-Mobile HTC One on Swappa for myself when I gave my iPhone 4S to my dad, although from a trusted seller, I knew I could not risk it anymore. Even though I know this guy's name, address, PayPal account, and had proof of purchase, I was still powerless; the wireless and insurance companies don't care about the facts. The merit of facts flies out the window and all they do is put their fingers in their ears and scream "OUR POLICY!" But I remembered during the escapade with the AT&T supervisor, he said I could have transferred the ownership of the phone. To get my facts straight, I went to T-Mobile with all the evidence I had saying I bought this phone from Swappa; I didn't bother with the bottom-feeders and went straight to the manager. Guess what he said? "We can't tap into the system and transfer ownership of a phone since it's tied to a contract. The best we can do it make a note on YOUR account that you bought this phone; this won't prevent it from being blacklisted but it will help if you decide to escalate the issue to Asurion (the insurance company)." Now I thought to myself, "would Asurion even give a damn?" The answer: NO; no they would not. They would most likely try to push the responsibility to someone else and dismiss this huge hole that creates helpless victims because their business runs on customers "losing" their phones or getting it "stolen," and then paying them to replace it.
After all this time wasted trying to get to the bottom of things, I'm left with the cold hard truth: you WILL get burned if you buy a used phone and there is NOTHING you can do about it! NOTHING! The best you can do is to take matters into your own hands and sue; the companies don't care and the police can't help! Save yourself from what has happened to me; just spend that extra $300 to buy a new phone. It's worth every penny for that extra security because this world is full of people who will take advantage of you! I can already feel my idealism fading...

That was a long read but well worth it sorry that happened to you man, But i think recommending people not buy a second hand phone is somewhat extreme not everyone is a crook and are out to get you.
Anyway glad you were able to recoup half of the money back.
I often meet with someone on the way to sell me a second-hand mobile phone, I did not bother these people.
I bought my HTC one s from a local pawn shop. It was a fido phone which I unlocked and use on Telus network. So basically as long as you buy a phone which was not on the carrier you are going to use it on, then you are completely safe right?
Could you not have still switched that iPhone back to T-Mobile?

This applies to me as well. Without getting into too much detail: Purchased a late model android phone from Craigslist, an unlocked AT&T branded device and I use T Mobile. Fast forward until 2 weeks ago the phone would no longer make calls and gave me a specific error code which I forget now. Turns out that code meant "stolen or lost device" and it would no longer work on any US cellular networks.
Someone who isn't me was unsuccessful in changing the number that shall remain nameless in order to get the phone working again.... that is all

Now i am living in europe, so this doesnt really bother me, yet i am still curious: what if you buy a htc one (for example) that someone had with contract, and root it? Would it still be in a blacklist? And for the iphones: does a jailbreak do the trick to get the phone going again?
Also, sorry for your experiences :/

Nope. Software modifications won't do anything as your IMEI has been blacklisted. The only way around that is a new motherboard.

Anyone know if this affects Canada the same? For example using an unlocked fido/rogers phone on Telus. Do they share a blacklist too?

Buying used phones entails some downsides, like not getting to claim warranty, and this blacklisting thing is really sad, but, meh, that's why we buy them cheap.
Also, I feel the lesson here is, take precautions when buying second-hand, for instance, leave the phone unused for 31+ days. Buy a bat and work out. Take incriminating photos of the seller, etc.
Anyway isn't it possible -although illegal, I know- to change your IMEI?
Seems to be "common" losing/changing it when flashing ROMs.

So what is the point of someone blacklisting a phone a year later? Do they get a insurance claim or something.
I have bought used sprint phones for years, but now that I am using a phone (tmobile) with a sim card/imei it seems that you are more likely to get screwed.
Does swappa and PayPal not protect against this issue? And if not what the hell is swappa charging the customer $10/transaction for?
I am almost positive I got this same error a couple of years ago on a phone purchased directly from AT&T. It was a bad SIM card. I wasn't able to make calls or anything. They replaced the SIM and it worked. So for those who buy a used phone and get that error, check your SIM card first.
I've been buying and selling used phones for the last 2 years and never had an issue. I've don't buy off craigslist though, I stick to swappa or ebay where you have some protection via paypal. Yes you always run the risk of someone reporting the device lost/stolen after the sale, but that's why you only buy from reputable/rated sellers and skip on anything that looks too good to be true.
I'm sorry to hear you got screwed on your iphone, but I wouldn't consider your experience the norm. As for the warranty/insurance issue on your other phone, that's just how it is, do your research. The warranty only applies to the original buyer of the device (when bought through an authorized retailer). Same with insurance, you can only add it in a certain time frame when you've bought the phone from an authorized retailer.
However, some carries do have an "open enrollment" where you can add insurance to your device regardless of when/where you bought it. Verizon actually has it going on right now through Dec 2.
