Ok i made a loss claim on my sgs4g on tmobile after three days of not having a phone and wondering where the hell it was. That said, i have since recieved my insurance replacement. Today I was cleaning out my car (a weekly ritual) and found it beneath the passenger seat. My question is simply what do i do with it? It is a gsm phone so no blacklisted esn, so can i sell it or give it to a less fortunate friend to use? What are my options?

You should ring your insurance company and ask them what to do. They may say to just forget it, but they may want you to send it back to your provider. Either way you've done the right thing so there's no comeback. After all, you did get a replacement so they played their part. Now it's your turn

Just because it's a GSM phone doesn't mean it can't be blacklisted.
T-Mobile will blacklist the IMEI if the device is reported as lost or stolen.
As Archer has suggested, just phone up your insurance company and ask them, however, don't expect the phone to work for very long.
I had unlocked it, does that matter? btw im not sending it back.

If I were you I'd give it to a friend or use myself , try to change imei if possible. ( No idea how )

Sim unlocking is purely allowing the device to accept sims from another network.
IMEI changing is certainly illegal in the UK and I'm pretty sure it is in the US and Canada.

Sell it to someone overseas, these go for 150-165 in xda marketplace, so a blacklisted one for 50-80 is fair enough.. have a small party with the cash and forget about it!!

I have sold an evo with a broken screen on ebay that was replaced with a insurance claim. I listed it with a bad esn, i could be wrong, but if you said the phone was lost or stolen in the insurance claim the esn is now bad.

so im useing my inspire 4g on att, i have been paying the $5 bucks a month for insurance for a year, i know that if i lose my phone it will cost $125 bucks to get a new inspire, i also know that the inspire is branded to att, so i got a couple questions, what if i was to throw away the sim card i have now and go claim that my phone is lost, could i then buy a new inspire for $125 and switch the sim card back and forth if i so desired?, and would they notice if i did? i want to use one sim card in two different inspires? any one have any info or opinions on this?

fraud huh, so life in prison huh, lol, so about the IMEI's being recorded, am i gunna get caught, ill sleep in the bed ive made when that time comes, but do they keep close tabs on these kinda things? and lets say i dident use my insurance and just bought one flat out, would i then be able to switch the sim back and forth with no problems?

Yeah if you bought one flat out, like off contract and everything. That wouldn't be a problem. And I suppose if you got caught trying to report a lost phone to get another one, the worst they can do is charge you for the phone?

So i bought my girl a sidekick 4g because it was $100 on craigslist and seemed like a good spare. Today she decided to use it and her data wasnt working so she called t-mobile and they said it could not be used due to fraud. So... How do we make it possible to be used?
Edit: Data works now...but no texts or calls. I really don't wanna be down the $100 I spent on this POS.

That's what I was afraid of hearing. Funny that it took about 24 hours to kick in. What's worse is that the phone was in the box sealed so I just thought they were in need of holiday cash. The good news is that I might have found a solution but I'm gonna have to root. Man oh man... If I can just get it to work then I will not have to be down. I guess even breaking even at this point would suffice.

Yes. Her other phone is a myTouch 4G and she just wanted something to change out to when her battery died (which is all the time) and was bored. She was still gonna use it as a phone.
I have never heard of tmo doing this. If you have another 4g phone. .. just use that to add 4g data to that particular line. then put that sim card into the sidekick.
Tmo uses gsm, not cdma and such like verizon and sprint. they have no way to see if phone is stolen or not, they can't block it like like esn numbers on verizon and sprint.

Its because its a stolen phone. I would hope if they stole your phone TMobile would make it harder to profit from that theft.

No it wasn't reported stolen from what the rep said. They said it was fraud. I asked for more details but i couldnt get more. After doing careful research, T-Mobile will block IMEI's only when it is beneficial to them. That does not mean protection for customers though.

When we met up with the guy she focused on trying to make the call first and since it worked i proceeded to pay. Dont ask me why the hell i never thought of waiting for data to kick in. (Which it didnt for two days at which point calling and texting became impossble on the phone.)

so i managed to talk this guy down on a samsung note a few days ago. box and all for a very good price. well today he calls me asking if it would be cool if he filed a claim on the phone saying he lost it. i told him no way! i also said that i have the box with his name and # labeled on it and that i would in no way support him if this comes down bad.
i guess my question is...if he tries to scam att or the insurance company what will happen? i rooted and unlocked it and use tmobile. just want to know if this is gonna come back on me.
he had other calls on the phone and wanted make a few extra bucks doing this scam...

You should be fine, AT&T to my knowledge doesn't block IMEIs on lost/stolen phones. There is also no network collaboration between TMO and AT&T for IMEI blocking either, so you'd be doubly fine on T-Mobile.
It's definitely fraud on the part of the seller though.

i have his box with his info on it. also have the text messages backed up with our agreement. lastly when i was on my way to meet him and awaiting that was all via text. backed up!
Then you shouldn't worry. You've got more than enough evidence to prove you got the phone legitimately. If he tries to pull an insurance job, he'll be the one to get busted since you have proof you bought the phone and not nicked it.

I remember reading somewhere(engaget maybe) that there is soon going to be a blacklist of lost/stolen/banned devices and that providers are going to get in on it.

I was not going to participate in a scam. I never heard from him after that phone call. I did look to see any other notes from him on Craigslist. Have not seen any so I'm assuming he got the hint.

Still not clear, but thank you. I will be making a profit from the sale of the phone. I'm worried that when I purchase a new phone, and activate it with ATT I will be flagged since its not the phone I originally purchased. Anyone with anymore insight care to chime in?
I dont think it should be a problem just tell them you bought another phone to use whe you go abroad. As long as you still pay your bill should be fine
