Most likely because official updates look for files on the target device to be identical to the files they are trying to update. If they find a discrepancy, they won't proceed to update the file.

I don't believe it is an apk. I think its built into the framework. Or if it is an apk it wouldn't work without the rest of motoblurs framework

There already is one for the Inc, just use that image in one of the inspire .zips. It has the same screen Res. so should work Http://Forum.xda-developers.com/showthread.php?t=1213781
