Well that's why I said I didn't know if I can post it here. They can close it if they want. Obviously it's not frowned upon that much.

Similarly, we take illegal software piracy very seriously, and our rules (which you are supposed to have read upon joining this forum) are unequivocal about it. Therefore you should know that you cannot post anything like this, as it is illegal and actually stands against the mores of what we do here.

Rather than jump to any conclusions or get all bent out of shape, I thought I'd politely and respectfully ask if the XDA mods can comment on this and to see if they would kindly share (or point me to, if it is already posted somewhere) the clear and specific criteria for what's allowed and what's not.
XDA has always had a very open spirit and feel to me and I'd hate to see any legitimate and helpful technical discussions squashed just because Google or T-Mobile might not like what we're saying (provided we're not advocating anything truly illegal -- and I'm referring here to things that will land you in jail, not simply about possibly wandering astray of the terms of service).
This has always been my go-to place for answers and I don't know where I'd go if I couldn't find what I was looking for here. The contributors here are top-notch and I haven't found the same quality on any of the other Android forums.
i'm not a mod but i may have some answer for you. the post you linked is speaking of a post in which someone was specifically asking how to copy applications from protected areas of the phone. there is really no need to do that since we can move everything to the ext2 partition and never lose our apps. the person repeatedly asked for the commands to do it and mikey threatened with a suspension. then a totally different person called mikey a dousche and he got a three day vacation. simply put *I* feel that if you do not know how to get the apps from your phone, protected or not, then there is no need to ask someone how to do it as it could potentially be considered warez and we do not like to see that here. warez is any post that specifically links or describes a way to get around paying money for a service, so if this person that was asking had managed to get apps from protected places then they could have bought an app, copied the .apk and refunded the app before the 24 hour limit and never actually pay a dime. hope this helps.
P.S. i hope mikey doesn't care i told his story for him

Warez are cracked or hacked versions of Games/Apps..

I agree with you pedmond.
When you are downloading something illegal with a warez link, you must know it cookiemonsterz.
I think in the Pack which a Member posted i nthe deleted post, contain some "illegitimate games", but i am not sur.
I tell "illegitimate games", a game in full version, without pay for it.

I just got my new HTC phone, before that, I was on a sidekick. Before this phone, the only games I could get were from the SK catalog
I've googled and found many many links to free games for this phone. I have no clue which ones are warez.
I am not nine, I am just new, which is why I was asking for help.
Am I to assume that anything outside of Windows Marketplace is warez?

Absolutely not. All you need do is when you come across a game of interest, go to the developers site (Game Loft for example) and see if it is a freeware game. If not then you know it is warez.

I can understand your new to the scene, but the same principal goes with everything...
If its too good to be true, it probably is!
There are numerous websites that state they are free ware, others that share information (normally stuff from scratch) eg. XDA..
If you come across anything just offering you apps/games for free, alarm bells should be ringing....
I downloaded the game Spinballs from the Marketplace, but it was only a demo
I found the full game from a website, so that's what warez is I guess

I saw an add in my local Clist the other day where a guy was offering access to free and most paid apps for download. He obviously wanted to charge a fee for this and didn't give a lot of details. He did say he'd add an app and then add "his servers", which update weekly. Sounds to me like another guy making a buck off of off something meant to be free and developed by the hacking community. I did a google search but only turned up old stuff from at least a year back. All of which had been patched. Anyone know what key words I'm missing or what he's using, it could be cool?

What's up Techies? What I was wondering - is where the line is drawn? How do you know your are commiting the action or process with what files?
From what I gather it is the illegal distribution Of copyrighted materials. I was reading and it seemed a guy just mentioned a program and he was chastised and boom thread closed. He may have posted a link and I didn't realize - I can't find the thread again, I was just meandering about the forums....

The way I've always looked at warez was... Is it full version, not beta or trial, and are you paying for it?
In other words, are you downloading something that you'd otherwise have to pay for in order to use?
Links to sources of that kind of material, even though it is not an actual warez item, are just as bad.

Warez is obtaining paid software for free or circumventing ways to pay for it. Providing links to sites/materials is just as bad and won't fly here.
We all need to read the Stickies, too. This is discussed in there. I think the post you referred to was asking for Warez, which is taboo here at XDA. The history is that access to, and discussions of, Warez\Pirated software threatened to shut down XDA several years ago. Imagine what life would be like without XDA.
Warez talks (solicitating links, request, posting, discussion or any talk) by any kind in threads or PM's will be shut down

Lol now you see this is where the Terms and Conditions comes in. When you made a Google account you abide by their rules. Now when you got your phone and entered the Play Store/Android Market the application asked you, do you accept the terms and conditions. You obviously clicked "Accept" without reading it, however you are now "attempting" to break one of the terms. In such cases that is "illegal", now let's discuss about XDA's rules.
Here is a rule that I quickly pulled out of the rules:
9. Don't get us in trouble.
Don't post copyrighted materials or do other things that will obviously lead to legal trouble. If you wouldn't do it on your own homepage, you probably don't want to do it here either.
