Well...while I disagree with the sellers from an ethical view, the only thing they are doing illegal is using Faria's name as long as they purchase a legal license for Widnows Mobile 6 (if that's possible?). There are other ads selling this for up to $80 so far and they don't mention and rom cooker by name.

What is funny is that a couple of months ago i got a message ont his board for support for NTS vanilla that came on the guys phone when he bought it on ebay. He tried to tell me that I had to support him. I told him I didnt and he never replied. LOL.

AFAIK This guy is doing nothing illegal (apart from referencing to Faria).
It IS unethical yes.
But arent there allways cheap bastards around like this one. For a lot of phones the unlock s/w is 'free', but still numerous people sell it as a service and charge up to 20 euro for it.
They make money using the knowledge of others (of which a lot are the active members on this forum) AND they mis-use the lack of knowledge a lot of phone owners simply have.
I would say 'ban him from ebay' goes a bit far, but cant we simply take him out of business by just starting another auction with reference to the right threads and not charge at all?? That WILL teach him.

Is it Simlocked to O2? I bought mine new and sim-free last year for £624 so if locked might be considered expensive for a second-hand item when you consider if anything goes wrong with it, they'd have to go through you go get it repaired.

O2 do not, and never have SIM locked their Windows Mobile devices. The Flint is pretty much the standard HTC offering, though the current ROM does not have the HTC Home front end.
O2 also tend to do warranty repairs based on the IMEI, so do not necessarily need the original owner to mediate things, as long as you are using an O2 SIM.
It seems amazing that prices seem to vary from around £320 to well over £500 on Ebay.

Maybe if matmaneyre could point these things out in the item description it'd clear things up to the public in general and bring about a quicker sale

Yes- you're right. Ebay changed the rules at the end of last year, for better or worse, though as you say, it was never possible to leave FB for someone who didn't actually buy.

To be honest, by 'too complicated for me' I really meant not quite right for me, as it has too many features I am not going to use, and I think I would be better off cashing in and getting something more suitable to my needs. Hope that clears it up a bit. I'd have put that in the description, but it seems to take so long to create a good listing just the way you want it, minor things that the everyday person browsing for such a device just get overlooked when you preview your listing before submitting it. Once you get to a stage where you think it sounds and looks good enough, you kinda just go with it.
As you say, it's no more complicated than any other WM device. It is available as an upgrade through O2, but strictly only to business customers. They are extremely hard to get hold of otherwise. I hounded them literally everyday for a month because I returned my faulty Serra (see my signature) and they couldn't offer me an equal or better replacement. All their Serras were out of stock - really messed me about for 4 weeks. In the end they backed down as there was nothing else they could offer me.
They don't know their ear from their elbow.
And I didn't realise you couldn't leave negative feedback to a buyer as luckily I've never been in a situation where I'd want to, although that's really only on there to make people think seriously before submitting an offer. I don't want to be relisting all the time for the sake of someone not reading the buyer restrictions or trying to scam me.
Hope that explains a few things...if you're still wary,. check my feedback. I've sold all my WM devices of the last 5 years on ebay (see sig again!) And see my postcount and view my posts too. I am a real, genuine human!!

Just to prevent any further dispute... I initially offered him higher than what he wanted because I believe the price I'm offering is fair. I could either buy it from states and have it shipped, or buy it from my Ausi mate. I don't really know anyone in US, plus I would have to have someone use an american CC to purchase the item because Canada is an international country to the US although we are practically sisters. No need to be frustrated. I also hate it when the seller increases the price due to greed but I'm sure this is not the case.

Sears never charged me for my G-tab . . .

I bought my G-tab online Nov. 1 via PayPal, received the tablet, and assumed the transaction went through. I just checked and they never took the money! The transaction expired Friday and is listed as "Canceled" now.
Anyone ever experienced this? I kinda want to call them to see why they didn't take the money. But, I kinda don't wanna tempt fate and look a $398.99 gift horse in the mouth either! LOL!

That's interesting considering you've probably intentionally voided your product warranty by making software mods using roms illegally ported from other devices. An probably side loade d hundreds of apks for which you didn't pay the developer and most likely skimmed from a wares or torrent site, or Applanet.net.
Sound like a huge case of situational ethics to me buddy. Pick a position. If you feel so much guilt about things, delete your xda account and keep it moving.
id let them know, personally. when you start taking an active role in karma, as another stated in this thread, then karma starts taking an active role in your life. ive had way too many run-ins with karma to tempt fate again.

that's actually not even a valid argument except for installing non-paid for apps.
What you do to a device you own is your choice. You can flash anything you want to it if you choose....as long as you don't expect a warranty replacement if you screw it up. If I want to flash my toaster oven with the firmware from my microwave......more power to me. But when my toaster oven no longer works, it's my fault not the manufacturers.
Now getting a toaster oven you didn't pay for is a totally different argument (the original poster's).
Sorry OP, but it's called theft of a material item. You knew that you didn't pay for it, but are keeping it anyways. Of course, many companies tack on extra charges for services and steal from consumers, so it's a gray area. I guess if you look at it from the standpoint of "business is business" then it's fair. Dunno what to say.

It happened to me, I called to ask about my order being placed and available, shortly after I was charged. I had received my pickup email already, so I'm sure if I had picked up the order and said nothing, it would have not been charged.
In a perfect world, when you called to tell them about the error they should have said "we appreciate your honesty and we will not charge you because of it, consider this a gift". You win, and they win as you would be more likely to be a return customer.

this auction is look atractive for me because of it's price. - if this game is, let's say "nice", not good, perfect, or somthing around, but "nice", for 5000$ and production costs (around 10000$) and total of 15,000$ i need only let's say 28,000 sales of the game for 0.99$ to get my money back after all commitions.
so it's sounds like a low risk inventment.

Well, trying not to be too cynical about all of this, the ebay ad is from someone in Israel, you've suggested you're from Israel, so why not contact the seller, it should be easy for you in particular to do that I would imagine, and find out how much of a scam it really is.

The sort of thing someone creates, then joins forums all over the interweb making random posts on the end of old threads to make it appear that they're not a new member, then posting a link to the ad hoping someone will be stupid enough to make a bid.
