Apple-sues samsung for copying Iphone/Ipad - General Topics

http://www.engadget.com/2011/04/18/apple-sues-samsung-over-for-copying-the-iphone-and-ipad/
What do you guys think? Is Apple being copied by Samsung? They run different apps/os/hardware. Form factor is fairly close however......

Its mainly because of touchwiz. But I think they also sued for hardware which is kinda stupid.

I LOVE and agree with what the Author said at the end:
"And hey, if you're going to sue Google indirectly, you can't leave a major player like Samsung outside the courtroom, it just wouldn't be fair."

Way to copy, Samsung. Only Apple can use the patented design of putting the screen between the mic and speaker. Wait, what?

It will go nowhere, and in a way it is a huge compliment to Samsung. Apple is so worried Samsung is going to toast their sales, they go and do the oldest trick sue....... LMAO............ they did not get very far with Microsoft or any other of their so called lawsuits........ this will be no different.

It would be cool if sammy told apple to go F themselves when they want more components for there next phone

****ing Apple. What a stupid company that thinks the whole technology world revolves around them when it's in fact miles ahead of them.

That wouldn't be the professional thing to do.
The professional thing to do would be to raise the cost of the NAND, the A4, and the A5 to pay for all of the legal fees. That way, Apple is paying the cost of both companies fees.
Samsung has a right to raise the cost when cost to manufacture goes up. This is probably what they'll do.
Also, I have one more thing to say.
Samsung's lawyers response should be along the lines of: "We take offense to Apple's accusations that the Galaxy S phones and tablets are a copy of the iPhone and iPad. Our devices do not instantly make the user a douchbag. Nor are our devices incredibly gay."

Don't forget, Apple sued HTC last year for touch and gesture features, including finger-swipe unlocking mechanisms, power conservation, touch-screen scrolling, and accelerometer capabilities.

Apple thinks this will make Samsung lose money. If anything, it'll show how Apple is scared of competition, and Samsung will sell MORE. Anyways, they sell more the the Galaxy S line. You can't make them lose money.

Well, back in 2008 I owned an iPhone. It was the 3G model and I was very pround because it had high standards for a phone at that time (processor, GPU). But when Galaxy S came out I realised that the best hardware components met the best software and hey, it s open source! The first real iPhone killed is Galaxy S and Android needed this flagship phone to overcome the competition. Samsung won t lose the trial with Apple and the good part is that iPhone 5 will be more expensive and it will have even lower standards than it s predecessor (we all know that Apple A5 DualclCore is clocked at 900Mhz and is far behind Sammys Exyon @1.2Ghz or Qualcomm s DualCore Snappdragon)
Sent from my GT-I9000 using XDA App

First let me say that iPhone is by far the most popular phone in the world. And this is a stupid lawsuit, now when people are considering the iphone they'll think "wait, didn't I hear about a phone similar to the iphone that apple was suing for?". they'll find out about the galaxy s (or gs2 ) and get that instead. Congratulations Apple, you just lost sales.

He was the same to Adobe with regards to Flash. If it wasn't for Macromedia/Adobe, Apple would have died LOOOOOOOOOOOOOOOOONG ago. If it wasn't for Macromedia's software, graphic design and video editing software, and, of course, Flash, wouldn't have been designed on a Mac and Apple would have died a slow, painful, death. How many options does ios5 "steal" from android or others. Such is the nature of business. If someone buys something, another company is going to produce a similar product with their own twist to appeal to another group of consumers and some of the "original" company's. When one company started building suvs, and another company sees a trend they will too. If one company sees that ppl like rear window wipers others are going to manufacturer them too. Take something, build it to your liking and add in to it. There are few truly genuine and unburrowed ideas in today's business. If you think you have a niche in the market, don't plan on having it long unless you continue to innovate. Heck, apple even spends less on its r&d per revenue then goggle, microsoft, or rim. Because they gave up on innovation and spent more on legal departments and advertising?

Motorola's cavalier attitude will have them banned in the U.S. Does anyone even care?

http://m.engadget.com/default/artic...microsoft-patent/&category=classic&postPage=1
Unlike apple, Microsoft gave them plenty of chances. Only Motorola can be blamed, not like they were releasing anything revolutionary anyway.
Meh...w/ that said, the Razr (thinnest) and Razr MAXX (longest battery life) aren't revolutionary to you? Minus the locked BL's I still say the Maxx is one of, if not the best phone out currently overall.
I don't find either advance to be a game changer, now if they made a small battery with that much charge or a thin phone that retained durability I'd understand.
What's Motorola?
I don't see that lasting long. Google going to lay some smack down on Microsoft with it's new patient portfolio.

Motorola will most likely be singing a different tune once Google flexes the "we own you" muscle a little bit.
In this day and age, I just can't understand a company who doesn't embrace the open spirit of Android development. Developers can help a company so very much if that company will open it's eyes and stop thinking "only" with it's bottom line.
Obviously they'll work it out. Too many $$'s at risk.
These kind of things don't make sense to me. It is so stupid. So if Microsoft wins, then Motorolla will just change 1 small thing in their new phones and move on with life...

I actually had to watch that video to learn about it. Motorola DROID line up doesn't get much play on this side of the world. Still waiting for the fantastic Razr Maxx. By time it gets here, if it gets here, it won't seem so spectacular versus the One X and upcoming GS3. Which is a shame.
Back to topic, I'm sure something will be fleshed out, MS deals more than Apple and with that whole Motorola Xbox ban thing I'm sure MS has some motivation.
I do'nt care, by the way, who cares?
Moto is crazy about everything, I wonder why they are freaking out over some patent.

XDA's view on Apple

Hello,
since I'm still rather new on the forums, I would like to know what the people here think of Apple and their devices, and of course, why. I think I already understand people aren't positive, which I'm either. Speak your mind!
My view? Well, I of course prefer Android. The freedom of flashing Roms is great, Android simply is much more open. I also see many Apple products with broken screens, and I nearly never spot a Droid with one. Apple products are overpriced in my opinion, too. And as last, patents, enough said.
I have to admit that I maybe am a little too subjective. I think that the overall hardware quite good, apart form the screens, and its interface feel rather good.
Oh, right, I forgot to mention innovation, which Apple lacks

Hm.
Well, I would have to say that albeit the devices have a premium feel [with the two latest iterations], the Apple ecosystem is generally a money trap.
I'd rather have a Blackberry over an Apple device. At least I wouldn't have to be afraid of breaking it with a 2 foot drop.
They don't get nearly the credit they deserve. Particularly around here.
Innovation stiflers.
As for their products, they're okay, if overpriced and hard to unbundle. With Apple, we pretty much get accept-everything-or-leave-it devices, and I don't really like their design aesthetic - even Metro is preferable to me.
Nothing really special. Easy to use but they're not my type. Overpriced and very limited.
They make quality hardware but lackluster software, to closed/limited for the price you're paying. They also have those overtly absurd patents that endanger the mobile ecosystem as a whole.
I like the design, it looks professional and iconic. Other than that, nothing.
Sent from my XT862 using Tapatalk 2
They're a good company, superior marketing, but shameless and greedy.
The hardware on them is just wonderful (minus the processor, but I suppose it doesn't need it with their OS). If on Android, every OEM could team up to make an ultra phone (i.e. Sony Camera, Tegra graphics, Exynos Processor, Motorola durability/signal strength etc.) like Apple did with everyone else's parts... well I might not be saying the same thing.
Apple is sort of like the Firing Squad, and each of the Android Manufacturers are like the Lineup. Apple takes each of the best parts from each OEM and kills them off. For example (most recently) Samsung chips, but sues them. It's a great strategy. But also a pretty a-hole move.
In conclusion, GREAT HARDWARE, SMOOTH OS, BUT CLOSED SOURCED JERKS. That's just me.
I think they make a decent product that appeals to those who want something simple to use. If the company wasn't the biggest patent troll around, I wouldn't mind recommending their products to people. They only sell one phone and I think there are different wants from consumers. Some like a larger screen, some like smaller screens, some like QWERTY keyboards, some would rather have a thinner phone with only a software keyboard. They had a pretty nice looking OS in 2007, it looks outdated nowadays. Its also a very limited OS with minimal customization allowed.
I see apple as a onetime great company that allowed the untech savy people to fianlly have the ability to use the latest tech, then they gained such a cult following they realized they could be a little greedy, when that worked so well they set there sights higher until they became a very greedy company whos inovation spirit was lost and forgotton.
Then they decided they want everyone tobe an isheep and make it so if you don't choose them you cannot choose anyone.

The iPhone has always had the best build quality. The iPhone always felt really good in the hand. You really feel like your possessing something made for the gods. The only thing about the built quality that I don't like is the glass screen, it breaks so easily.
The iPhone has the most apps, iTunes, and no risk of viruses so your always secrure. The battery life will almost always get you through at least a day. The picture quality is remarkable, and the camera is easy to use. When there's an update (if your device is going to get it) you recive it almost immediately. The ios interface is simple, beautiful, and fun to use.
Apple is never influenced by other companies. They never put technology in there phones thats not practical (HTC releasing the Tbolt that only lasted 4 hours) (4LTE drains battery's way to fast to be put in a phone).
Having that said, I refuse to buy an iPhone until it supports a 4 inch (or bigger) screen that's 720p. And atleast 1.2 gzh dual core A5 CPU.
Yep, I'm picky

The only thing I like from Apple, having used the Iphone 4, is the app store.
I don't care how many apps there are for each platform, but in the iphone, hundreds of apps are very polished and made almost perfectly. This includes games. I'm not even going to mention games and apps on the ipad; when they're optimized correctly, they're beautiful. (see: snapseed, alienblue, etc) You just enjoy using those apps. Many apps and games on Android are just iphone ports, and due to fragmentation, you don't get 100% perfect games like the developer intended.
Other than that, I don't care about apple or their products.

Apple-Samsung Court Case

Looks like our beloved Charge was mentioned as a witness in this case:
http://www.technobuffalo.com/companies/apple/apple-samsung-trial-verdict/
- rubber band patent
- 915 patent (scrolling with one finger)
- 163 patent (double tap to zoom and center content)
- iphone trade dress (Charge was not in violation of this)
what this could mean for the future for the Charge? who knows?
good side: perhaps a software update to the latest OS with valid patents
bad side: a software update reverting these violations
neutral: nothing....
Here's a interesting write up about some sketchiness among the jury and the decision. In this light, it seems almost certain that at appeal is coming, if not outright dismissals on at least some of the violations under a Rule 50(b). With this much alleged impropriety, they may even be able to get a stay on the decision.
I doubt Apple is overly concerned with a low sale volume device like the Charge in the grand scheme of things. I imagine that the most that might happen is stopping production.

Cnet is reporting that Apple is requesting a ban on sales of the Charge (amongst other phones) in the US.
With appeals and other legal manuvering I have no idea whether this will really happen, but I wonder what it means for customers that have these phones... What would happen if you need a replacement from VZ?
It would be great if they just make them stock android devices with 4.1.1 like the nexus S...The resale value would double lol.
i would not be surprised to see VZW offer us a deep discount on upgrading to another device. probably something like $100 off the 2-year contract price of another device even if you have time left on your current contract. which is really nothing new, but it could easily persuade most out of the charge...

tldr but I'd like to know a summary
Sent from my SCH-I510 using xda premium
First article is showing how the only device that the judge felt confident in granting a sales injunction for was one of the few devices that didn't get any judgement against it. Literally, the only device the judge thought was a slam dunk got off clean, and others that she considered to be weak cases got slammed by the jury, which when taken with the earlier reports of procedural errors and bias points further toward an incompetent or biased jury. The second article compares this case to previous attempts by Oracle, SCO, and Microsoft attempting (and failing) to shut down other FOSS projects due to fear, and speculates (with good reasoning) that this could very well be a test case for patent reform that makes it all the way to SCOTUS.
This is just getting worse and worse. The jury foreman in an interview said that he determined that prior art didn't apply because "The software on the Apple side could not be placed into the processor on the prior art and vice versa. That means they are not interchangeable. That changed everything right there." Great logic, except that interchangeability isn't part of the definition of prior art. I can just be words on a piece of paper with no actual implementation whatsoever and still be prior art, yet he managed to convince the rest of the jury using that logic. Keep in mind that this is the same guy who has a patent and admitted that was thinking of this case in terms of defending his own patent.

Every time that guy opens his mouth, he strengthens Samsung's appeal and/or Rule 50(b) filing.

Did Apple really sell 9 Million iPhones on opening weekend? Not Really

Apple being Apple again,
According to Gene Munster, the 9 Million figure included channel fill inventory of the iPhone 5C which was around 3.5 Million. This means that the actual sell through figure was to around 5.5 Million iPhones sold to consumers during the opening weekend.
Source
Apple is so smart, the 5s and 5c both cost them less to manufacture than the 5 did, it was all a big ploy to make more per device and drop the 5 from the lineup.
There was safe and that is that I'll never part of Iphone buyers! lol
I think it is possible, but i think it is interesting, that they are not telling how many units of the iphone 5c were sold.
It is probably not a good selling product..
The 5C is an useless device if you have the iPhone 5, really, it just adds color, no great changes at all. For the iPhone 5S I can say is worth the change when you come from an iPhone 4S or 4. Besides, there're some serious security problems with that iPhone 5S fingerprint ID, it is now hacked and the vulnerability has been spreaded across the internet.

Y yes because most BELOW AVRAGE AMERICANS all over buy the iPhone because of various reason and the crap that the provide knowing that I can buy a $20 android that can so more than the junk they sell for $200 and the iPhone 5C is a joke. I'm only 13 years old but knowing that I go to school everyday watching all the kids with there crapy iPhone and me getting bullied for being an android user is just crap. iPhone is a full joke all the people who live around me even own this crap. For crying out loud my younger brother age 11 told me his kindle fire (1st gen) is way to boring and barley does much so he never used it then when I installed Cyrogenmod 10.2 on it he used to device everyday and he started to like Android but know he just loves iOS and all that crap. And for the spoild brats out there telling me that iPhone does more without jailbreak than android should shout their mouths and actually go learn something. ever since the first iPhone they haven't made any big improvements that make my mind go wow just the Same old if apple continues with all this iOS7 junk in the next 2-4 years the business will go dead. Looking at the way apple is going is really disappointing sad enough knowing that the brains of apple is dead but apple should put some effort into their work.
