No, you can't install the premium app if it's not avaible for you. That means that the developer hasn't made it compatible with devices that doesn't have android 4.0+
The new XDA Premium app is built using the latest Tapatalk 4 API's which require Android 4.0+. So technically its not possible to use on devices running pre-ICS. Anyways, the various other choices are to use XDA free app or use the Tapatalk Classic app or Forum Runner.

root is available in general section, then you need to grab sdb.exe (also in the root thread) and then push your ringtones (ogg) via sdb push (like adb with android) inside the according directory. done!
